This permit amendment applies to the lands identified in Book 912, Page 225, of the land records of the City of South Burlington, Vermont, as the subject of a deed to Robert Berman LLC, the Permittee as Grantee. This permit specifically authorizes the Permittee to a two phase construction addition: Phase I add loading dock, remove attached shed, relocate HVAC, add deck to west side and parking lot changes; Phase II construct a 4,200 sf addition to existing 15,792 sf building and rehabilitate eastern parking area. All work on Lot #16 of the National Life commercial subdivision. The project is located on Green Mountain Drive in the City of South Burlington. The project is subject to Act 250 jurisdiction because the project is a material change to a development over which the Commission has jurisdiction and thus a land use permit amendment is required pursuant to Act 250 Rule 34. The Permittee, and its assigns and successors in interest, are obligated by this permit to complete, operate and maintain the project as approved by the District Commission in accordance with the following conditions: All conditions of Land Use Permit #4C0094 and amendments are in full force and effect except as amended herein. 2. Representatives of the State of Vermont shall have access to the property covered by this permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental and health statutes and regulations and with this permit. 3. The project shall be completed, operated and maintained in accordance with: the plans and exhibits on file with the District Environmental Commission, and the conditions of this permit. 4. A copy of this permit and approved plans shall be on the site at all tunes throughout the construction process. 6. No changes shall be made in the design or use of this project without the written approval of the District Coordinator or the Commission, whichever is appropriate under the Act 250 Rules. 7. Pursuant to Act 250 Rule 51(G), the permit application and material representations relied upon during the review and issuance of this permit by the District Commission shall provide the basis for determining future substantial and material changes to the approved project and for initiating enforcement actions. 8. The District Environmental Commission maintains continuing jurisdiction during the lifetime of the permit and may periodically require that the permit holder file an affidavit certifying that the project is being completed, operated and maintained in accordance with the terms of the permit, as provided by 10 V.S.A. §§ 6001-6092 and the rules of the Natural Resources Board (Act 250 Rules). 9. The conditions of this permit and the land uses permitted herein shall run with the land and are binding upon and enforceable against the Permittee and their successors and assigns. 10. This permit hereby incorporates all of the conditions of the following Agency of Natural Resources Permits: • Potable Water Supply and Wastewater System Permit #WW-4-3448 issued on March 9, 2010 by the Wastewater Management Division; and • Final Discharge Permit #3019-9010 issued on June 2, 2003 by the Water Quality Division. Any subsequent nonmaterial changes to these permits shall be automatically incorporated herein upon issuance by the Agency of Natural Resources. Subsequent amendments involving material changes to the Act 250 permit shall not be constructed prior to review and approval of the District Coordinator or the District Commission under applicable Act 250 Rules. 11. The Permittee shall apply and maintain calcium chloride and/or water on all roadways or disturbed areas within the project during construction and until pavement and/or vegetation is fully established to control dust. 12. There shall be no floor drains installed at the facility without first acquiring the required Underground Injection Control Permit from the Wastewater Management Division of the Agency of Natural Resources. 13. No later than 30 days prior to commencement of building construction, the Permittee shall submit a Construction Waste Reduction Plan nc,.p::iivwW.ati G,.ie4.vt.,3,✓,gee-WAstedi,.,xeuyclitig;n,in�nCT25nteinplate <i,c to be approved by the Agency of Natural Resources Solid Waste Management Program. The contractor shall be obligated to implement the Plan. Land Use Permit #4C0094-5B Page 3 of 5 14. The Permittee and all subsequent owners or lessees shall install and maintain only low -flow plumbing fixtures in any buildings. Any failed water conservation measures shall be promptly replaced with products of equal or better performance. 15. The Permittee shall comply with Exhibits #18, #19 and #21 (Sheets SP1, SP2 and D1)for erosion control. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. All erosion control devices shall be periodically cleaned, replaced and maintained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as it deems necessary. 