HomeMy WebLinkAboutSP-18-13 - Decision - 0002 Green Tree Drive#SP-18-13 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CHAMPLAIN VALLEY DISPENSARY - 2 GREEN TREE DRIVE SITE PLAN APPLICATION #SP-18-13 FINDINGS OF FACT AND DECISION Champlain Valley Dispensary, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 7,080 square foot mixed -use building. The amendment consists of adding "cannabis dispensary (dispensing only)" use to the previously approved umbrella approval, 2 Green Tree Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a 7,080 square foot mixed -use building. The amendment consists of adding "cannabis dispensary (dispensing only)" use to the previously approved umbrella approval, 2 Green Tree Drive. 2. The owner of record of the subject property is Pidgeon Farm Properties. 3. The subject property is located in the Mixed Industrial and Commercial Zoning District. 4. The application was received on March 14, 2018. 5. The plan submitted is titled "Lot 9 Green Tree Park Gregory Drive South Burlington, VT prepared by Trudell Consulting Engineers, Inc., dated 10/10/95, with a last revised date of 3/12/18. Zoning District & Dimensional Requirements: 6. No changes to dimensional standards are being proposed. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. Vehicle and Bicycle Parking - 1 - #SP-18-13 7. The applicant will comply with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate the minimum requirement of two (2) (100% of requirement) short-term bicycle parking spaces. 8. The property contains a total of 44 spaces. Parking limitations are such that no combination of uses may exceed the need for more than 44 spaces. Traffic 9. The proposed change does not increase traffic generation. Traffic generation is limited by the last umbrella approval amendment (#SP-03-01). The maximum amount of traffic which the existing and proposed uses can generate is 16.4 vte's during the P.M. peak hour. Other 10. The plan shows that the area being used for a dumpster enclosure will be used for snow storage. The site plan should be revised to not include the dumpster storage area as an area for snow storage. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-18-13 of Champlain Valley Dispensary, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and will be on file in the South Burlington Department of Planning and Zoning. 3. The new inverted "U" bicycle rack must be placed on a solid surface of at least 2' X 6' and securely fastened to the ground. 4. The allowable uses in the building will be: 1. General office 2. Printing, bookbinding production facilities 3. Warehouse/distribution 4. Equipment service, repair, and rental 5. Light manufacturing 6. Wholesale establishments 7. Cannabis dispensary (dispensing only) 5. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. WA #SP-18-13 6. The Applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to the occupancy of any new uses. 7. Any change to the site plan will require approval by the Administrative Officer or the South Burlington Development Review Board. Signed on this day of C 2018 by R and J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
