STm py QdT TIQ)GN CINMSERS State of 'Vermont WATER SUPPLY AND WASTEWATER DISPOSAL PERMIT LAWSIREGULATIONS INVOLVED Environmental Protection Rules Effective August 8, 1996 Case Number: WW-4-1181 PIN: EJ98-0169 Landowner: AT & T Communications of New England Address: 449 Hamilton Avenue White Plains, NY 10601 This project, consisting of constructing a 7,000 square foot structure for a telecommunications facility with a maximum of three employees on Lot 48 of Subdivision Permit EC-4-1120, Green Tree Park, served by municipal water and sewer services, located off Greentree Drive in the city of South Burlington, Vermont is hereby approved under the requirements of the regulations named above, subject to the following conditions. This permit does not constitute approval under Act 250 case number 4C00149. GENERAL This permit does not relieve the permittee from obtaining all other approvals and permits as may be required from the Act 250 District Environmental Commission, the Department of Labor and Industry -phone (802) 828-2106 or (802) 658-2199 and local officials prior to proceeding with this project. 2. The project shall be completed as shown on the following plans which have been stamped "approved" by the Wastewater Management Division: Doc. Control #: ERN #45040, Sheet SP02 "Site Plan Utilities" last dated 04-27-98 and Sheet POI "Plumbing Site Plan and Details" last dated 04-27-98 prepared by CIMA Group. The project shall not deviate from the approved plans without prior written approval from the Wastewater Management Division. 3. No alterations to the building that would change or affect the exterior water supply or sewage disposal, or the approved use of the building shall be allowed without prior review and approval from the Agency of Natural Resources. Water Supply & Wastewater Disposal Permit WW-4-1181 AT & T Communications of New England Page 2 4. The Wastewater Management Division now reviews the sewage and water systems for public buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit. 5. By acceptance of this permit, the permittee agrees to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental/health statutes and regulations, with this permit. 6. All conditions set forth in Subdivision Permits #EC-4-1120 and #EC-4-1120-Ishall remain in effect except as modified or amended herein. 7. A copy of the approved plans and this permit shall remain on the project during all phases of construction and, upon request, shall be made available for inspection by State or local personnel. WATER SUPPLY 8. The project is approved for water supply by connection to the municipal water system. No other means of obtaining potable water shall be allowed without prior review and approval by the Wastewater Management Division. 9. The exterior water supply piping herein approved shall be routinely and reliably inspected during construction by a Vermont -registered professional engineer who shall, upon completion and prior to utilization of the system, report in writing to the Wastewater Management Division that the installations was accomplished in accordance with the approved plans and permit conditions. SEWAGE DISPOSAL 10. The project is approved for wastewater disposal by connection to the municipal sewer system for a maximum of 36 gallons of sewage per day. No other method of wastewater disposal shall be allowed without prior review and approval by the Wastewater Management Division, and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. The exterior sewer collection system herein approved shall be routinely and reliably inspected during construction by a Vermont -registered professional engineer who shall, upon completion and prior to occupancy of the subject establishment, report in writing to the Wastewater Management Division that the installation was accomplished in accordance with the approved plans and permit conditions. ADDRESS: 440 Hamilton Avenue White Plains, NY 10601 District Environmental Commission #4 hereby issues Land Use Permit Amendment #4C0149- 14, pursuant to the authority vested in it by 10 V.S.A., Chapter 151. This permit amendment applies to the lands identified in Book 419, Page 598, of the land records of the Town of South Burlington, Vermont, as the subject of a deed to AT&T Communications of New England, Inc., the "Permittee" as "Grantee." This permit specifically authorizes the construction of a one-story, 7,000 sq. ft. telecommunications building with related site improvements on Lot #8, a 1.70 acre lot off of Green Tree Drive in Green Tree Park, a previously approved commercial/industrial subdivision in South Burlington, VT. The Permittee, and its assigns and successors in interest, are obligated by this permit to complete, operate and maintain the project as approved by the District Commission in accordance with the following conditions: All conditions of Land Use Permit #4C0149 and amendments are in full force and effect except as amended herein. 