REALTY - 5 GREEN TREE DRIVE SITE PLAN APPLICATION #SP-06-23 FINDINGS OF FACT AND DECISION K.C. Realty Inc., hereinafter referred to as the applicant, is seeking to amend a previously approved plan for a 20,160 sq. ft. mixed use building with an umbrella approval. The amendment consists of increasing the allowable traffic generation from 13 P.M. Peak hour trip ends to 25 vehicle trip ends, 5 Green Tree Drive. The Development Review Board held a public meeting on May 16, 2006. Mark Kelly represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved plan for a 20,160 sq. ft. mixed use building with an umbrella approval. The amendment consists of increasing the allowable traffic generation from 13 P.M. Peak hour trip ends to 25 vehicle trip ends, 5 Green Tree Drive. 2. The owner of record of the subject property is K.C. Realty, Inc. 3. The subject property is located in the Mixed Industrial & Commercial (10) Zoning District. 4. Thirteen (13) vehicle trip ends were approved as part of a conditional use and site plan approved on July 10, 2001. Because the applicant is proposing a change of use in the building that is estimated to generate 20.77 vte's, the applicant is requesting that the Development Review Board approve 25 vehicle trip ends. All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. - 1 - #SP-06-23 2. The subject lot shall be approved for a maximum of twenty-five (25) PM Peak Hour Vehicle Trip Ends. 3. Any change to the site plan shall require approval by the South Burlington Development Review Board.