16. All mulch, siltation dams, water bars and other temporary devices shall be installed immediately upon grading and shall be maintained until all roads are permanently surfaced and all permanent vegetation is established on all slopes and disturbed areas. Topsoil stockpiles shall have the exposed earth completely mulched and have siltation checks around the base. 17. All areas of disturbance must have temporary or permanent stabilization within 14 days of the initial disturbance. After this time, any disturbance in the area must be stabilized at the end of each work day. The following exceptions apply: i) Stabilization is not required if work is to continue in the area within the next 24 hours and there is no precipitation forecast for the next 24 hours. ii) Stabilization is not required if the work is occurring in a self-contained excavation (i.e. no outlet) with a depth of 2 feet or greater (e.g. house foundation excavation, utility trenches). 18. All disturbed areas of the site shall be stabilized, either seeded and mulched or covered in stone or rolled erosion control matting immediately upon completion of final grading. All disturbed areas not involved in winter construction shall be double mulched and seeded before September 15. Between the periods of October 15 to April 15, all earth disturbing work shall conform with the "Winter Construction" standards and specifications of the Vermont Standards & Specifications for Erosion Prevention & Sediment Control (2006). 19. Prior to construction of the approved work, the Permittee shall complete the following: a) construction limits shall be clearly delineated with flagging or snowfencing; b) diversion ditches shall be placed on the uphill limits of the construction area; and c) temporary siltation controls shall be placed on the downhill limits of the construction. Immediately following the above, the permanent drainage system and/or roads shall be installed after which normal construction can begin. 20. A copy of the approved erosion control plan shall be on the site at all times during construction. 21. In addition to conformance with all erosion control conditions, the Permittee shall not cause, permit or allow the discharge of waste material into any surface waters. Compliance with the requirements of this condition does not absolve the Permittee from compliance with 10 V.S.A. (§§ 1250-1284) Chapter 47, Vermont's Water Pollution Control Law. 22. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #20 (Sheet SP3) by replacing any dead or diseased plantings within the season or as soon as possible after the ground thaws, whichever is sooner. 1 Land Use Permit #4C0094-5B Page 4 of 5 23. All stumps shall be disposed of on -site above the seasonal high water table or at a State approved landfill so as to prevent groundwater pollution. 24. The installation of exterior light fixtures is limited to those approved in Exhibit #23, and shall be mounted no higher than 20 feet above grade level. All exterior lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 25. The Permittee shall not erect exterior signage without first obtaining approval from the District Commission. Signage includes banners, flags, and other advertising displays, excepting temporary real estate marketing signs. 26. Pursuant to 21 V.S.A. § 268, energy design and construction shall comply with The 2005 Vermont Guidelines for Energy Efficient Commercial Construction and shall further include any custom energy measures referenced in comments by the Department of Public Service if found by the applicant to be cost-effective on a life -cycle -cost basis. 27. The installation and/or use of electric resistance space heat is specifically prohibited without the prior written approval of the District Environmental Commission. 28. The amendment consists of developing the property in two phases. Phase 1 will consist of: 1) converting the building to wholesale use, 2) adding a loading dock, 3) removing an attached shed, 4) relocating an HVAC unit, 5) making minor parking improvements, and 6) constructing a deck. Phase II will consist of 1) constructing a 4200 sq. ft. addition for wholesale use, and 2) making improvements to the easterly parking area. COMMENTS Associate Planner Cathyann La Rose and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on February 2, 2010 and have the following comments. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: The following general criteria and standards shall be used by the Development Review Board in reviewing applications for site plan approval. They are intended to provide a framework within which the designer of the site development is free to exercise creativity, invention, and innovation while improving the visual appearance of the City of South Burlington. The Development Review Board shall not specify or favor any particular architectural style or design or assist in the design of any of the buildings submitted for approval. The Development Review Board shall restrict itself to a reasonable, professional review, and, except as otherwise provided in the following subsections, the applicant shall retain full responsibility for design. A. Relationship of Proposed Development to the City of South Burlington Comprehensive Plan. Due attention by the applicant should be given to the goals and objectives and the stated land use policies for the City of South Burlington as set forth in the Comprehensive Plan. Staff feels that this is being met. The proposed use is identified as a preferred use in the district in the Comprehensive plan. B. Relationship of Proposed Structures to the Site (1) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. There