'DEVELOPMENT REVIEW BOAR) 6 DECEMBER 2005 The South Burlington Development Review Board held a regular meeting on Tuesday, 6 December 2005, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset St. Members Present: J. Dinklage, Chair; L. Kupferman, M. Behr, G. Quimby, C. Bolton, R. Farley, M. Birmingham Also Present: R.Belair, Administrative Officer; J. B. Hinds, Director of Planning & Zoning; B. McDonough, Planning Department; E. Hart, J. Kipp, T. Haire, S. Hood, A. Lafferty, R. Milliken, R. Barone, E. Lesser, R. Dickinson, D. White, M. Sperry; A. Parent, The Other Paper; Channel 17 I. Other Business/Announcements: Mr. Belair presented a request from the South Burlington School District for a one-year extension to their site plan approval for expansion of the parking lot at Central School. Staff has no objections. Mr. Kupferman moved to approve a one-year extension to the site plan for expansion of the Central School parking lot. Mr. Birmingham seconded. Motion passed unanimously. Mr. Belair also advised that the applicant for Item #5 had asked for a continuance until 20 December in order to make changes to the plan. Ms. Quimby moved to continue Final Plat Application #SD-05-88 of Pizzagalli Properties, LLC, until 20 December. Mr. Bolton seconded. Motion passed unanimously. i Public Hearing: Conditional Use Application #CU-05-15 of NPIRE for conditional use approval under Section 14.10, Conditional Use Review of the South Burlington Land Development Regulations. Request is for permission to allow a portion of the property to be used as a commercial parking facility, 85 Green Mountain Drive: and 3: Site Plan Application #SP-05-53 of NPIRE to amend a previously approved plan for a 8700 sq. ft. building with 4400 sq. ft. for warehouse use and 4300 sq. ft. for general office use. The amendment consists of designating a portion of the parking area for use as a commercial parking facility for a maximum of 26 vehicles, 85 Green Mountain Drive: Mr. Kupferman asked about the cul de sac. Mr. Hart said it is no longer there. Mr. Belair said it should be removed from the plan. The draft motion was amended to revise stipulation 3(a) to read: The plan shall be revised to reduce the width of the curb cut to the 36' maximum and eliminate the cul de sac lines. -1- DEVELOPMENT REVIEW BOARd 6 DECEMBER 2005 Ms. Quimby moved to approve Conditional Use Application #CU-05-15 and Site Plan Application #SP-05-53 of NPIRE subject to the stipulations in the draft motion as amended above. Mr. Farley seconded. Motion passed unanimously. 4. Public Hearing: Final Plat Application #SD-05-86 of Avalanche Development, LLC to amend a previously approved planned unit development consisting of an 8,904 sq. ft. building with 5,304 sq. ft. of medical office use and 3600 sq. ft. of general office use. The amendment consists of converting 3600 sq. ft. of general office use to medical office use, 1050 Hinesburg Road: Mr. Belair noted that traffic would increase slightly. Other than that, there are no other changes required to the plan. Ms. Quimby moved to approve Final Plat Application #SD-05-86 of Avalanche Development, LLC, subject to the stipulations in the draft motion. Mr. Bolton seconded. Motion passed unanimously. 5. Continued until 20 December 2005. 6. Public Hearing: Final Plat Application #SD-05-89 of Magic Hat Brewing Co. to amend a previously approved planned unit development consisting of three commercial and industrial buildings on two parcels totaling 6.73 acres. The amendment consists of: 1) installing two 38-feet high grain storage silos, 2) enclosing a 35'x125' patio, and 3) constructing a 28'x65' addition, 5 Bartlett Bay Road: Mr. Belair noted that there is a landscaping requirement of $9200. The applicant proposes $3000 in new landscaping. There is no place to put other landscaping other than behind the building which no one could see. Mr. Belair noted that the height of the silos is 3 feet above the regulations, so the applicant is asking for a 3-foot height waiver. Mr. Kupferman suggested that the applicant allow use of the silos for telecommunications. The applicant was open to this suggestion. Mr. Dinklage suggested the applicant explore the use of rail to bring in grain and get some trucks off the road. The draft motion was amended to add stipulation #12 as follows: The Board approves a three foot height waiver for the two silos for a maximum height of 38 feet. Ms. Quimby moved to approve Final Plat Application #SD-05-89 of Magic Hat Brewing Co. subject to the stipulations in the draft motion as amended above. Mr. Farley seconded. Staff feels that the proposed project is consistent with the planned character of the area, as defined by the Comprehensive Plan. 1a The proposed use shall