MINOR LOT LINE ADJUSTMENT APPLICATION #AD-15-03
FINDINGS OF FACT AND DECISION
Vermont Commons School, hereinafter referred to as the applicant, is seeking approval
for a minor boundary line adjustment between 65 Green Mountain Drive (Hort. Farm)
and 75 Green Mountain Drive (Vermont Commons School).
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the follow:
FINDINGS OF FACT
1. The applicant is seeking approval for a minor boundary line adjustment between 65
Green Mountain Drive (Hort. Farm) and 75 Green Mountain Drive (Vermont Commons
School).
2. The owners of record of the subject properties are UVM & SAC (65 Green Mountain
Drive) and Vermont Commons School (75 Green Mountain Drive).
3. The subject properties are located in the Commercial 2 & IA -South Zoning Districts.
4. The application was received on July 23, 2015.
5. The plat submitted is entitled, "Proposed Boundary Line Adjustment Vermont
Commons School 75 Green Mountain Drive South Burlington, Vermont", prepared by
Civil Engineering Associates, Inc., and dated 7/22/15.
DIMENSIONAL REQUIREMENTS
6. All area and dimensional requirements will continue to be met for all two (2) lots
involved.
PURSUANT TO SECTION ZS,Z9(B) OF THE LAND DEVELOPMENT
REGULATIONS:
7. NO NEW LOTS ARE CREATED THROUGH THIS ADJUSTMENT.
The boundary line adjustment between the lots involved will not result in the creation of
any new lots. The boundary line adjustment involves the exchange of 0.09 acres from
65 Green Mountain Drive to 75 Green Mountain Drive. The result being that there will be
only a slight increase in the size of one lot and the slight decrease in size of the other
lot, both lots still meeting the minimum lot size requirement.

8. THE SALE OR EXCHANGE OF PARCELS OF LAND IS BETWEEN ADJACENT
PROPERTY OWNERS.
The lot line adjustment will be between adjacent property owners.
9. THE RELOCATION OF THE LOT -LINE DOES NOT RESULT IN THE CREATION
OF A NON -CONFORMING LOT, STRUCTURE OR USE.
Lots are in conformance with the City of South Burlington Land Development
Regulations, Article 15 Subdivision and Planned Unit Development, Section 15.19 Minor
Lot Line Adjustments.
10. THE PROPOSED CHANGE DOES NOT VIOLATE ANY CONDITIONS IMPOSED
FROM PRIOR MUNICIPAL APPROVAL.
This lot line adjustment does not violate any conditions of prior approval.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves Minor
Lot Line Adjustment Application #AD-15-03 of Vermont Commons School, for a
boundary line adjustment between 65 Green Mountain Drive and 75 Green Mountain
Drive, subject to the following conditions:
1. All previous municipal approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. This project shall be completed as shown on the plat and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The final plat plan shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Administrative Officer prior
to recording. Prior to recording the final plat plan, the applicant shall submit a copy
of the survey plat in digital format. The format of the digital information shall require
approval of the South Burlington GIS Coordinator.
4. Any change to the plat plan shall require approval by the South Burlington
Development Review Board or he Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
