DECISION AND FINDING OF FACT
On the 12th day of May, 1997, the South Burlington Zoning Board of
Adjustment heard testimony regarding a conditional use application
of Alan and Maureen Pidgeon, 2 Green Tree Park, this meeting was
also attended by Jeff Nick, J.L. Davis Company.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question is zoned I-C District.
2) Section 26.65 Multiple uses requires Board approval under
conditional use review criteria.
3 ) The Zoning Board of Adjustment granted a multiple use for this
property on October 23, 1995.
4) The applicant is requesting a maximum of three (3) permitted
use type tenants.
5) The structure contains approximately 7000 square feet and has
two tenants presently.
6) The third tenant proposed at this time is a wholesale bakery.
Conclusion
1) No adverse impacts are expected on City services, sewer
allocation of 600 gpd was granted in September 1994.
2) Traffic impacts will not exceed 26 peak hour trip ends. Any
proposed use that would exceed this number would be subject to
a full review.
3 ) Planning Commission granted site plan approval based on twelve
(12) permitted uses (9/l/94).
4) Building was constructed in order to utilize renewable energy
resources.

5 ) The character of the area, light industrial uses, would not be
affected by the proposed uses.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereb grants the applicant's request for an
umbrella permit for a ma of three (3) tenants, located at 2
Green Tree Park.
