HomeMy WebLinkAboutSP-98-0000 - Decision - 0003 Green Tree DriveFINDINGS OF FACT & DECISION STATE OF VERMONT Gp G COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Linda & Joe Bacigalupo to construct a 31,900 square foot light manufacturing facility in two (2) phases. Phase I would consist of 24,000 square feet (20,000 square feet on first floor and 4,000 square feet of mezzanine space) and phase II would consist of 7,900 square feet, 3 Green Tree Drive. On the 10" day of March, 1998, the South Burlington Planning Commission approved the request of Linda & Joe Bacigalupo for site plan approval under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of constructing a 31,900 square foot light manufacturing facility in two (2) phases. Phase I would consists of 24,000 square feet (20,000 square feet on first floor and 4,000 square feet of mezzanine space) and phase II would consist of 7,900 square feet. 2. This property located at 3 Green Tree Drive lies within the IC District. It is bounded on the north by a vacant lot, on the east by Green Tree Drive, on the south by a mixed use industrial building, and on the west by three (3) residences. 3. Access/circulation: Access is proposed to be by a 32 foot curb cut on Green Tree Drive. Circulation on the site is adequate. 4. Coverage/setbacks: Phase 11: Building coverage is 29.9% (maximum allowed is 30%). Overall coverage is 52.5% (maximum allowed is 70%). Front yard coverage is 30% (maximum allowed is 30%). Setback requirements are met. 5. Parking,: A total of 20 spaces are required and 30 spaces including two (2) handicapped spaces and a bike rack will be provided. 6. Landscaping: The minimum landscaping requirement, based on building costs, is $18,346, which is not being met. Proposed plantings, which include Potentilla, Rhododendron, Juniper, Burning Bush, Red Maple and Arborvitae, are $12,200 short of the minimum requirement. Applicant sought a credit for the shortfall for existing landscaping along the westerly boundary planted by the subdivider. The plan shows a row of Burning Bush shrubs along the northerly boundary. These shrubs are proposed to be planted on the adjacent property. The plan should be revised to show these plantings proposed on the applicant's property. 7. Traffic: ITE estimates that this facility would generate 24 additional vehicle trip ends (vte's) during the P.M. peak hour. The applicant was made aware that the road impact fee is approximately $4500. 8. Sewer: The sewer allocation needed is 360 gpd (includes 20% reduction allowed by State). The applicant will be required to pay the per gallon fee prior to permit issuance. 9. Lighting: Exterior lighting will consist of the following: — four (4) 70 watt metal halide lamps mounted on the building with downcasting shielded fixtures. — one (1) 100 watt high pressure sodium light with a downcasting shielded fixture mounted on a 42" bollard. 10. Dumpster: The proposed dumpster storage area will be screened by a fence. 11. Phases: The Planning Commission typically approves a two (2) year time frame for additional phases. This means that the zoning permit for the second phase would have to be obtained within two (2) years of approval. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Linda & Joe Bacigalupo to construct a 31,900 square foot light manufacturing facility in two (2) phases. Phase I would consist of 24,000 square feet (20,000 square feet on first floor and 4,000 square feet of mezzanine space) and phase II would consist of 7,900 square feet, 3 Green Tree Drive, as depicted on a two (2) page set of plans, page one (1) entitled, "Site Plan 3 Green Tree Drive Tri-Tech, USA South Burlington VT," prepared by Alpine Design & Engineering, Inc., dated 2/6/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner K prior to permit issuance. a) The site plan shall be revised to add more landscaping on the site. The applicant shall work with staff and neighbors to produce an acceptable plan. b) The site plan shall be revised to relocate the Burning Bush shrubs along the northerly boundary onto the applicant's property. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the light manufacturing building will generate 24 additional vehicle trip ends during the P.M. peak hour. 4. All exterior lighting shall consists of downcasting shielded fixtures. Any change to approved lights shall require approval of the City Planner prior to installation. 5. Prior to issuance of a zoning permit, the applicant shall post a landscape bond in an amount to be determined by the City Planner. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6. The Planning Commission approves a sewer allocation of 360 gpd (includes 20% reduction allowed by State). The applicant shall be required to pay the per gallon fee prior to permit issuance. 7. The zoning permit for phase 2 shall be obtained within two (2) years or its approval shall become null and void. 8. The applicant shall obtain a zoning permit for phase I within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 9. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the new building and future addition. 10) Any change to the site plan shall require approval by the South Burlington Planning Commission.