2. The project shall be completed, operated and maintained as set forth in accordance with the plans and exhibits stamped "Approved" and on file with the District Environmental Commission, and in accordance with the conditions of this permit. No changes shall be made in the project without the written approval of the District Environmental Commission. 3. The District Environmental Commission maintains continuing jurisdiction during the lifetime of the permit and may periodically require that the permit holder file an affidavit certifying that the project is being completed, operated and maintained in accordance with the terms of the permit. 4. By acceptance of this permit, the Permittee agrees to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental and health statutes and regulations and with this permit. By acceptance of the conditions of this permit without appeal, the Permittee confirms and agrees for itself and all assigns and successors in interest that the conditions of this permit shall run with the land and the land uses herein permitted, and will be binding upon and enforceable against the Permittee and all assigns and successors in interest. , -- 6. The project is approved for the following maximum impacts: 12 vehicle parking spaces 60 gallons per day of water and wastewater; 30 vehicle trips per day; 2 peak hour vehicle trips. 7. This permit hereby incorporates all of the conditions of the Water Supply and Wastewater Disposal Permit #WW-4-2282 issued on May 29, 1998 by the Regional Engineer, Division of Wastewater Management, Agency of Natural Resources. 8. The Permittee shall apply and maintain calcium chloride and/or water on all roadways or disturbed areas within the project during construction and until pavement and/or vegetation is fully established to control dust. 9. The Permittee and all assigns and successors in interest. shall comply with all of the terms and conditions of the Discharge Permit File #1-0546 issued by the Agency of Natural Resources and with all terms of General Permit #3-9001. 10. The building approved herein is not approved for any manufacturing use or the on -site disposal of any process wastes. The Permittee shall apply and receive approval for any change in the use of the buildings which involves the storage or handling of any regulated substances or the generation of hazardous wastes. 11. No floor drains are to be constructed which discharge underground on -site unless an Underground Injection Control Program,Permit has been obtained., 12. The Permittee shall apply to the District Environmental Commission for approval for any change in the use of the building or land which would cause noxious or unhealthy emissions into the air or injection of toxic wastes into the soils. 13. The Permittee and all assigns and successors in interest shall install and maintain water conserving plumbing fixtures. The plumbing fixtures shall operate with the following specifications: (1) internal system water pressure of 50 psi maximum, (2) toilets with a maximum of 3.5 ,gallons per flush, (3) showerheads operating with a maximum of 3 gallons per minute and (4) faucets on sinks and lays shall operate at a maximum of 3 gallons per minute where new fixtures are being installed. Land Use Permit #4C0149-14 Page 3 14. The Permittee shall comply with Exhibits #20 and 21 for erosion control. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. From October 1 to April 15 of any calendar year, all disturbed areas of the construction site shall be mulched until final vegetative cover is established. All erosion control devices shall be periodically cleaned, replaced and maintained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as it deems necessary. 15. In addition to conformance with the requirements of the erosion control conditions above, the Permittee shall not cause, permit, or allow the discharge of waste materials into any surface waters. Compliance with the requirements of this condition does not absolve the Permittee from compliance with 10 V.S.A., Chapter 47, Vermont's Water Pollution Control Law. 16. The District Commission reserves the right to require a staggered schedule for employees at this building to prevent p.m. peak hour trips at Green Tree Park from occurring at the same hour, if future traffic studies indicate that such measures are warranted to reduce peak hour congestion at the US 2 / Gregory Drive intersection. 17. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #19 by replacing any dead or diseased plantings as soon as seasonably possible. 18. The installation of exterior light fixtures is limited to those approved in Exhibits #13 and 18, and shall be mounted no higher than 20 feet above grade level. All exterior lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 19. No exterior signs shall be installed without the prior written approval of the District Commission. 20. The Permittees and all successors and assigns shall comply with the energy conservation measures approved of by the Public Service Department as stated in Exhibits #8, 30 and 33. 