are no changes with respect to the transitions from structure to site and from structure to structure as a result of Phase 1 of this proposal. Phase 2 of the proposal does make improvements to the easterly parking area, including the addition of a handicapped parking space and a more efficient use of the parking area. 2 The applicant should be providing additional information to the Staff with respect to this requirement. It appears that this is being met but additional information is needed. This information should be finalized before the hearing. (2) Parking: (a) Parking shall be located to the rear or sides of buildings. (b) The Development Review Board may approve parking between a public street and one or more buildings if the Board finds that one or more of the following criteria are met. The Board shall approve only the minimum necessary to overcome the conditions below. (i) The parking area is necessary to meet minimum requirements of the Americans with Disabilities Act; (ii) The parking area will serve a single or two-family home; (iii) The lot has unique site conditions such as a utility easement or unstable soils that allow for parking, but not a building, to be located adjacent to the public street; (iv) The lot contains one or more existing buildings that are to be re- used and parking needs cannot be accommodated to the rear and sides of the existing building(s); or, (v) The principal use of the lot is for public recreation. (c) Where more than one building exists or is proposed on a lot, the total width of all proposed parking areas that are both to the side of a building and between the front lot line and the building line of the building on the lot that is closest to the public street shall not exceed one-half of the total building width of all buildings on the lot that are located adjacent to the public street. Buildings separated from the front lot line by parking approved pursuant to 14.06(C)(2)(b) shall be considered adjacent to the public street. Buildings separated from the front lot line by any other parking areas shall not be considered adjacent to the public street. (d) The DRB shall require that the majority of the parking on through lots and corner lots be located between the buildings) and the side yards or between the building and the front yard adjacent to the public street with the highest average daily volume of traffic. Where the rear yard of a lot abuts an Interstate or its interchanges, the majority of parking shall be located between the building and the side yards or between the building and the yard that is adjacent to the Interstate. There are no proposed changes with respect to the location of parking on the site. Section 2(iv) above indicates that parking may be permitted to the front of the building if the buildings are to be reused. That appears to be the case here. The Board should discuss whether the addition of 4200 square feet in Phase 2 should merit any changes to the parking located to the front of the building. There does not appear to be a threshold of re -use and new construction with respect to this criterion. (3) Without restricting the permissible limits of the applicable zoning district, the 3 height and scale of each building shall be compatible with its site and existing or anticipated adjoining buildings. There are no proposed changes with respect to the height of the building, which remains within the limits of the district. (4) Newly installed utility services and service modifications necessitated by exterior alterations or building expansion shall, to the extent feasible, be underground. There are no proposed changes with respect to the height of the building, which remains within the limits of the district. C. Relationship of Structures and Site to Adjoining Area. (1) The Development Review Board shall encourage the use of a combination of common materials and architectural characteristics (e.g., rhythm, color, texture, form or detailing), landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (2) Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. The applicant has not submitted any elevations of the existing or proposed building. No height waiver is requested and the proposed addition to be part of Phase 2 is in the rear of the building. If the Board would like to see proposed renderings, they should instruct the applicant to such. 14.07 Specific Review Standards A. Access to Abutting Properties. The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial or collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. There do not appear to be any additional opportunities for useable connections to other properties. The UVM horticulture farm is to the east, but a connection via this property would not be very reasonable. Staff does not recommend the reservation of any additional land. B. Utility Services. Electric, telephone and other wire -served utility lines and service connections shall be underground insofar as feasible and subject to state public utilities regulations. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Staff has already stated that additional utility lines shall be installed underground. C. Disposal of Wastes. