Dear Dave:
This letter is to serve as a request to the City Council for a
zoning variance for lot size for two lots created by subdivision
of the following described property:
Lot # 6 of the National Life Subdivision situated on the
southerly side of Green Mountain Drive and presently owned
by Mark Hill Investments, Inc.. This lot presently has a
frontage of 300 feet on Green Mountain Drive and an even
depth of 300 feet.
It is proposed by Mark Hill to sell 134 feet frontage on Green
Mountain Drive and 300 feet depth of the easterly portion of
above lot to Roger E. Curtis.
This will result in two lots each with less than the square foot
requirements under the present zoning. However, I do understand
that these lots would conform under new zoning regulations now
under consideration.
I am acting as agent of the buyer and therefore I am unable to state
the use for this property other than investment. I can, however,
represent that the ultimate buyer is willing to make application
to the proper board or commission for their approval prior to any
building on this lot.
The enclosed Plot Plan will show the subdivision of this lot in
more detail.

3. A revised site plan containing information required from stipulation
1 shall be submitted prior to issuance of a building permit.
Mr. Ewing seconded the motion and all voted for it.
Application by Mark Hill Investments for site plan annroval of an addition
to Xeireke Muffler at 5 Green Mountain Drive
Mr. Spitz showed the area on a slide.
Mr. Siner said this was a 40' x 40' addition to accomodate the expansion
of the business. The same type of services will be provided. Some rock
will be removed and some additional area paved. There will be no additional
curb cut. They expect to have 11 more cars per day with the expansion.
There are now 3 employees and 5-6 are expected with the expansion. They
will have about 18 .parking spaces. Mr. Poger read the list of plantings.
Mr. Woolery moved that the South Burlington Planning Commission approve
the site plan application of Mark Hill Investments for a commercial addition
as depicted on a plan entitled "Proposed Addition for Meineke Discount
Mufflers", prepared by H.I. Lamphere Corporation, last revised March 2,
1901,_subject to the following stipulations:
I. A landscaping bond of $900 shall be provided.
2. This site plan approval_expires_in_6 months.
Mr. ;wing seconded the motion and it passed unanimously.
Other business
The proposed zoning change to industrial in the Southeast Quadrant
wits discussed at the City Council meeting Monday and Mr. Spitz reported
that concerns expressed at that meeting centered on any industrial uses
in that area, this development in particular, andX'the provisions of the
existing industrial zoning being applied in that area. Two options were
considered - removing two of the three properties proposed for rezoning,
thus leaving only the land the applicant is interested in, or writing up
provisions for the industrial zone in that area. Air. spitz was concerned
about rushing through any provisions and he stated that he wanted to discuss
zoning at the last meeting in March and the first meeting in April. He
said that if the Council made any changes to the proposal, it would have
to be sent back to the Commission for input. Changes will require re -warning.
Mr. Levesque asked about mFzking a recommendation to remove certain uses,
such as contractors' yards from the zoning.
Ms. Emery, an area resident, said the neighbors felt that light industry might
be UK, but heavy industry was riot.
Mr. Woolery suggested wording to the effect that no change to the
provisions would be made as long as the applicant remained GBIC's proposed
tenant, but Mr. Poger did not think that could be done.
Ms. Coffin, another area resident, felt the zoning should be positive
rather than negative. She did not feel the zoning should be written for
this one piece of land, since it will'set a precedent in the Quadrant.
Mr. Ewing suggested leaving the industrial zoning existing now intact
and writing provisions for another zone. These zones could be called
Industrial 1 and Industrial 2. A few certain uses could be picked and set
out in the Quadrant. He added that the present industrial zoning allowed
some uses he did not want to see in the Quadrant.

