PPLICANT PLANNING COMMISSION JUNE 11, 1985 The South Burlington Planning Commission held a regular meeting on Tuesday, June 11, 1985 at 7:30 pm in the Conference Room, City Hall, 575 Dorset St. Members Present Peter Jacob, Vice Chairman; Mary -Barbara Maher, Judy Hurd, John Belter, John Dooley Member Absent William Burgess Others Present Jane Bechtel, City Planner; Ruth Poger, The Other Paper; Michael Dugan, Elizabeth Edwards, Gary Farrell, Colin Lindberg, Elaine Bassett, Anna Mayo, Mabel & Harold Brown, Bill Greer, Carl, Martha and Anna Lavallee, David Brown, Mallory Parker, Larry Bagdan Minutes of June 4, 1985 The June 4, 1985 minutes were approved on a motion by Mrs. Maher, a second by Mrs. Hurd, and a unanimous vote. Continue site plan application of Gary Farrell for construction of a 36,000 sq. ft. industrial building at 50 Green Mountain Drive Mr. Jacob read the letters submitted by Paul Carrara, the fire chief, and IDS regarding the plans. Mr. Lindberg went over the planting plans and building elevations. He also mentioned storm water. This will run to the north and be caught in a retention pond, the location and configuration of which has not been decided yet. It might be located in an existing ravine in the area. They are working with the city's consultants on this. The pond is presently planned to be on property owned by IDS, but Mr. Farrell noted that if that plan fell through, they could retain the water on their own lot. Mr. Farrell said they wanted to get some kind of approval tonight so they could move ahead on the agreements needed for the access and for the retention pond, but Mr. Dooley felt the issues left unresolved were such that approval should not be given tonight. He felt the developers were going in the right direction. Mrs. Maher also did not want to give approval yet. Mr. Dooley suggested that the Commission members indicate their intentions tonight. He said he liked the plan, assuming that the fire chief's concerns could be dealt with and assuming that the retention pond plan stays very close to what was shown tonight. Mrs. Hurd said she liked the concept, but did not want to vote on the plan with so many issues left unresolved. Mr. Lelter did not object to stipulating some of the items. Mr. Jacob liked the plan but wanted the issues resolved first. The Commission agreed that it liked the concept. Mrs. Hurd moved to continue the application until June 18, 1985 at 7:30 pm at City Hall. Mr. Dooley seconded the motion and all voted aye. 6/11/85 ' JSB MOTION OF APPROVAL That the South Burlington Planning Commission approve the site plan application of Gary Farrell for the construction of a 36,000 square foot industrial building at 50 Green Mountain Drive as depicted on a plan entitled "Gary Farrell, South Burlington Development: Site Plan, Landscaping" as prepared by Colin Lindberg, dated 5/28/85 and 6/4/85 with the following stipulations: 1. The plan shall be revised to show exact location of the access road. Agreements shall be obtained from adjacent land owner for this access, prior to permit. 2. Plans shall be submitted to the South Burlington Fire Chief with revised access, locations of hydrants, and looped water system for review prior to permit. 3. The new curb cut shall be constructed with a depressed concrete curb. If the existing curb on the adjacent southerly lot is to be closed so that the two properties share the one driveway, the old curb shall be closed by constructing a new barrier curb in its place. 4. A $12,500 landscaping bond shall be posted prior to permit. 5. The existing curb opening along the east side of the site shall be closed by removing the existing depressed curb and constructing a new barrier curb. 6. A sewer allocation shall be made in accordance with the South Burlington Sewer policy. The applicant shall pay the rate established by the City Council. 7. The plan shall be reviewed by Wagner, Heindel and Noyse prior to permit to determine the effect of this development on the erosion downstream in the Bartletts Bay watershed area. The developer shall follow the remedy, if any, proposed by this firm so as to not contribute to the erosion problem. 8. The building permit shall be obtained within 6 months. The overlay zone permits 47 trips per peak hour from this use. The ITE data, from a limited sample of "specialty retail centers" estimates 81 trips per peak hour for this building and use. The applicants data show this producing 733 per day and 81 per hour on the adjacent street. Any waivers must be granted under the criteria of Section 17.50. (As a Planned Commercial Development, a level of C would be maintained as required, according to the traffic study submitted by the applicant.) The plan should be revised to delineate the 108 spaces that are claimed by this applicant. It should be made clear that spaces claimed by this applicant and approved by the Commission will not be reallocated to future applicants with or without private deeds for shared or in -common parking, unless the hours of operation are significantly different. The following information has been received: �T) The landscaping plan now shows an increase in plantings to meet the $17,500 bond requirement. Plantings are primarily cedar hedge, yews, juniper, maple, and