HomeMy WebLinkAboutSP-97-0000 - Decision - 0045 Green Mountain DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Paul Roche to amend a previously approved plan for a 8400 square foot building used for auto service. The amendment is to convert 3894 square feet to warehouse use, 45 Green Mountain Drive. On the day of November, 1997, the South Burlington City Planner approved the request of Paul Roche to amend a previously approved site plan under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved site plan for a 8400 square foot building used for auto service. The amendment is to convert 3894 square feet to warehouse use. The ZBA on 11/24/97 granted the applicant a conditional use permit for the multiple uses. The only issue affected by this amendment is parking. 2. This property located at 45 Green Mountain Drive lies within the C2 District. It is bounded on the north and south by office buildings, on the east by the UVM Horticultural Farm and on the west by Green Mountain Drive. 3. Parking: A total of 11 spaces are required and 17 spaces including one (1) handicapped space and a bike rack are being provided. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington City Planner approves the site plan application of Paul Roche to amend a previously approved plan for a 8400 square foot building used for auto service. The amendment is to convert 3894 square feet to warehouse use, 45 Green Mountain Drive, as depicted on a plan entitled, "Site Plan for Paul Roche in the City of S. Burlington, VT., "dated 11/4/97, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) For the purpose of calculating requited road impact fees under the South Burlington Impact Fee Ordinance, the City Planner estimates that the change in use will generate zero (0) additional trip ends during the P.M. peak hour. 3) Any new exterior lighting or changes to existing exterior lighting shall consist of downcasting shielded fixtures. Any change to existing lights shall require approval of the City Planner prior to installation. 4) The applicant shall obtain a zoning permit for the change is use within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 5) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the newly converted space. 6) Any change to the site plan shall require approval by the South Burlington Planning Commission.