3) Farrell, Shelburne Road
Applicant has submitted requested traffic information (enclosed).
It is apparent from the indicated traffic volumes that there will be
some delays for left -turning movements - both into and out of the new
building. However, the Bartlett Bay signal will provide gaps to
enable vehicles to turn north onto Shelburne Road; and the existing
shoulders on Shelburne Road are wide enough to allow vehicles to
easily pass any car turning into the office building. In addition,
the applicant is proposing to widen the shoulders 4 feet to become
full 12 foot lanes to make passing movement even easier.
4) SBC Cinema, Shelburne Road
Applicant is proposing a third cinema to replace the enclosed
mall area - similar to the Welby Drug proposal. Total seating capacity
of the three cinemas will be same as the current two cinemas.
Landscaping requirements will be met along the Shelburne Road
frontage of the property rather than in the direct vicinity of the
building.
This site is being reviewed under PCD traffic criteria. In
accordance with the stipulation for the Welby Drug application, a

study (enclosed) indicate that several intersection approaches operate
at worse than level of service C.
A letter from the current applicant (enclosed) indicates the
expected amount and timing of any increase in traffic. Since the
total increase will be minimal, the volume of cars at any one time will
be staggered, and all traffic will be.after peak road hours - there
should be no adverse effect from this application on the existing level
of service.

the proposed gas islands and front of building.and we would extend the canopy
over that.
Mr. Jarrett asked is it your contention that you have to put up the canopy
within 3 feet of the property line in order to remain competitive. Mr. Graf
asked how far the canopy is from the edge of the sidewalk and Mr. Donlan
replied 13'. Mr. Jarrett said is it your contention that you can't operate
without this canopy. Mr. Poalino said that the necessity of the canopy is that
the external island is going to be self -serve and we are also concerned with
the appearance of the location. I anticipate and expect the Jartran trucks to
be moved to the back. Mr. Wesson said with the depth of the lot there is
plenty of room to move back. Mr. Dinklage suggested that they go to the
Planning Commission.

No. 5 Appeal of Mark Hill
Appeal of Mark Hill Investments for Astro Space, Inc., seeking approval from
Section 12.20 Conditional uses, sub,section 12.205 manufacturing and assembly
from previously prepared materials and components. Request is for permission
to occupy an existing structure containing 11,200 square feet as a
manufacturing and assembly operation for conversion to Astro Vans, located at
5 Green Mountain Drive.
Mr. Ward said the area is zoned C-2 District. Section 12.20 Conditional uses
sub section 12.205 manufacturing and assembly from previously prepared
materials and components. Existing uses - automotive repairs - Aamco
Transmissions and Meineke Mufflers. Proposed conversion of astro vans.
Building containing 11,200 square feet.
Mr. Hill said the whole building is 11,200 square feet and going from 3 uses to
1 use. This is to be used for conversion of Astro vans to cargo vans and will
be shipped out right away. It's a commercial type of vehicle. Fits in well
with the area.
The appeal was granted unanimously.
No. 7 Tabled Appeal of the Davis Company
Consider tabled appeal of the Davis Company, Mr. Larry Williams agent. Request
of Vermont Midstate Volco-White to occupy approximately 30% of building.
Mr. Williams said that Midstate Volco White would like to occupy 1/3 of
building at 10 Farrell St. This would be a combination of truck sales, lease
and truck repair. There are 23 parking spaces - there will be new trucks on
site for sale. Trucks for repair would be on a short term basis. Midstate
would agree to what short term means. Mr. Dinklage said he would like to
consider limiting the vehicles for repairs. Mr. Graf said the landscape is
kept up nicely in that area and he would not like to see a lot of wrecked
vehicles parked in that area. Mr. Thibault said the north side is screened.
Mr. Dinklage said if you were to limit the amount of vehicles awaiting repair
how many would you have. Mr. Williams said about 8. The primary use of the

We are writing on behalf of the Meineke Realty Corporation asking
for an extension to the Zoning Permit which was issued on 22
November 1977 in connection with the construction of a 2000 square
foot Muffler Shop at lot #6 Green Mountain Drive in South Burlington.
Planning proceeded on the project as follows:
1) December 1977- The Lessee, Mr. Mark Hill, developed pre-
liminary floor plans with Meineke Realty Corporation.
2) January 1978- The Lessee negotiated lease arrangements with
Meineke Realty Corporation.
3) February 1978- (early) completed lease arrangements, estab-
lished project budget.
4) February 1978 (late) Lessee started selection of Architect.
5) March 1978- Architect selected, contracts for construction
documentation signed.
6) March 1978 (late) - Architect commenced construction doc-
umentation.
7) April 1978 (middle - Documentation complete and released
for bids.
8) 2 May 1978- Bids received, all excessive.
9) May 1978- Early June 1978- Negotiation with various con-
tractors to secure project within budget.