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure 51 and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). The plans show a screened dumpster on the property. D. Landscaping and Screening Requirements. See Article 13, Section 13.06 Landscaping, Screening, and Street Trees. Based on construction costs of $414,600, the plans should include a minimum landscaping budget of $10,792. The applicant has submitted a landscaping plan but has not included an itemized listing of proposed plantings. 1. The applicant shall include an itemized listing of approved plantings which meets or exceeds the minimum requirement. The City Arborist reviewed the plans. He has asked for planting details to be included on the plans. 2. Planting details shall be included on the landscaping plans. Snow storage areas are shown on the plans. A bike rack is shown on the plans but is completely out of the way of use for the general public, tucked to the side of the building. The bike rack should be relocated to be more user-friendly. 3. The bike rack should be relocated to location which may be easier to access for the employees and general public. Lighting 4. Internal components are totally enclosed in a rain -tight, dust -fight and corrosion resistant housing. The housing, back plate and door frame are die cast aluminum. A choice of three (3) optical systems is available. Luminaires are suitable for wet locations (damp locations if inverted). HOUSING: Housings are die cast aluminum. A memory retentive gasket seals the housing to the door frame to exclude moisture, dust, insects and pollutants from the optical system. A black, die cast ribbed backplate dissipates heat for longer lamp and ballast life. DOOR FRAME: A single -piece die cast aluminum door frame integrates to the housing form. The door frame is hinged closed and secured to the housing with two (2) captive stainless steel fasteners. The heat and impact resistant 1/8 (.32cm) tempered glass lens and one-piece gasket are mechanically secured to the door frame with four (4) galvanized steel retainers. OPTICAL SYSTEMS: Reflectors are composed of specular extruded and faceted components, electropolished, anodized and sealed. Reflector segments are set in arc tube image duplicating patterns to achieve the wide throw, forward throw or medium throw downlight distributions. ELECTRICAL: STANDARD LUMINAIRES: Each high power factor HID core and coil ballast is the separate component type. For luminaires provided with CosmoPolisTM, each high power factor ballast is electronic, designed specifically for the CosmoPolis M high performance ceramic metal halide electronic sytem. Luminaires are completely assembled with no disassembly required for installation. Lamping requires no lifting or hinging of the luminaire housing, disturbing wiring or exposing uninsulated live parts. HOUSING: Extruded housings (EH style) are offered in 14" (35.56 cm) and 19" (48.26 cm) sizes and are composed of precisely mitered anodized aluminum extrusions. The project shall be completed, operated and maintained in accordance with: (a) the plans and exhibits on file with the District Environmental Commission, and (b) the conditions of this permit. 4. No changes shall be made in the design or use of this project without the written approval of the District Coordinator or the Commission, whichever is appropriate under the Environmental Board Rules. 6. The District Environmental Commission maintains continuing jurisdiction during the lifetime of the permit and may periodically require that the permit holder file an affidavit certifying that the project is being completed, operated and maintained in accordance with the terms of the permit, as provided by 10 V.S.A., Chapter 151 and the rules of the Environmental Board. By acceptance of the conditions of this permit without appeal, the Permittees confirm and agree that the conditions of this permit shall run with the land and the land uses herein permitted, and will be binding upon and enforceable against the Permittees and all assigns and successors in interest. This permit hereby incorporates all of the conditions of the Subdivision Permit #EC-4-2242 issued on March 10, 1999 by the Regional Engineer, Wastewater Management Division, Agency of Natural Resources. 9. The building approved herein is not approved for any manufacturing use or the on -site disposal of any process wastes. The Permittees shall apply and receive amended approval from the District Commission for any change in the use of the buildings which involves the storage or handling of any regulated substances or the generation of hazardous wastes. 10. The Permittees shall not erect exterior signage or additional lights without first obtaining approval from the District Commission. Signage includes banners, flags, and other advertising displays, excepting temporary real estate marketing signs. 11. The Permittees shall implement the Energy Efficiency Recommendations contained in the July 6, 1999 letter from Dan Gaherty (Green Mountain Power) to Michelle Russo (IDX) and included in the Department of Public Service memorandum dated July 13, 1999 (Exhibit #16). 12. No further subdivision, alteration, and/or development of any parcel of land approved herein shall be permitted without the written approval of the District Commission. 