DECISION AND FINDING OF FACT
On the 12th day of May, 1997, the South Burlington Zoning Board of
Adjustment heard testimony regarding a conditional use application
of Pamela Starbuck, 75 Green Mountain Drive, this meeting was also
attended by George Starbuck, Michael Starbuck, Gary Lavigne,
Michael Simoneau, Greg Dirmaier, Robert & Marley Skiff.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question is zoned Commercial II District.
2) Section 13.20 Conditional uses requires Board approval for
educational facilities (sub -section 13.210 of the zoning by-
laws).
3) Section 26.65 Multiple uses is also conditional use requiring
Board approval.
4) The proposed use being a private school, the existing use
being testing research laboratory.
5) The structure under consideration contains a total of 20,600
square feet.
6) The lot contains 1.3 acres and is conforming to existing
bylaws.
Conclusion
1) The proposed use is a private school, grades 7-12. The
maximum enrollment is 120 students in the year 2000.
2) Evidence presented does not adversely affect the character of
area (this property abuts U.V.M. Horticultural Farm) the
municipal facilities (no increase required for water and
sewer) and traffic within the area (increase of 26 vte's).
3) Students will not be permitted vehicles at school, school will
provide van transportation.
4) The general character of the area in general office,
industrial/manufacturing and automotive.
5) Complies with existing by-laws.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereby grants the applicant's request to
operate a private sc of d.b.a. The Vermont Commons School in
conjunction with a t
s arch/testing laboratory d.b.a. Aquatec,
located at 75 Green Mu ain Drive.
