SITE PLAN APPLICATION #SP-17-56
FINDINGS OF FACT AND DECISION
Bill Shearer, hereinafter referred to as the applicant, is seeking after -the -fact approval to
amend a previously approved plan for an 8,400 sq. ft. building consisting of the following
uses: 1) 4,100 sq. ft. of auto service and repair, 2) 3,300 sq. ft. of wholesale, and 3)
1,000 sq. ft. of general office. The amendment consists of: 1) expanding the southerly
dumpster enclosure, and 2) revising the landscaping plan to eliminate the need to plant
seven (7) Arborvitae trees at the southerly end of the site, 45 Green Mountain Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
The applicant is seeking after -the -fact approval to amend a previously approved plan
for an 8,400 sq. ft. building consisting of the following uses: 1) 4,100 sq. ft. of auto
service and repair, 2) 3,300 sq. ft. of wholesale, and 3) 1,000 sq. ft. of general office.
The amendment consists of: 1) expanding the southerly dumpster enclosure, and 2)
revising the landscaping plan to eliminate the need to plant seven (7) Arborvitae
trees at the southerly end of the site, 45 Green Mountain Drive.
2. The owner of record of the subject property is RAVA, LLC.
3. The subject property is located in the Commercial 2 Zoning District
4. The application was received on July 18, 2017.
5. The plan set submitted consists of a two (2) page set of plans, page one (1) is titled,
"45 Green Mountain Drive Green Mountain Drive South Burlington, Vermont",
prepared by Krebs & Lansing Consulting Engineers, Inc., dated October 4, 2016, and
last revised on 7/18/17.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages since the last approved plan.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Vehicle and Bicycle Parking

8. No changes to vehicular parking.
9. The plan will have to comply with Section 13.14 of the LDRs to include the new type
and location for bicycle racks, to accommodate the minimum requirement of two (2)
short-term bicycle parking spaces.
Landscaping
10. The applicant is proposing to eliminate the need to install seven (7) Arborvitae trees
at the southerly end of the site due to the fact that the property owner to the south
has planted 13 4.5' to 5' Arborvitaes trees in essentially the same location but on
their own property. The applicant submitted a photo looking towards the south to
show the existing trees on the abutting landowner's property.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-56 of Bill Shearer, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The plans must be revised to show the changes below and will require approval of
the Administrative Officer. Three (3) copies of the approved revised plans must be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to add two (2) short-term bicycle parking spaces.
4. The applicant must regularly maintain all stormwater treatment and conveyance
infrastructure.
5. Prior to issuance of a zoning permit for the project, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF) format.
6. The applicant must obtain a zoning permit from within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and void.
7. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
8. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the site modifications.

9. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this
decision by filing a Notice of Appeal with the secretary of the Development Review
Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed
within 15 days of the date of this decision.
