SITE PLAN APPLICATION #SP-18-44
FINDINGS OF FACT AND DECISION
Lyric Theatre Company, hereinafter referred to as the applicant, is seeking after -the -fact
approval to amend a previously approved plan for a 14,087 sq. ft. multi -use building.
The amendment is an after -the -fact approval to construct a short walkway to
accommodate a new exterior door and approval to add "personal instruction" use to the
property's umbrella approval, 7 Green Tree Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking after -the -fact approval to amend a previously approved plan
for a 14,087 sq. ft. multi -use building. The amendment is an after -the -fact approval to
construct a short walkway to accommodate a new exterior door and approval to add
"personal instruction" use to the property's umbrella approval, 7 Green Tree Drive. 2.
The owner of record of the subject property is Lyric Theatre Company, LLC.
3. The subject property is located in the Mixed Industrial - Commercial Zoning District.
4. The application was received on August 7, 2018.
5. The plan submitted is titled, "Lyric Theatre Company & Green Tree Drive South
Burlington, Vermont", prepared by Guillot Vivian Viehmann Architects, Inc., dated
10/28/2016, and last revised on 11/15/17.
6. The owner of record of this property is Lyric Theatre Company.
DIMENSIONAL REQUIREMENTS
7. Overall coverage will remain at 53% but will increase from 42,965 sq. ft. to 42,997
sq. ft. (70% is maximum). All other coverages will remain unchanged.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the
following_ general review standards for all site plan applications:

Landscaping/Screening
8. Three (3) Juniper shrubs will be relocated to accommodate the new walkway.

Bicycle Parking
9. The plan complies with Section 13.14 of the LDRs to include the new type and
location for bicycle racks, to accommodate the minimum requirement of two (2) short-
term bicycle parking spaces (50% of requirement).
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves Site Plan
Application #SP-17-73 of Lyric Theatre Company, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The allowable uses will be as follows: Agriculture & construction equipment sales,
service & rental; Processing & storage; Distribution and related Storage, with >15%
of GFA in office or principal permitted use by same tenant; Equipment service, repair
& rental; Transportation Services; Light manufacturing; Warehousing, processing,
storage & distribution; Recreation facility, indoor; Office, general; Research facility or
Laboratory; Printing & binding production facilities; Radio & Television Studio; Pet
Grooming, commercial greenhouse and personal instruction. If the Land
Development Regulations change so that any of the above uses are no longer
permitted, then those uses which are no longer permitted shall be no longer be
approved.
4. The applicant must obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the new walkway and prior to occupancy of any new use.
6. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