crab. PLANNING COMMISSION MAY 28, 1985 Mrs. Maher said she wanted to see specifically what kind of barrier was planned before the application was approved. Mrs. Maher moved to postpone the site plan application for two weeks, until June 11 at 7:30 pm at City Hall. Mrs. Hurd seconded the motion and all voted aye. Consider site plan application of Gary Farrell for construction of a 28,000 sq. ft. industrial building located at 50 Green Mountain Drive Mr. Lindberg noted that the site was 2.4 acres in size. The curb cut is presently right across from the access to the UVM Horticultural Farm and that has led to erosion problems in the area. The site drops almost 30' east to west. What they would like to do is share an access with the lot to the south of them. This would improve circulation on that lot and would allow this lot to have a more gradual slope in. The building will be 160' x 120' with two stories and will be built into the slope of the land. The building will be about 25% office space and they show about 40 spaces for that use andabout 30 parking spaces for the manufacturing use. Some handicapped spaces are shown. Mr. Lindberg said the building would look very nice, so they planned to plant honey locust trees rather than pines. The locusts should do very well in this soil, he said. There will be down lighting in the parking areas and at building entrances, but uplighting into the tree branches in some areas. r Mr. Lindberg said they had met with neighbors in this area to'see if they could solve some of the drainage problems. They hope to slow the velocity of the water and send it into the northern drainageway rather than the southern one. It was noted that both drainageways come out at the lake quite close to one another. Mr. Lindbarg said they might put in a retention pond to slow the water. The city's consultants, Wagner, Heindel and Noyes, will look at the drainage plans. The Commission wanted to postpone approval for two weeks so the drainage plans could be firmer. Mrs. Maher also wanted to see what the building exterior would look like. It was noted that 35' was the height restriction. Mr. Dooley moved to postpone the application until June 11, at 7:30 pm at City Hall. Mrs. Maher seconded the motion and all voted aye. Other business Mrs. Hurd noted that Pete's Trailer Mart still looked messy. Ms. Bechtel said she would check into it with the 'Zoning Administrator, but she noted that they had not done any construction yet, so they did not have to make any changes. Mr. Jacob said the Commission had not given approval for an auto body shop on Airport Parkway and he noted that Caron's had one. Mrs. Hurd noted that Dairy Queen was planning to go into the Dorset aouare Mall and Mr. Burgess was not sure that would be allowed under the ordinance. Mrs. Maher asked Ms. Bechtel to see why Mr. Tarrant had no landscaping on the east side of his building on Shelburne Road. Ms. Bechtel gave the Commission a status report on sewer capacity. Mrs. Maher asked Ms. Bechtel to find out which types of pine trees the University recommends for this area, both for sandy soil and clay soil. The meeting was adjourned at 10:00 pm. Lightining: Any lighting for night time use should be restricted so that neighbors on Shunpike Road are not bothered. 7) GREEN MOUNTAIN DRIVE, INDUSTRIAL BUILDING The applicant proposes to construct a 28,800 square foot spec in- dustrial building on lot #11, Green Mt. Drive. The Zoning Board granted a multiple use permit for three uses such as manufacturing, assembly and a similar use. The Board also stipulated that there shall be no retail and no outside storage. The property is zoned Commercial-2. Parking: The plan shows 56 parking spaces including 2 handicapped spaces. This should be sufficient for the proposed use. Circulation: There is adequate circulation around three sides of the building. Vehicles will enter from a driveway on the adjacent lot since this lot slopes very steeply toward the back of the lot. (see Bill's memo) Landscaping: The landscaping plan is short $7500 since the formula was applied incorrectly. I will review revised plans available prior to the meeting. Other: This use will require a sewer allocation and will be charged in accordance with the new formula of $2.50 per gallon. Discussion of site plan application of Allson Partnership for construction of 150 space parking lot at 50 Green Mountain Drive. Mr. Blake Stimson of Pinkham engineering spoke for the applicant. fie said that access was from the existing NorcEic Ford parking lot. The lot will be used for overflow car storage from the Nordic property. fie said that he felt there were three concerns; one was the concerns of IDS regarding drainage and the landscaping; two, meet the concerns of the city engineer regarding the storm water drainage; and three, have a review by Wagner, Heindel, and Noyse for storm waters. fie said that all three concerns had been met. The storm water will be diverted over to the south side of the lot and go down an existing ditch near the property line all the way to an existing low spot where a pipe would be put in to direct the water to a catch basin and then over to the original outfall of the drainage. For landscaping they proposed 