HomeMy WebLinkAboutSP-97-0000 - Decision - 0075 Green Mountain DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Wiemann-Lamphere Architects to amend a previously approved site plan for a 20,000 square foot research and testing laboratory. The amendment consists of: 1) converting 12,000 square feet of space to an educational facility, and 2) construct a 36 square foot addition for the educational facility, 75 Green Mountain Drive. On the 13th day of May, 1997, the South Burlington Planning Commission approved the request of Wiemann-Lamphere Architects for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved site plan for a 20,000 square foot research and testing laboratory. The amendment consists of: 1) converting 12,000 square feet of space to an educational facility, and 2) construct a 36 square foot addition for the educational facility. The last review of this property by the Planning Commission was on 2/9/82. The ZBA on May 12, 1997 approved a request from the applicant for a conditional use permit. 2. This property located at 75 Green Mountain Drive lies within the C2 District. It is bounded on the north by a vacant building, on the west by Green Mountain Drive, on the east by the UVM Horticultural Farm and on the south by the access driveway to the UVM Horticultural Farm. 3. Access/circulation: Access is provided by two (2) curb cuts on Green Mountain Drive, a 25 foot curb cut to the north and a 20 foot curb cut to the south. No changes proposed. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 22.0% (maximum allowed is 30%). Overall coverage is 56.3% (minimum allowed is 70%). Front yard coverage is 52.2% (maximum allowed is 30%). Front yard coverage is an existing situation which will not be made worse by this application. Setback requirements are met. 5. Landscaping: The minimum landscaping requirement, based on building cost, is $750 which is being met. Proposed plantings include Ginkgo trees. 1 6. Parking: A total of 35 spaces are required and 43 spaces including two (2) handicapped spaces and a bike rack will be provided. 7. Traffic: ITE estimates that the current use generates 56.8 vehicle trip ends (vte's) during the P.M. peak hour and with the proposed change in use to generate 81.1 vte's. This represents a 24.3 vte increase. The applicant was made aware that the road impact fee will be approximately $4000. 8. Sewer: No additional allocation needed. 9. Dumpster: The dumpster will be screened by placing it behind the building. 10. Lighting: Existing exterior lighting consists of four (4) 150 watt lamps on 14 foot poles and two (2) flood lights on the north end of the building. These flood lights should either be removed or replaced with downcasting shielded fixtures approved by the City Planner. 11. Other: --- the parking lot should be striped as shown on the site plan prior to occupancy of the educational facility. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Wiemann-Lamphere Architects to amend a previously approved site plan for a 20,000 square foot research and testing laboratory. The amendment consists of: 1) converting 12,000 square feet of space to an educational facility, and 2) construct a 36 square foot addition for the educational facility, 75 Green Mountain Drive, as depicted on a plan entitled, "Addition and Remodel for Aquatec Inc South Burlington, VT.," prepared by Wiemann-Lamphere, Architects, Inc., dated 4/24/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Prior to issuance of a zoning permit, the applicant shall post a $750 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 3. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. The two (2) flood lights on the north side of the building shall be removed or replaced with a downcasting shielded fixture approved by the City Planner prior to occupancy by the educational facility. 4. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the change in use will generate 24.3 additional vehicle trip ends during the P.M. peak hour. 5. The parking lot shall be striped as shown on the approved plan prior to occupancy by the educational facility. 6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 7. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy by the educational facility. 8. Any changes to the site plan shall require approval by the South Burlington Planning Commission. Chairman or Clerk South Burlington Planning Commission Date 3
