HomeMy WebLinkAboutSP-98-0000 - Decision - 0040 Green Mountain DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN sr - CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Alison Partnership and BPD Realty, Inc., to modify the configuration of several lots, in particular lots 11 and 12, that were originally created in an 18 lot subdivision approved by the South Burlington Planning Commission on 1/23/73, 40 and 50 Green Mountain Drive. On the g" day of September, 1998, the South Burlington Planning Commission approved the request of BDP Realty, Inc. for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1) This project consists of modifying the configuration of several lots, in particular lots #11 and 12, that were originally in an 18 lot subdivision approved by the Planning Commission on 1/23/73. This proposal involves moving the southerly boundary of lot #11 35 feet to the south to the centerline of a 70 foot r.o.w. to the Horticultural Farm which was eliminated when Green Mortmain Drive was constructed. This proposal also involves moving the northerly boundary of lot #12 35 feet to the north to center of this same 70 foot r.o.w. 2) Lot size/frontage: The expanded lots will meet the lot size and frontage requirements. 3) Coverage/setbacks: Coverage and setback requirements are met. 4) Other: The plan should be revised to include a note that the "old" property lines will be dissolved. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Alison Partnership and BDP Realty, Inc., to modify the configuration of several lots, in particular lots #11 and 12, that were originally created in an 18 lot subdivision approved by the South Burlington Planning Commission on 1 /23/73, 40 and 50 Green Mountain Drive, as depicted on a plat entitled, "Composite Parcel Plan Heritage Group Shelburne Road South Burlington, Vermont," prepared by Pinkham Engineering Associates, Inc., dated 8/26/98, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plat plan shall be revised to show the changes below and shall require approval ofthe Director of Planning & Zoning. Three (3) copies of the approved revised plan shall be submitted to the Director of Planning & Zoning prior to permit issuance. a) The final plat shall be revised to note that the "old" property lines are to be dissolved. 3) Any change to the final plat shall require approval by the South Burlington Planning Commission. 4) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format.