21. All energy conservation devices shall be maintained in good working order and any failed devices shall be promptly replaced by equipment which is at least as energy efficient as the failed device being replaced if the device were operating as designed. Except for the electric heating approved as described in Exhibits #30 and 33, the installation and/or use of any additional electric resistance space heating is specifically prohibited without the prior written approval of the District Environmental Commission 23. No further subdivision and/or development of any parcel of land approved herein shall be permitted without the written approval of the District Commission. 24. All construction on this project must be completed within three years of the date of this approval. 25. Pursuant to 10 V.S.A. § 6090(b) (effective June 21, 1994), this permit amendment is hereby issued for an indefinite term, as long as there is compliance with the conditions herein. 26. Failure to comply with all of the above conditions may be grounds for permit revocation pursuant to 10 V.S.A., Section 6090(b). The Agency requests that the Commission include a condition in the permit requiring the applicant to maintain an undisturbed 100 foot wide buffer between the proposed buildings and Muddy Brook. Criterion 5 - TRAFFIC Al Wright with the Vermont Agency of Transportation (AOT) has reviewed the application and reports that the applicant is required to provide AOT's Chief of Utilities and Permits with a traffic study for the intersection of Gregory Drive and Williston Road. Criteria 9(F) and 9(J) - ENERGY CONSERVATION AND PUBLIC UTILITIES Application #4C0149-13 May 23, 1998 AT&T Page 2 The Department of Public Service (DPS) participates in the interagency review of Act 250 applications with regard to Criteria 9(F) and 9(J). Criterion 9(F) requires that ".. . the planning and design of the subdivision or development reflect the principles of energy conservation and incorporate the best available technology for efficient use or recovery of energy." Randall Lloyd, with the Department of Public Service (DPS), has reviewed the application. Mr. Lloyd reports that he has requested that the applicant provide additional information regarding the HVAC system design, including equipment efficiency ratings, cost-effective alternatives to the proposed electric resistance space heating, and building envelope insulation levels. Upon review of this information DPS will provide supplemental comments to the Commission. Mr. Llewellyn then addressed staff comments. He said there would be a minimum 100 ft. of frontage with lots at least 13,000 sq. ft. Additional sewage would be required. Additional traffic will be addressed. The landscape plan will be revised, and they will present a review plan for the whole piece. At one time, a 40 ft. easement was given on the Nowland property and the Economou property for a rec path. This particular path has been abandoned. The applicant met with the rec path people regarding an easement. The old one has now been replaced along the border with the Economou property. This easement is 20 ft. Mr. Weith asked about the approved rec path along the wetland. Mr. Bresee said the request is to eliminate that. The Rec Path feels the eastern border is better because it is higher and drier. Also, neighbors are already walking in that area and would like the rec path built there. Mr. Weith noted Mr. Larkin was getting credit against impact fees for part of the path to be built. That issue will have to be addressed. Mr. Burgess said he was opposed to extending the cul de sac except on a temporary basis. He wanted assurance that the other half of the road would be built. He noted there is no obligation for the Economou project to build their half. Mr Weith said he believed they intend to build it. Other members agreed with Mr. Burgess. Mr. Weith said the Commission could stipulate that the 7 homes not be built till the road is built. Mr. Burgess asked if the city could build the road. Mr. Weith said the city doesn't yet have legal documents. Members agreed with Mr. Weith that the homes not be built till the road is built. With regard to wetlands issues, Mr. Llewellyn said they believe they are out of the wetlands with a 50 ft. buffer. He also showed the Dorset View Protection line and said that most lots are in the non -buildable area, but that was set aside to protect the wetland which is smaller than at first believed. Lot 79 or 80 might be moved, however. No other issues were raised. 7. Site plan application of AT&T to construct a 7,000 sq. ft. warehouse (telecommunication switching facility) on a 1.7 acre parcel, 4 Green Tree Drive: PLANNING COMMISSION 10 March 1998 page 6 Mr. Bujarski said this is part of a communications loop going through New England. It is not a "peopled" building but is full of equipment. There would be only 2 employees with access, one part time and one supervisor. The building would have no windows and would be designed with security in mind. It would not be heated. Some mechanical equipment on the roof would be screened. The building would have a brick facade. Mr. Conger said there will be two one-way entrances. 