150 dogwoods around the border where the property meets the IDS property. Mr. Stimpson presented a memo from Wagner, Heindel, and Noyse that said that everything was in order except for an existing curb cut on Green Mountain Drive that should be closed. Ile also noted the recommendations regarding erosion control and the existing ditch. He said that the applicant has agreed to all the recommendations. Mr. Jacob asked why all the trees were of the same species. Most commissionersprefered a mix with evergreens and that the trees not be in a straight line. Mrs. Lafleur presented a letter that she had received that day from IDS saying that they agreed with the drainage plan they had reviewed. Since she had just received the letter today Mrs. Lafleur said that she still had to ask Mr. Szymanski to review these drainage plans for consistency with the ones presented tonight. Mrs. Lafleur said that IDS said they would like some landscaping but that there was no mention that they liked this landscaping plan. Mr. Stimson said that he could obtain a letter to that effect. Mr. Jacob asked if there was anyone present from IDS. There was not. Mrs. Maher asked what the existing vegetation was like. Mr. PLANNING COMMISSION JANUARY 27, 1987 6 Stimson said that the land was sloping toward Shelburne Road and had many small trees on it. Mrs. Maher asked why the lot was laid out the way it was. Mrs. Lafleur said that it was "a car storage lot and not a regular parking lot. Mr. Dooley noted that there was a comment in Mr. Szymanski's memo to the commission that IDS had not done what they were suppose to. Mrs. Lafleur said that the only problem was that these plan show what is existing on the IDS property and Mr. Szymanski wanted the plans to show what had been approved for the IDS lot. He also wanted written approval from IDS for Nordic to do the drainage work on their property. Mr. Stimson said that the agreement was that Nordic would be paying for the materials and IDS doing the work because it is on their property. Mrs. Lafleur said that the other issue regarding drainage was the recommendations from Heindel, Wagner and Noyes. There were strict erosion controls measures to be done prior to and during construction. Mr. Dooley asked if these stipulations were enforc.ble. The Zoning Regulations allow one access per lot. Mr. Munson presently has only a shared driveway to the property. This driveway is to be closed under the Dorset Street widening plan. I suggest that we follow the plan and allow access from San Remo Drive only to the rear of the lot. This provides safer access and retains the ability of Dorset Street to handle traffic flows. The curb cut that overlaps the property line should be moved so that it is solely on the lot of the present building. Other: The landscaping plan is still approximately $200 short. A plan valued at $3000 is required. No trees should be planted within the proposed right-of-way. 3) (NORDIC FORD TOYOTA, �50 GREEN MOUNTAIN DRIVE This plan shows 150 parking spaces on this 2.24 acre property. Site Plan application of Nordic Ford/Toyota for use of property as an auto parking lot, 50 Green Mountain Dr. Mrs. Lafleur said that this plan was before the Zoning Board last night and they approved it pending a new drainage plan approved by the City Engineer. The neighbors from IDS were present and wished to discuss the drainage plan and landscaping. Mr. Anderson said that this land was just purchased and he was trying to get a temporary lot here as soon as possible because they needed additional parking spaces. He has not had time to get the engineering done. Mrs. Lafleur presented a letter from IDS which raised questions about the landscaping and engineering.. Mr. Anderson said that his site cannot be seen from Green Mountain Drive or Shelburne Road. Mr. Jacob asked if the lot was going to be paved. Mr. Anderson said it was. Mr. Dooley felt that since there were neighbors who wanted to see the landscaping plan and had concerns with the drainage that this plan should come back to the Planning Commission. Mrs. Lafleur said that the landscaping plan formula isn't triggered by this plan because there is no building. Mr. Anderson said that they planned to landscape for screening anyway. Mr. Jacob asked the representatives from IDS if all their concerns were answered. The engineer from Trudell Engineering who is doing the plans for IDS said that they had two concerns with this plan; drainage and aesthetics. The plan showed a detention pond at the downhill end of the project with a discharge that went right onto the IDS property. They found this unacceptable. He felt there were other ways to do the engineering. He also felt that although the project was not visible from Shelburne Road it could be seen from IDS and they wanted as much screening as possible. Mr. Jacob asked if both parties could get together with the City Engineer regarding the drainage. Mr. Anderson said he would get together with the owners of IDS to work on a landscaping plan also. Mr. Burgess questioned the letter received from IDS. He asked Mrs. Lafleur to check their stipulations to see what they were required to do regarding landscaping. As you know, the City of South Burlington recently granted our