13. The Permittees shall reference the requirements and conditions imposed by Land Use Permit #4C0094-5 in all deeds and leases. 14. Pursuant to 10 V.S.A. § 6090(b), this permit amendment is hereby issued for an indefinite term, as long as there is compliance with the conditions herein. 15. Failure to comply with all of the above conditions may be grounds for permit revocation pursuant to 10 V.S.A., § 6090(b). It is bounded on the north by an automotive accessory business, on the south by GMP offices, on the east by the UVM Horticultural Farm and on the west by Green Mountain Drive. Access/circulation: Access is provided by a 30 foot curb cut on Green Mountain Drive. No changes proposed. Circulation is adequate. Coverage/setbacks: Building coverage is 22% (maximum allowed is 30%). Overall coverage is 53% (maximum allowed is 70%). Front yard coverage is 22% (maximum allowed is 30%). The existing building and the proposed addition meet the setback requirements. Landscaping: The minimum landscaping requirement based on building costs, is $750 which is being met. Plantings will be either White or Red Pine. Plan should be revised to accurately depict existing landscaping on the site. Parking: This site requires 57 parking spaces and 59 spaces including three (3) handicapped spaces are being provided. A bike rack is being provided as required under Section 26.253(b) of the zoning regulations. Sewer: Since the last approval of this site in 1980, 20 employees have been added. The building is pre-engineered and 44 parking spaces will be provided. Drainage has been discussed with the City Engineer and a new fire hydrant will be installed, as per the fire chief's request. The building tenant will be an electromechanical firm, taking 50;' of the space. The other half of the building is unoccupied at this time. There will be 20 employees in the occupied calf of the building. The other tenant will fall within the uses allowed in the area, Mr. Bouchard said. Mr. Spitz noted that this use met all the C2 requirements. Mr. Bouchard said there would be an occasional delivery truck, and UPS would come to the site daily. Sketch plan review of application by Michael Dressler for a new 100 foot by 100 foot lot at 24 Orchard Road Mr. Spitz said most lots in the area were 50' x at least 150' and that the land in question was originally 4 lots, 2 on Orchard Road and 2 on l-ieadow Road. What is being:requested now is two lots, one 100' x 100' and the other 100' g 2001. This division has already been made for tax purposes, but does not have formal approval, and the sale has not been completed. There is a house on one lot, but not on the other. The Commission saw no problem with the application. Application by Munson Earth Moving Company for site plan approval and for approval to build without public road frontage for a truck terminal maintenance shop on a rear lot on Builders Boulevard Mr. Doug Schner said this was a pre-existing lot of 2.07 acres. Munson has a right of way over the private drive known as Builders Boulevard which will be the access for this lot. The building will be 6,000 sq. f t. and a 50' setback will be maintained between this and the commercial land to the west. The drainage swale will be redefined and taken into the brook. Water and sewer for the building will be broujht through Builders Boulevard. 60 parking spaces are required by ordinance, which Mr. Schner felt was excessive and should be changed. There are currently 37 office employees at the 35 Green Mountain Drive facility and three building mechanics use the facility as a work-out location. The proposed use will be identical with the added benefit of bringing grounds maintenance equipment closer to the employees that use them. 2. There are currently two company vehicles parked at the 35 Green Mountain Drive facility. The addition of the maintenance shed will provide covered storage for three additional company vehicles at the facility. x (, 3. The site plan has been revised to include the planting of six evergreens at the facility. Said trees will be planted in May of 1995. 4. The nearest fire hydrant has been added to the proposed site plan. 5. The site plan has been revised to show the boundary line between C2 and IA districts on the eastern property line. 6. As shown on the site plan dated November 30, 1994, there are 59 parking spaces at the 35 Green Mountain Drive facility. Three of these spaces are provided for the handicapped. 7. The site plan has been revised to show the existing exterior lighting. The plan also shows the planned addition of three exterior 150 HPS shielded lights on 20 foot poles. The additional lights are not an integral part of this project and probably will not be done until the spring of 1995. 8. The site plan has been revised to show the location of the existing dumpsters. Screening is provided by the trees mentioned in item 3 above. 9. Bicycle parking facilities on the east side of the property have been added to the proposed plan. 10. Front yard coverage percentage is 22%. 11. No additional parking spaces are proposed. The existing 59 parking spaces are in excess of the South Burlington Zoning requirements. Also please note that the proposed building maintenance shed has been reduced to a 28' by 48' structure to reduce the total cost of the project.