12 parking spaces are provided but only 5 are required. All utilities would go to existing systems and storm water would go to an existing swale in the rear. All coverages are within limits. Mr. Dinklage noted that as with all approvals the use of the building might change in the future. Mr. Burgess noted that the vehicle trip ends would result in an impact fee of $900. RESPONSE: The heating for the structure is electrically based. The occupancy for the building will require cooling year round so the electrical heating will rarely be used. The primary concern with the electrical equipment housed in this building is to keep it cool. However, when some heat is needed it is usually generated by the surplus heat of the electronic equipment. If additional heat is required, it is supplied by the electrically operated heating system. c) Is an air pollution control permit from the Agency of Natural Resources required for a) or b) above? If yes, what is the status of your application? RESPONSE: The emergency generator has an engine greater than 200 HP, which would require a permit if it was continuously used. However, since it is only used in emergencies, the engine does not require a permit. A permit is not required. d) Indicate how dust will be controlled during and after construction. RESPONSE: If conditions arise that dust may be generated either at the site, or on the access road, water and/or calcium chloride will be applied to the surface to control a prevent this from happening. Existing storm runoff is transported via a sheet drainage system and discharged at the east side of the site into an existindrainage swale. Erosion barriers as detailed on the enclosed plans will & erected around the construction area before construction begins. Due to the generally gently sloping site, the potential for soil erosion is small. RESPONSE: The majority of the drainage swales will be grass with only minor use of rip -rap, which will be used at all points of concentrated discharge (see plans for details and locations of these devices). d) If exterior site work or earth moving will occur between October 1 and April 15, indicate what special erosion control measures will be taken to stabilize bare soils through the winter months. RESPONSE: The site portion of this project is scheduled to be complete by October 1. However, should the project schedule need to be changed, the erosion control plan would incorporate measures to control the movement of water -borne sediments during the winter months in accordance with the recommendations outlined in the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites. These methods include seeding with annual rye grass, an extra heavy mulch, and reseeding in the spring. Refer to the erosion control plans and details for specific sediment containment practices. e) How frequently will the erosion controls be inspected during construction and who will be accountable for their maintenance? RESPONSE: The site contractor is responsible for the installation, inspection and replacement of erosion control measures employed as a result of his activity. Prior to this application, 434 spaces have been allocated, and 26I spaces remained. With inclusion of this project, 249 spaces remain. See the cumulative impact table in the appendix for further information. i) Demonstrate that the traffic associated with the project will not create unreasonable congestion or unsafe conditions on nearby highways or nearby intersections (include traffic counts during peak hours, measurements of delays in entering intersections, recommendations of traffic engineer, etc.) RESPONSE: The actual anticipated vehicle traffic anticipated for this project is very low due to the low number of employees. During the local review process, South Burlington used the category "warehouse" for lack of a better definition to categorize the anticipated traffic. The calculated vehicle trips based on this is 30 trips per day. This is well below the planned trips for this lot (63), and within the remaining allocation for the overall commercial project. RESPONSE: The project site is an undeveloped lot within a 13 lot commercial park. The site presently is sparsely grassed with no trees, except previously planted street trees. The adjacent lots are developed or are anticipated to be with significant visual features on or adjacent to the site. b) Demonstrate that the project's visual appearance from a highway, community center, or nearby residences is consistent with the visual appearance of the existing area as described in a) above: i) Demonstrate that the project use (residential, retail, industrial, etc.) is consistent with the existing or planned land uses in the area. RESPONSE: The project use is consistent with the planned use of the overall site. The planned use for