firm, BDP Realty Associates, approval to build a 120,000 square foot office building on the adjoining property. There were stipulations to our approval requiring us to allocate a substantial amount of money for landscaping our site, and also to screen the car lots of Nordic so to provide Shelburne Road with an oasis of greenery. We feel another car lot will detract from the asthetics that we desire and were mandated by the City, and that a lot this close to our project would be nearly impossible to screen. Our second concern is that of storm water drainage. The site plan for the new car lot shows concentrated water run-off that will empty into a drainage system planned for our building site. The designs for our system have been completed and approved by the City. Those plans did not anticipate and cannot handle the additional run-off that the new parking area clearly will generate. The Planning Commission has already given approval for storage, distribution and manufacturing use. Access: Two curb cuts are proposed on Farrell Street. The applicants also requests a new curb cut (26 feet) wide from Swift Street located at the bottom of the hill. One gravel access near the intersection will be closed and seeded. At the previous approval, the two driveways on Farrell Street were approved and and the one on Swift Street was closed. It seems as though strong justification is needed to warrant this third curb cut at the bottom of the hill especially because of the grade out of the lot as well as that on Swift Street. See Bill Szymanski's comments regarding this. Circulation: Circulation is complete around the building. New asphalt will be installed at the rear of the building to allow for additional parking. Parking: Ninety parking spaces are shown. These should be adequate. Landscaping: No construction work is proposed therefore the landscaping formula is not triggered. However, I recommend that the applicant plant the 7 new yews shown on the plan at the very least ($200 value). Access: Access is shown from the existing Nordic property to the south. No direct access is shown from Green Mountain Drive. Circulation: Circulation is adequate with appropriate aisle widths. 2 Parking: The plans show 156 parking spaces. Landscaping: No new landscaping is shown. (See Bill Szymanski's comments regarding drainage.) 6) NORDIC FORD/TOYOTA, 1620 SHELBURNE ROAD The Allson Partnership proposes to revise the site plan approved last year. The original approval was for a 14,000 square foot building on two floors. This new application is for an 18,472 square foot single -story building. At the original approval, the Commission approved changes to all three lots as well as the new construction. The other site changes are close to completion. Access: Six curb cuts provide access to the entire site. There are three on Shelburne Road but this includes the curb cut on IDS property that will be closed as a condition of their recent site plan approval. Two curb cuts are shown on the east -west portion of Green Mountain Drive and one on the north -south portion of Green Mountain Drive. Circulation: A new improved circulation plan is shown throughout the property. Parking: The old plan showed 958 total spaces with 205 on the lot with this proposed building. This plan has 195 on this lot. These car storage parking spaces are more narrow than we require so there actually may be fewer spaces or just tightly parked vehicles. Landscaping: A $13,500 landscaping plan is required. The old plan was valued at $15,000. Lot Coverage: At the previous approval, the Commission required 70% maximum coverage on this lot. RE: Nordic/IDS Drainage Plan & Implementation Construction on both the Nordic Storage Lot and the IDS lot are about to begin in the coming week. As you recall, portions of the storm drainage system were to be resolved between the two owners. Engineers for both owners have resolved the proposed storm drainage plan and its implementation is due to proceed as follows: IDS will construct a temporary Swale which picks up the flow from IDS's south property line. This Swale will be staked with haybales every 50 ft and will carry storm water to an existing catch basin which will be fitted with a temporary inlet, a crush stone apron and a haybale dam. This temporary solution will be implemented in order to retain the use of the existing drive during construction. Completion of the building and site are scheduled for July. Before that time, the permanent solution shown on the enclosed plan by Pinkham Engineering will be implemented. I hope this procedure and schedule meets with your approval. The Zoning Board of Adjustment turned down Zachary's conditional use request on October 23, 1978. This decision was appealed to court and is now ripe for a de novo hearing. I have some indication from the court that the case may be called for trial any day now. It would appear that the Zoning Board's decision was based upon the character of the neighborhood. In their opinion the proposed use would not be compatible with the character of the area. This incidently is a standard for review in conditional use applications. Another standard is traffic on roads and highways in the vicinity. If the City is to defend the Zoning Board's