conform to the stated purpose of the district in which the proposed use is located. Staff feels that the proposed project is consistent with the stated purpose of the Commercial 2 District which is, "to encourage general commercial activity". The Development Review Board must find that the proposed uses will not adversely affect the following: a) The capacity of existing or planned municipal or educational facilities. The proposed project will not adversely affect municipal services or educational facilities. b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses. The proposed project will not have an adverse affect on the character of the neighborhood or zoning district that this property falls within. c) Traffic on roads and highways in the vicinity. Access to the property is via a 41 foot wide curb cut off Green Mountain Drive. Staff recommends that the curb cut be reduced in width to the 36' width maximum. 1. The plans should be revised to reduce the width of the curb cut to the 36' maximum. The proposed use will generate little traffic, as it is only being used by a private motor sales company. There will be no members from the general public visiting the site. d) Bylaws in effect. The proposed project is in keeping with applicable regulations. e) Utilization of renewable energy resources. The proposed project will not affect renewable energy resources. 0 General public health and welfare. The proposed project will not have an adverse affect on general public welfare. SITE PLAN REVIEW STANDARDS Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations, the proposed conditional use shall meet the following standards: 3 (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. The proposed project is in compliance with this criterion. The current uses require 17 parking spaces on the site. The plan notes that there are a total of 26 parking spaces located on the property. Eight (8) of these parking spaces will become unusable as they will be used for vehicle storage, leaving 18 parking spaces left to be used by building employees & customers. The plan shows two (2) spaces located immediately north of the building which are not striped. 2. The plans shall be revised to delineate the location of the vehicle parking storage area and indicate that it is for a maximum of 26 vehicles. 3. The parking lot shall be striped to add the two (2) spaces to the north of the building as shown on the plan. Pursuant to Section 13.01(G)(5) a bicycle rack must be provided on the property for use by employees, customers, and the general public. The plan depicts a bicycle rack. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. Parking is located on the front and side of the building. The area proposed for commercial parking is the parking area on the north side of the building. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. There are no building changes associated with this application (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. Staff feels that this requirement is being met. There is landscaping along the front of the property that will help screen the view of the stored vehicles from the public right — of — way. (fl Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Staff feels that this requirement is being met. C! (g) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to require any additional access easements as part of the proposed project. (h) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (i) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). An enclosed dumpster location is noted on the plan. (j) Landscaping and Screening Requirements Pursuant to Section 13.06(B)(5) of the Land Development Regulations, snow storage areas must be depicted on the plan. The plan does not note the location of snow storage area(s). 4. The plan should be revised to show the location of the snow storage area(s). If any new lighting is proposed, it must be in compliance with Section 13.07(A) of the Land Development Regulations which states that lighting shall be shielded and downcasting. Number one is the south wall which has shielded down lights. Number two shows the north wall which shows a flood light over the main door and lights at the northwesterly corner of the building. Numbers three and four are close ups of these lights. These are primarily security lights but shine into the parking area so that parking lot lights are not necessary. There are no neighboring buildings to the north and east and the IDX building is several hundred feet to the west across Green Mountain Drive. They can be pointed further downward but offsite glare does not appear to be a problem at this site. It is my assumption that you will not require parking lot striping at this site since there is