the overall pproject is a commercial/industrial park. The proposed facility eas7y meets this definition. The normal operation of this facility will not generate any significant noise. Only during power outages will noise fie generated by the emergency generator. The generator is equipped with a muffler to minimize this noise. It is not anticipated that this occasional noise will impact the adjoining neighbors. ii) Demonstrate that the building size, density, and location are not out of character with the terrain of the site, the size of the nearby buildings, surrounding vegetation, and nearby scenic vistas from highways or community centers. (Show details on site plan). RESPONSE: Greentree Park is a industrial/commercial development. The proposed use, a telecommunication facility, will complement the other uses in this park. The proposed building of approximately 7,000 square feet may be the smallest building yet constructed in this ark. The terrain of the site is generally flat, the footprint of the binding fits well on the site. iii) Demonstrate that the architectural sale and building materials and colors are not out of character with the style of area buildings (provide drawings of building). RESPONSE: The building has been designed with a pleasing earthtone brick exterior surface. The brick surface will be a pleasing change to the typical metal sided commercial building that normally is constructed. Elevations of the building are included in the appendix. iv) Demonstrate that parking areas are designed to minimize their visibility from the highway or nearby residences. (Show on site plan.) RESPONSE: The parking area, consisting of twelve spaces, is located in front of the building, and is heavily screened from the road by extensive landscaping. The landscaping includes mugho pines and red maples. The landscape plan, enclosed in the appendix, illustrates the extent of this landscaping. v) Demonstrate that any project signs are designed to minimize their visual impact on the surrounding area (include size, illumination, and colors). (Show location on site plan.) RESPONSE: The project will have one sign identifying the building. This sign will be located on the west (Green Tree rive) side of the building. The proposed sign is shown on the enclosed building elevation. Traffic signs for this project will include one "Entrance Only", one "Exit Only", and two "Handicap Parking" signs. The locations of these signs are shown on the enclosed site plan. vi) Demonstrate that any exterior lighting is designed to minimize its visual impact on the surroundin area at night, and that it will not glare into the highway or nearby residences (include size, wattage, fixture style, and pole height.) RESPONSE: Exterior lighting consists of building wall mounted cutoff floodlights, and light bollards distributed around the parking and driveways. The wall mounted lights feature cutoff glare control. The bollards are 42" tall. vii) Demonstrate that any utilities (propane tanks, trash dumpsters, electric distribution lines and poles, etc.) are designed to minimize their visibility from the highway or nearby residences. RESPONSE: All utilities to this project will be installed underground. This includes telephone, power, and a fuel oil tank. The project will not have a dumpster. The landscaping includes 13 Red Maples, 6 Japanese Flowering Crabs, 18 Red Pines, and 7 Dwarf White Pines. Shrubs include 51 Mugho Pines, and 22 American Cranberry Bushes. The landscape plan, enclosed in the appendix, illustrates the placement of these plants. ix) Indicate if any restrictions on tree cutting or earth disturbance will be used to minimize any of the visual impacts discussed above. (Show details on site plan.) RESPONSE: The existing 1.70 acre lot does not presently have any trees, other than the street trees planted as a part of the original development. Occupancy sensors are specified for open equipment areas providing automatic switching for the lighting in these areas. RESPONSE: The majority of the heat for the building is heat generated by the communications equipment. The remaining heating for the structure, when needed, is electrically based. Stormwater runoff is routed to this Study Point by two distinct routes which are modeled under two subareas for the lot. Subarea 1 is comprised primarily of grassed area which is routed by overland flow to a grassed Swale located northeast of the proposed building. Subarea 2 encompasses the majority of the impervious pavement and building areas with some grassed areas. As you know, our comments are required so that a meaningful assessment can be made under 10 VSA Section 6086 (a) (9) (J). You have advised us that the electrical service entrance for your proposed 6,400 sq. ft communication switch facility and the proposed future 5,000 sq. ft. addition to this facility will be 80.0 amp, three phase 480 WYE/277 volts, and total peak demand is estimated at 291 KW. Our review of this project also assumes that all three phase