HomeMy WebLinkAboutSP-98-09 - Decision - 0075 Green Mountain DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Wiemann-Lamphere Architects to amend a previously approved plan to convert 12,000 square feet of a 20,000 square foot research and testing laboratory to an educational facility and construct a 95 square foot addition, 75 Green Mountain Drive. The amendment consists of: 1) adding a second floor within the existing building for a total of 25,200 square feet, and 2) using the building for 13,700 square feet of educational facility use and 11,500 square feet of research and testing laboratory use. On the day of July, 1998, the South Burlington Planning Commission approved the request of Wiemann-Lamphere Architects to amend a previously approved site plan under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved plan to convert 12,000 square feet of a 20,000 square foot research and testing laboratory to an educational facility and construct a 95 square foot addition. The amendment consists of: 1) adding a second floor within the existing building for a total of 25,200 square feet, and 2) using the building for 13,700 square feet of educational facility use and 11,500 square feet of research and testing laboratory use. The only issues affected by this amendment include traffic and parking. 2. This property located at 75 Green Mountain Drive lies within the C2 District. It is bounded on the north by a vacant building, on the west by Green Mountain Drive, on the east by UVM Horticultural Farm and on the south by the access driveway to the UVM Horticultural Farm. 3. Traffic: ITE estimates that the current uses plus the additional square footage for the educational facility generate 64.4 vehicle trip ends (vte's) during the P.M. peak hour. This property is approved for 8 1. 1 vte's. No additional road impact fee is required. 4. Parking: The proposed uses require a total of 45 spaces and 43 spaces are being provided. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Wiemann-Lamphere Architects to amend a previously approved plan to convert 12,000 square feet of a 20,000 square foot research and testing laboratory to an educational facility and construct a 95 square foot addition. The amendment consists of 1) adding a second floor within the existing building for a total of 25,200 square feet, and 2) using the building for 13,700 square feet of educational facility use and 11,500 square feet of research and testing laboratory use, 75 Green Mountain Drive, as depicted on a four (4) page set of plans, page one (1) entitled "Addition and Remodel for Aquatec Inc South Burlington, VT," prepared by Wiemann-Lamphere, Architects, Inc., dated 4/24/97, last revised on 6/16/98, with the following stipulations. 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Pursuant to Section 26.256(b) of the Zoning Regulations, the Planning Commission approves 43 parking spaces which represents a two (2) space waiver. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the newly converted space. 5.
