HomeMy WebLinkAboutSP-02-06 - Decision - 0002 Green Tree Drive#SP-02-06 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Alan and Maureen Pidgeon to revise the location of a dumpster and enclosure at 2 Green Tree Drive, South Burlington, VT 05403. On the 22°d day of February, 2001, the Director of Planning and Zoning approved the request of Alan and Maureen Pidgeon for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: This project consists of amending a previously approved site plan issued January 9, 1998 for a 7,080 square foot building for multiple tenants at 2 Green Tree Drive in order to relocate a dumpster pad and dumpster enclosure area on the property. 2. The record owners of the property are Alan and Maureen Pidgeon. This property is located at 2 Green Tree Drive, at the intersection of Green Tree Drive and Gregory Drive, and is within the Mixed Industrial -Commercial district. The present use of the property is a multi -tenant building including light manufacturing. Access/circulation: No changes affecting access and circulation are proposed. 4. Coverage/setbacks: The proposed dumpster location is in an area that has already been paved. No change in the approved existing coverages (14.7% building, 25.1% front yard, 58.6% overall) will result, and all setback requirements appear to be met. 5. Landscaping_ No changes to landscaping are proposed. 6. Traffic: No changes affecting traffic are proposed. 7. Parking. The new dumpster location would be on the site of three existing parking spaces. Three new parking spaces would be created where the dumpster and enclosure are currently located. No change in the total number of spaces and handicapped spaces will result. 8. Sewer: No changes affecting wastewater flows are proposed. 9. Lighting: No changes in lighting are proposed. 10. Dumpster: The proposed amendment would relocate the dumpster pad area from a location directly adjacent to the south side of the building to an area in the parking lot farther away from the south side of building. The new dumpster pad is proposed to be enclosed with six-foot high stockade fencing. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning approves the site plan application of Alan and Maureen Pidgeon to relocate a dumpster enclosure area at 2 Green Tree Drive, South Burlington, VT 05403, as depicted on a plan entitled "Lot 9 Green Tree Park, South Burlington, VT," dated "Revision #410115101," with the following stipulations: 1) All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2) Any changes to the site plan shall require approval by the South Burlington Development Review Board. 3) The new dumpster pad shall be fully enclosed with stockade fencing as indicated on the plans. 4) A zoning permit shall be obtained within six (6) months or this approval shall be null and void.