motors larger than 10 H.P. and all single phase motors larger than 5 H.P. meet the requirement for reduced voltage starting unless written approval has been received from Green Mountain Power, and that none of the proposed communication switch facility described above will have electric space heating. This peak requirement for 291 KW can be supplied from Green Mountain Power's existing and planned generation sources. We have evaluated the transmission and the distribution system that will be used to serve your project's requirements and have determined that existing facilities are adequate for that purpose. We do not anticipate that your addition will require distribution or transmission improvements at this time or accelerate routine system improvements planned for the near future. Any new line extension construction necessary to provide service will be administered under GMP's line extension tariff. This tariff provides that line extensions will be installed in a right- of-way granted by the customer., GMP requires that these rights -of -way be unencumbered, a minimum of 10' wide and be protected by a legally binding easement. This project consists of constructing a 7000 square foot warehouse (telecommunication switching facility) on a 1.7 acre parcel. 2. This property located at 4 Green Tree Drive lies within the IC District. It is bounded on the north, south and east by industrial/commercial buildings, and on the west by Green Tree Drive. 3. Access/circulation: Access is proposed to be via two (2) curb cuts on Green Tree Drive. The southerly curb cut is 26.7 feet and will be for ingress only. The north curb cut is 21.5 feet and will be for egress only. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 10.5% (maximum allowed is 30%). Overall coverage is 25% (maximum allowed is 70%). Front Iyard coverage is 20% (maximum allowed is 30%). Setback requirements will be met. 5. Parking: A total of four (4) parking spaces are required and I ten (10 )spaces are provided including two (2) handicapped spaces and a bike rack. 6. Landscaping: The minimum landscaping requirement, based on building costs, is $15,000 which is being met. Proposed plantings include Red Maple, Crabapple, Red Pine, White Pine, Mugho Pine and Cranberrybush. 1 7. Traffic: ITE estimates that a 7000 square foot warehouse use will generate 5.2 vehicle trip ends (vte's) during the P.M. peak hour. The applicant indicated that there will be no additional traffic generated during the P.M. peak hour. The employees workday ends at 3:00 P.M. The Planning Commission decided to apply the standard rate instead of the applicant's numbers. Typically, the Planning Commission goes with the standard rate in case a building is used by a different user in the future. The applicant was made aware that the road impact fee is approximately $860. 8. Sewer: The sewer allocation needed for this project is 36 gpd I (includes 20% reduction allowed by State). The applicant will be required to pay the per gallon fee prior to permit issuance. 9. The driveway curbs have been removed from the plans. 3. The existing sidewalk will be replaced at the driveway crossings with a 8" thick sidewalk. These will be constructed to maintain the existing sidewalk grades. 4. The two accesses will be maintained with the southerly used for ingress and the northerly used for egress. This will allow for on -site circulation of truck traffic including fire trucks. 5. A manhole has been chosen for this location instead of the multiple clean -outs which would be required at 100' intervals by VT EPR regulations. 6. The on -site driveway culvert has been chosen to provide needed slope drainage across the front of the site. An inlet structure would make it more difficult to grade the site for proper drainage. 7. A graded swale has been added along the southerly property boundary line. 8. The limited elevation drop across the site does not allow us to daylight the perimeter drain to this swale. The perimeter drain needs to be at a depth of approximately 5' to 6' below the finished floor elevation. As such, we have routed it to the existing storm system. The curb openings require the existing barrier curb be removed and a depressed curb poured. 2. Driveway curbs shall not cross the sidewalk as plan shows. 3. Sidewalk at entrance shall be 8 inches in thickness and grade not changed from what exists. 4. It seems that one entrance to the property would serve it adequately and the entrance opposite the cul-de-sac be eliminated. 5. Building sewer manhole is not necessary. A clean out at the 90 degree bend will suffice. 6. An inlet with a 6 inch pipe draining to a swale along the southerly side of property would be easier to maintain instead of a culvert pipe. 7. There should be a graded swale along the southerly boundary draining easterly to prevent runoff on to adjacent property to the south. 8. Building perimeter drains may outlet to the swale along the southerly boundary. GREEN TREE PARK - LOT NO. 4 - 3 GREEN TREE DRIVE 1.
