HomeMy WebLinkAboutSP-17-08 - Decision - 0001 Green Tree Drive#SP-17-08 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING BOB AVONDA — 1 GREEN TREE DRIVE SITE PLAN APPLICATION #SP-17-08 FINDINGS OF FACT AND DECISION Bob Avonda, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 15,000 sq. ft. building for contractor or building trade facility use. The amendment consists of adding an outdoor storage area, 1 Green Tree Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. Bob Avonda is seeking after -the -fact approval to amend a previously approved plan for a 15,000 sq. ft. building for contractor or building trade facility use. The amendment consists of adding an outdoor storage area, 1 Green Tree Drive. 2. The owner of record of the subject property is Greentree, LLC. 3. The subject property is located in the Mixed Industrial - Commercial Zoning District. 4. The application was received on February 7, 2017. 5. The plan submitted is entitled "Avonda Air Warehouse 1 Green Tree Drive So. Burlington, VT", prepared by Trudell Consulting Engineers, Inc.., dated 2/14/96, and last revised on 1/05/17. DIMENSIONAL REQUIREMENTS 6. All other coverages will remain the same. SITE PLAN REVIEW STANDARDS 7. None of the site plan review standards will be affected by this application. OTHER Disposal of Wastes All dumpsters and other facilities to handle solid waste, including compliance with any recycling, composting, or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s), - 1 — #SP-17-08 8. The existing dumpsters will be screened with opaque fencing on all sides. This criterion will be met. Outdoor Storage, Outdoor storage of goods, materials, vehicles for other than daily use, and equipment shall be subject to the following provisions; (1) Any outdoor storage shall be appurtenant to the primary use of the property and shall be allowed only in nonresidential districts and upon approval of the DRB in conjunction with a site plan, conditional use and/or PUD application, (2) The Development Review Board may require that outdoor storage areas in connection with commercial or industrial uses be enclosed and/or screened where the storage area may comprise an attractive nuisance, where the proposed use of the storage areas present opportunities for theft, or where the Board finds that said storage areas are in view of residentially - zoned parcels 9. The site plan designates an area at the rear of the property for outside storage of materials used in the business. This area will not be additionally screened as it is not visible from residentially zoned parcels and the storage area does have some existing trees which do provide some screening. This criterion is being met. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-08 of Bob Avonda, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the outdoor storage area. 5.