such an overabundance of parking space. As spelled out on the site plan the buyer has advised me that they have 14 full time employees who meet every Tuesday morning for a staff meeting, but otherwise the 8 field technicians work directly at customer locations rather than on site. Only 6 employees are always on site, arriving just before 8 a.m. and leaving just after 5 p.m. There is very little non -employee traffic and parking. National Life received an Act 250 permit for the 18 lot subdivision in 1973 (twice amended), but the State offices cannot find any application for most of the buildings constructed in the development. As a result, minor applications are required. The subject building was constructed by Stu Ireland in 1975 and purchased by Geraldine Poulin in 1976. It housed her Tupperware sales and distribution operation until the business was sold about two years ago. Thus, the municipal impacts described in the application have come and gone. H. Armstrong, S. C. Wiggans, and H.W. Yawney, has inspected the site of the proposed S. D. Ireland Construction Company building on Lot 8, Green Mountain Drive, South Burlington, Vermont. After reviewing the proposed planning plans submitted by the S. D. Ireland Construction Company, the Tree Committee makes the following recommendations: 1. 60 Arborvitae, instead of 30, should be planted along the east boundary of the property, adjacent to the UVM Horticultural Research Center fence. They should be planted five feet apart in a similar manner to those on the property just south of Lot 8. 2. Approximately 20 Arborvitae should be planted five feet apart along the north boundary of the property adjacent to the UVM Horticultural Research Center fence. 3. Red Oak trees should be substituted for the Linden tree in the planting plan. The Honey Locust trees indicated on the planting plan are satisfactory for the site. 4. A mixture of ten more,four-inch caliper, Red Oak and Honey Locust trees should be added on the east side of the building and the parking lot to "soften" the view from the east. A member of the South Burlington Tree Committee will be available to help locate planting sites for these trees after the building has been constructed. 5. The planned parking spaces on the north side of the building should be moved to the west so they do not extend past the east side of the building. 6. The site plan should be resurveyed so that it clearly shows the correct boundaries, building location, drives and parking spaces, and tree and Arborvitae locations. Section 11.704 indicates that any new public or commercial use adjacent to or within 50 feet from the boundary of a Residential District is subject to a required rear or side yard of 65 feet. In addition, a 15-foot landscaped strip is required as a buffer. Significantly, the words "Residential District" as used in Section 11.704 are capitalized. Article VI of the Zoning Regulations covers the Residential Districts, and again in this article the words are capitalized. I can only conclude that "Residential Districts" as used in Section 11.704 pertain only to the Residential Districts described in Article VI. Compliance with the requirements of this condition does not absolve the Permittee from compliance with 10 V.S.A., Chapter 47, Vermont's Water Pollution Control Law. The applicant shall contact Green Mountain Power and Vermont Gas concerning energy conservation programs by March 1, 1999. Additionaly, the Department of Public Servivice (Randall Lloyd, telephone 828-4020) shall be contacted when HVAC, electric and other heating devices are replaced within the existing structure to ensure compliance with DPS standards. 19. No further subdivision and/or development of any parcel of land approved herein shall be permitted without the written approval of the District Commission. 20. In order to comply with the wishes of the landscaping committee, the planting will be made at 4' intervals in that 120' section along the UVM roadway lying easterly of the proposed Locusts and Lindens. The balance of the arbor vite (approximately 70 trees) will be placed along the easterly and northerly boundary. Spreading yews and juniper will be put along the edge of the building. This landscaping will certainly cost more than the required $2100. The arbor vite along the easterly and northerly boundary cannot provide a complete screening; however, significant visual relief will be afforded, breaking up the mass of the building. I have purchased very good nursery stock; the end result should be quite attractive. I shall also comply with your recommendations of: (1) a full 40' curb cut width, and (2) entrance paving of at least 12' back from Green Mountain Drive to keep gravel from being thrown into the road.