10. June 23 1978- Acceptable proposal secured from contractor,
the project is authorized to proceed.
From the above you will see that the project is proceeding in a
deliberate manner although not as rapidly as planned. We anticipate
that the present schedule will allow occupancy of the building by
on or about 1 September 1978.
We request consideration of an extension of the Zoning Permit so
that the project will proceed as finally planned.

PLANNING COPD!ISSION NOVEMBER 22, 1977
Mr. Palmer said that he had talked to the State Highway Department about entrance
and exit from the property and that no left turns into the lot will be allowed.
People will have to go past the entrance and then turn around so that they can
enter by making'a right turn. Mr. Morency asked about putting a barrier in the
road to prevent left turns, but Mr. Palmer said that the Highway Department had
not liked that idea. Mr. Woolery asked whether the car -leasing business, which
will go on one of the lots, would be generating traffic at specific times of the
day and was told that cars would be taken and returned any time, although not by
the customers themselves. Mr. Morency ssid that it did not seem practical or
good design to have cars have to pass the.lot then turn around and come back to -
get in. Mr. Poger also felt uncomfortable withthatidea. He was not at all
sure that people would obey the "no left turn" signs, or that they would even
see them. 'Mir. Page said that Xr. Palmer had had to depend on the Highway
Department for help in this and he said that part of the approval would be that
the property be developed in phases and that the Commission could review the
situation before the last two lots were developed. Mr. Poger replied that if
3 lots were developed and the Commission decided the situation was dangerous,
they could do nothing about it at that time and it would remain unsafe. Mr.
Page said that the plan was to extend the new industrial road to the east and
that that would make it roughly parallel with this section of road. Trucks could
then go down that way. Mr. Foger still did not like the design and Iir. Morency
felt that it looked temporary, not permanent. Mr. Page said that land for widening
the road would be reserved. Mr. Morency suggested moving the center line over
and having two lanes going down the hill and one up instead of the other way
around. He said that the present set-up would not prevent left turns and he
would rather have a provision for them there. He said that that was much more
reasonable. Mr. Poger said that the Commission should _request the Highway
Department to re -design the entry, moving the center line over as suggested by
Mr. Morency. He asked Mr. Palmer if a delay for that reason would cause him
any hardship and was told that it would not. Mr. Poger moved to continue the
public hearing on Muddy Brook Industrial Park td December 6, 1977 at 7:30 pm
at City Hall._ The motion was seconded by Mr. Morency and passed unanimously.

Mr. DesLauriers said that he had been in before the Commission to talk about this
and that they had liked the idea. There will be 4 small office buildings with
2 curb cuts along Dorset Street. They will be 2 stories tall and contain about
3,000 sq.ft. each. He slid that he had obtained Zoning Board approval to build
the first buildi — a_r-d use it foraReal Estate business. The entire lot has both
t sewer and water lines,he,.said, and he felt that the sewage flow would be very
low. This use of the land would also give the city more money in tax revenues
and would not put any children into the school system, as it would if the land

He said that he would wait until the sewage problem was resolved to put the

He said that the building would be 2,000 sq.ft. and that he thought it met all
of South Burlington's requirements. Mr. k'oolery asked .if_there were room,for
expansion and was told that there was a lot -of it. Mr. --Page said that there
existed on the lot a curb cut which Xeineke did not want -to use and he felt
that they should be sure that it was closed up. Mr. Levesque. suggested, that -
they plant a few trees in the area and said that .they eould get seedlings free
of charge from the Forestry Department. Mr. Woolery moved that the South Burlington
Planning Commission approve the site plan of Mleineke:Realty, Inc., for a 2,000
square foot muffler repair shop, as depicted on a plan entitled, Proposed
Building for 114eineke Discount Mufflers...', dated 10 24 77, unsigned, subject
to the following stipulations:
1) A landscaping bond of 31200 shall be posted.
2) Storm drainage shall be reviewed and approved by the City Engineer.
3) A bond in an amount to be determined by the City Engineer shall be
posted for the closing of the existing curb cut.
The motion was seconded by Mr. Poger and passed unanimously.

