PLANNING COMMISSION OCTOBER 26_L 1976 Site Plan Review, Overlake Distributors, Lot #13 Green Mountain Drive Mr. Page displayed drawings showing the site plan and the elevations and referred to his memo of October 22nd concerning the swale. He said he was concerned about the best way to maintain the swale in order to drain the property, either by a culvert or keeping it in grass. Mr. Szymanski doesn't want a building on it. Mr. Bagdan said he felt the swale could be redirected. Mr. Poger suggested that when the City Engineer is asked how they are to deal with that swale, that Mr. Szymanski be asked to try to maintain it as a grass swale rather than a culvert. Mr. Page said everything else in the site plan is conforming. Mr. Bagdon explained they are an electronics distributor with a nominal amount of traffic, perhaps loading three big trucks a day and perhaps about two or three customers coming in per day. Will have about ten people working there. The location of the curb cut to be closed was pointed out on the site plan. Mr. Poger moved that the Planning Commission approve the site plan for Over - lake Distributors for Lot #13. Green Mountain Drive. with the fol]owinc stipulations from the memo from Mr. Ward dated October 22nd; #2, the closing of the curb cut; #3, a bond for $1, 00_for land'scapinE, with the additional stipulation that the drainage swale be approved by the City Manager and that the Planning Commission desires that the swale be relocated, not culverted. Seconded by Mr. Levesque and voted unanimously. Mr. Levesque referred to a previous recommendation to the Council that there be a separate City Manager and a separate City Engineer, and he felt this recommendation should be sent to the Council again. that provision for this be made in the next year's budget. Chairman Wessel said this would be discussed next week. Response to the Williston Planning Commission letter This letter was read aloud by Chairman Wessel. He asked for comments from the Planning Commission as to whether they wished to respond to this letter. The members felt that traffic was the prime concern but the Planning Com- mission had no objective information regarding this at this time. Mr. Woolery moved that the Planning Commission ask the Chairman to respond to the letter received —gym the Willi—nn Planning Commission. Seconded by Mr. Lidral and voted unanimously. Mr. Wessel stated he was preparing a list of objectives of the Planning Commission, how it should prepare for the onslaught of coming problems, whether an engineer should be hired or a consultant. Discussion of zoning amendments to regulate restaurants Mr. Morency referred to his previous report containing suggestions for restrictions on the lot size, the frontage, the minimum distance between similar types of business, and his initial recommendation that restaurants be Made a conditional use and then a more substantial plan be developed later. Myette, Chairman Zoning Board of Adjustment Oct. 4,1975 PROTECTIVE COVENANTS Each purchaser of lots #1 through 017 from National Life Insurance Company shall be bound by the protective covenants as follows: 1. National Life Insurance Company shall appoint an architectural control conm,ittee to approve the architectural design of all improvements placed on said lots. Z. It shall be the responsibility of a lot owner to maintain and replace, if necessary, with like, kind and quality all trees that are planted by National Life Insurance Company along the boundary of the access road which fronts that lot.
