HomeMy WebLinkAboutCU-00-08 SP-0014 - Decision - 0040 Green Mountain Drive#CU-00-08 & #SP-00-14 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan and a conditional use application for constructing a 3,500 square foot addition to an automobile repair and service building, 40 Green Mountain Drive. On the 2nd of May, 2000, the South Burlington Development Review Board approved the conditional use application under Section 26.05 and site plan under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of a site plan and a conditional use application for constructing a 3,500 square foot addition to an automobile repair and service building, 40 Green Mountain Drive. 2. The owner of record is the Allison Partnership. This property is located in the Commercial Two District and it is bounded on the east by Green Mountain Drive and on the west and south by Heritage Ford -Toyota. It is bounded on the north by a commercial structure. 4. Cover e/setbacks: The existing building coverage is 71/o and will increase to 9.25% (30% maximum). The total coverage is currently 41% and will decrease to 40% (70% maximum). The front yard coverage is unknown. This information was requested but not provided. Setback requirements are met. 5. Access: There are three points of access. A 28-foot curb cut on Green Mountain Drive provides the sole means of access to a public street via a 25-foot access drive. Two 25-foot points of access located on the northwest and southwest corners of the property provide access to the Heritage Ford Toyota dealership via a private access drive. Circulation on the site is adequate. 6. Building Height: The applicant should submit information on the proposed height of the addition. 7. Parking The number of service bays is unknown and therefore the minimum parking requirement is unknown. The applicant appears to have sufficient parking though with 159 parking spaces. At least six of these spaces must be delineated as handicapped spaces. A bike rack must also be provided. 8. Landscaping: The minimum landscaping requirement is $1,680 and the applicant has proposed only $1,489 in landscaping. This presents a $191 shortfall. The plans should be revised to make up the shortfall and change the Norway Maple to a Sugar Maple or a Red Maple as Norway Maples are a non-native and intrusive species. 9. Li tin : All lighting must be downcasting and shielded. All existing lights must be downcasting and shielded or retrofitted. Flood lights are not permissible and must be removed. Cut sheets for all existing and proposed lighting fixtures must be submitted for approval by the Director of Planning and Zoning prior to permit issuance. 10. Sewer: The applicant should request an additional sewer allocation and expect to pay a per gallon fee, if needed. 11. Dumpster: A screened dumpster area should be provided. 12. Other: The plans should be revised to show the correct scale. 13. Conditional Use Criteria: The proposed use complies with the stated purpose of the Commercial Two District to "encourage general commercial activity." The proposed use will not adversely affect: a) the capacity of existing or planned community facilities. No affect expected. b) the character of the area affected. No adverse affect is expected. c) traffic on roads or highways in the vicinity. The proposed use is not expected to impact traffic. d) bylaws in effect. The proposal is in conformance with the zoning regulations, e) utilization of renewable energy resources. There is no utilization of renewable energy resources to be affected. f j general public health and welfare. No adverse affect expected. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the site plan application #SP-00-14 and conditional use application #CU-00-08 of Heritage Motors, Inc. to construct a 3,500 square foot addition to an automobile repair and service building, 40 Green Mountain Drive, as depicted on a plan entitled "Heritage Autobody Proposed Addition Lot 12 Green Mtn. Dr. So. Burlington, Vermont" prepared by The Architect Team, dated 3/17/00 with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plans shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised plans shall be submitted to the Director prior to permit issuance. a) The site plan shall be revised to include the front yard coverage expressed as a percent. b) The proposed height of the addition should be incorporated into the site plan. c) The site plan shall be revised to note the total number of service bays planned for the site in order to calculate the minimum parking requirements. d) The site plan shall be revised to delineate no more than 50 spaces and a bike rack. e) The site plan shall be revised to change the proposed Norway Maple trees to a Sugar Maple or a Red Maple. An additional Maple tree shall be depicted on the plans. f) The dumpster and outside storage area shall be noted on the plan and shall be screened from the public street. g) The site plan shall be revised to show the correct scale. 3. Any new exterior lighting shall consists of downcasting fixtures. Any change to approved fights shall require approval of the Director prior to installation. Prior to permit issuance, the applicant shall submit exterior lighting details (cut -sheets) for all existing lights. Any existing building mounted flood lights shall be removed or replaced or modified with downcasting shielded fixtures approved by the Director. 4. The building shall be sprinklered or other means of fire protection shall be worked out with the Fire Chief. 5. Prior to issuance of a zoning permit, the applicant shall post a landscape bond in an amount of $1,680. The bond shall remain in effect for a three (3) year period to assure that the landscaping takes root and has a good chance of surviving. 6. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the addition will generate zero (0) additional vehicle trip ends during the P.M. Peak hour 7. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 8. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the addition. 9.