Mr. foolery asked how many parking places there were and was told 15. He said
that there would be a lot of cars coming in and going out each time classes
changed and he felt that people shculd be encouraged to move in a circular pattern
around the building. Mr. King said that part of the lot would be gravel and
part would be paved. Be said that directional arrows would direct the cars
around the building. Mr. Poger suggested not allowing people to stop in the front
of the -building. Mr. 'Foolery said that the curb cut looked pretty narrow and he
suggested that the City Engineer look at it. He also said that the side of the
building near Blondin will be pretty narrow in the"wipier due to the snow storage.
Mr. Poger said that the Planning Assistant and the Zoning Administrator had
disagreed about the required amount of landscaping an8 that he would like to see
it go in. Mr. Page felt that the most important landscaping would be to the rear
and that was already there. There was very little plantable area left, he said,
and he was not sure that they should be required to squeeze in a dollar amount
of landscaping. MIr. Wollery suggested that the Tree Planting Committee look at
it and that if there was enough landscaping for less money, that would be OK.

5) Meineke Discount Muffler
This facility has received conditional use approval from the
Zoning Board of Adjustment. The only two trees presently on the lot
will be retained. Only a minor portion of the 2.1 acre lot will be
used by this business. Traffic,circulation, landscaping, access,
and screening are all adequate. Storm drainage should be reviewed
by the City Engineer.
6) Gymnastics School Building, San Remo Drive
The proposed building received a variance to dimensional
requirements from the Zoning Board of Adjustment, largely due to
the lot being a pre-existing small lot (2 acres is minimum required
lot size, lot in question is 1� acre). The lot is devoid of vegeta-
tion; it fronts on San Remo Drive, which carries no through traffic,
and backs up to an existing residential neighborhood. There is
presently a 6' stockade fence on the rear line of the property;
additional plantings are proposed to augment the rear yard buffer
area.
Because of the building and parking layout, and the character
of the neighborhood, I concur with the developer that a waiver on
the required landscaping, from $1500 to $1,000, is appropriate.
7) Horizon Heights, Mofification of Subdivison Approval
This request is for a modification to the approved plan, which
showed that the improve -gent of Quarry Hill Road leading from Spear
Street to the project's primary entrance, would be centered within
the 60 foot right of way, with the sidewalk located on the nouthside.
As built, the road is off center to the north, and the sidewalk is
located on the southside- this modification was approved by the
City Engineer - see his explanatory memo -
A related question has been posed by Cupola Golf Course, Inc.,
which originally sold the 11 acre lot to the developers of Horizon
Heights. As you may recall, Cupola obtained subdivision approval
conditioned on their upgrading Quarry Hill Road to full city design
tandards before any further "substantial develop -tent or subdivision"
,.-ould take place. Thus, to minimize their future roadway L-nprove-
ent costs, Cupola is rightfully insisting that the road i-_-iprove:nents
ne in strict accord with the Planning Coir4nission approval. With the
�_xception of the roadway offset, the road has been built as approved,
according to the City Engineer.

with Nordic Ford, Willie Racine's AMC and Jeep Dealership,
Shearer Chevrolet, moss Dodge, Tuff Kote-Dinol Undercoating
in the immediate vicinity. We feel that Meineke Discount
Muffler Shops will fit in with the character of the area.
• 13.103 - Traffic on roads and highways in the vicinity.
There is a traffic light at the corner*ol Shelburne Road and
Green Mountain Drive which will regulate the traffic flow in
and out of.the Meineke area. Meineke Shops are a retail service
• to their customers for the sale, service and installation of
mufflers, tailpipes, shock absorbers and exhaust systems. The
national average of cars serviced in the Meineke Shop is 8-10
cars per day. The averag,z number of customers in the service
station per day is -approximately 75. We mention this comparison
because we believe that a Meineke Shop will not bring any sub-
stantial increase in traffic to the Shelburne Road area. The
hours the Shops will be open will be from 8 a.m. - 6 p.m. six
days per week.