decision, it is my view that we should retain a land use expert. This person could testify as to the potential impact of this use in the area, and perhaps could also examine traffic impact, if any. I would estimate that I could get the assistance of a qualified person we have used in other similar cases and that the fee would be in area of five or six hundred dollars. Without expert testimony, I don't feel the City has a very viable case. Mould you please let me know promptly if we can retain a land use planner and what the Council's desire is in regard to this case. By copy of this letter I ant asking Dick Ward to let me know how this property is presently zoned and to give you any information you may want concerning the case. Continue site plan application of Gary Farrell for construction of a 36,000 sq. ft. industrial building at 50 Green Mountain Drive Mr. Jacob read the letters submitted by Paul Carrara, the fire chief, and IDS regarding the plans. Mr. Lindberg went over the planting plans and building elevations. He also mentioned storm water. This will run to the north and be caught in a retention pond, the location and configuration of which has not been decided yet. It might be located in an existing ravine in the area. They are working with the city's consultants on this. The pond is presently planned to be on property owned by IDS, but Mr. Farrell noted that if that plan fell through, they could retain the water on their own lot. Mr. Farrell said they wanted to get some kind of approval tonight so they could move ahead on the agreements needed for the access and for the retention pond, but Mr. Dooley felt the issues left unresolved were such that approval should not be given tonight. He felt the developers were going in the right direction. Mrs. Maher also did not want to give approval yet. Mr. Dooley suggested that the Commission members indicate their intentions tonight. He said he liked the plan, assuming that the fire chief's concerns could be dealt with and assuming that the retention pond plan stays very close to what was shown tonight. Mrs. Hurd said she liked the concept, but did not want to vote on the plan with so many issues left unresolved. Mr. Belter did not object to stipulating some of the items. Mr. Jacob liked the plan but wanted the issues resolved first. The Commission agreed that it liked the concept. Mrs. Hurd moved to continue the application until June 18, 1985 at 7:30 pm at City Hall. PLANNING COMMISSION MAY 28, 1985 Mrs. Maher said she wanted to see specifically what kind of barrier was planned before the application was approved. Mrs. Maher moved to postpone the site plan application for two weeks, until June 11 at 7: 0 pm at City Hall Mrs. Hurd seconded the motion and all voted aye. Consider site plan application of Gary Farrell for construction ofa 28,000 sq. ft. industrial building located at 50 Green Mountain Drive Mr. Lindberg noted that the site was 2.4 acres in size. The curb cut is presently right across from the access to the UVM Horticultural Farm and that has led to erosion problems in the area. The site drops almost 30' east to west. What they would like to do is share an access with the lot to the south of them. This would improve circulation on that lot and would allow this lot to have a more gradual slope in. The building will be 160' x 120' with two stories and will be built into the slope of the land. The building will be about 25% office space and they show about 40 spaces for that use andabout 30 parking spaces for the manufacturing use. Some handicapped spaces are shown. Mr. Lindberg said the building would look very nice, so they planned to plant honey locust trees rather than pines. The locusts should do very well in this soil, he said. There will be down lighting in the parking areas and at building entrances, but uplighting into the tree branches in some areas. ,.- Mr. Lindberg said they had met with neighbors in this area to'see if they could solve some of the drainage problems. They hope to slow the velocity of the water and send it into the northern drainageway rather than the southern one. It was noted that both drainageways come out at the lake quite close to one another. Mr. Lindberg said they might put in a retention pond to slow the water. The city's consultants, Wagner, Heindel and Noyes, will look at the drainage plans. The Commission wanted to postpone approval for two weeks so the drainage plans could be firmer. Mrs. Maher also wanted to see what the building exterior would look like. It was noted that 35' was the height restriction. Mr. Dooley moved to postpone the application until June 11, at 7.30 pm at City Hall. Mrs. Maher seconded the motion and all voted aye. Other business Mrs. Hurd noted that Pete's Trailer Mart still looked messy said she would check into it with the 'Zoning Administrator, but they had not done any construction yet, so they did not have to Mr. Jacob said the Commission had not given approval for shop on Airport Parkway and he noted that Caron's had one. Hurd noted that Dairy Queen was planning to go into Mall and Mr. Burgess was not sure that would be allowed under Mrs. Maher asked Ms. Bechtel to see why Mr. Tarrant had the east side of his building on Shelburne Road.
