HomeMy WebLinkAboutSP-16-74 - Decision - 0007 Green Tree Drive#SP-16-74 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING LYRIC THEATRE COMPANY — 7 GREEN TREE DRIVE SITE PLAN APPLICATION #SP-16-74 FINDINGS OF FACT AND DECISION Lyric Theatre Company, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 14,087 sq. ft. multi -use building. The amendment is to construct a short walkway to accommodate a new exterior door, 7 Green Tree Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved for a 14,087 sq. ft. multi -use building. The amendment is to construct a short walkway to accommodate a new exterior door, 7 Green Tree Drive. 2. The owner of record of the subject property is Lyric Theatre Company, LLC. 3. The subject property is located in the Mixed Industrial - Commercial Zoning District. 4. The application was received on October 20, 2016. 5. The plan submitted is titled, 'Lyric Theatre Company & Green Tree Drive South Burlington, Vermont", prepared by Guillot Vivian Viehmann Architects, Inc., and dated 10/18/2016. DIMENSIONAL REQUIREMENTS 6. Overall coverage will remain at 53% but will increase from 42,965 sq. ft. to 42,997 sq. ft. (70% is maximum). All other coverages will remain unchanged. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following_ general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. Landscaping/Screening 7. Three (3) Juniper shrubs will be relocated to accommodate the new walkway. - 1 - *S P-16-74 DECISION Based on the above Findings of Fact, the Administrative Officer herby approves Site Plan Application #SP-16-74 of Lyric Theatre Company, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the new walkway. S. Any change to the site plan will require approval by the South Burlington Development Review Board o the Administrative Officer. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
