Re: Findings of Fact, application of Geraldine Poulin for the
reapproval of an 18 lot subdivision plat approved on 1/23/73,
Shelburne Road and Green Mountain Drive.
On the loth day of March, 1998, the South Burlington Planning
Commission approved the request of Geraldine Poulin for final plat
approval under Section 204 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of the reapproval of an 18 lot
subdivision plat approved on 1/23/73. The approved plat was not
recorded until June 15, 1973. Consequently, the approved plat was
not recorded within the 90 days mandated by State Statutes. The
purpose of this application is to legitimize the recorded plat to
cure any question regarding the lawful existence of those lots
within the subdivision that have the same boundaries as shown on
the 1973 plat. The sketch plan was reviewed on 2/10/98.
2. Some of the original lots have altered their boundaries since
the 1973 plat. The City will be requesting that these property
owners obtain the appropriate amendments from the Planning
Commission.
3. Once this plat is approved, the Chairman should sign and stamp
the recorded plat and a legal document should be recorded which
describes the Commission's action.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the final plat application of Geraldine Poulin
for the reapproval of an 18 lot subdivision plat approved on
1/23/73, Shelburne Road and Green Mountain Drive, as depicted on a
plat entitled, "National Life Insurance Co. Shelburne Road So.
Burlington, Vermont," prepared by Webster -Martin, Inc., dated June
12, 1973. This approval is to officially approve the plat recorded
in map volume 105, page 21 of the South Burlington Land Records,
subject to the following stipulation:

1. The Chair or Clerk of the Planning Commission shall stamp and
sign the plat recorded in map volume 105, page 21 of the South
Burlington Land Records within 90 days or this approval is null and
void. Prior to the Chair or Clerk of the Planning Commission
stamping and signing the recorded plat, a legal document shall be
recorded which explains the Planning Commission's action regarding
this approval. This legal document shall be approved by the City
Attorney prior to recording.
