FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-01-90 of MDT Partnership, LLP to amend
a previously approved site plan for an 11,200 square foot automotive repair and sales
building at 5 Green Mountain Drive, and an 11,925 square foot automotive repair
building at 9 Green Mountain Drive. The amendment consists of 1) removal of a 3,600
square foot building, with the concrete pad to remain; 2) creation of 2,955 square feet of
paved area for automobile parking, display and storage; and 3) creation of a 500 square
foot paved area between the concrete building pad and the building at 5 Green
Mountain Drive.
On the 18' day of December, 2001, the Director of Planning & Zoning approved the site
plan application of MDT Partnership, LLP under Section 26.10(b) of the South Burlington
Zoning Regulations, based on the following findings:
1. This project consists of a site plan application to amend a previously approved site
plan for an 11,200 square foot automotive repair and sales building at 5 Green
Mountain Drive, and an 11,925 square foot automotive repair building at 9 Green
Mountain Drive. The amendment consists of 1) removal of a 3,600 square foot
building, with the concrete pad to remain; 2) creation of 2,955 square feet of paved
area for automobile parking, display and storage; and 3) creation of a 500 square
foot paved area between the concrete building pad and the building at 5 Green
Mountain Drive.
2. The owner of record is MDT Partnership, LLP.
3. This property is zoned C-2 and is located at the southwest corner of Green
Mountain Drive adjacent to Willie Racine's Jeep. It is located within Traffic
Overlay Zone 4 (High Volume Roadway Segment).
4. Access and circulation. The addition of a 10 foot by 50 foot paved area between
the concrete pad of the 3,600 square foot building that has been removed and the
existing building at 9 Green Mountain Drive will provide for moving vehicles
between the concrete pad and the 9 Green Mountain Drive building. No other
changes to access and circulation are proposed.
5. Pam. The South Burlington Zoning Regulations require one space per 500
square feet of gross building area, or 45 spaces (22,495 SF/500 SF=45). 48 parking
spaces, including four handicapped spaces, are shown on the plans. An additional
2,955 square feet of paved area is proposed at the southwest corner of the lot but is
not shown on the plans as being striped for parking.
6. Coverage: The removal of the 3,600 square foot building will reduce total building
coverage on the site from 29.7% to 25.7%. The maximum for the C2 district is 30%.
With the remaining concrete pad, the new 10 foot by 50 foot paved area, and the
new 2,955 square foot paved area, total site coverage will be increased to 67.6%.
The maximum for the C2 district is 70%. There is no change to the front yard
coverage. Coverage limits are therefore met.
7. Setbacks: No changes affecting setbacks are proposed.
8. Landscaping: Based on the stated cost of improvements of $40,000, additional
landscaping with a value of $1,200 would be required by the Zoning Regulations.
No additional landscaping is shown on the plans. The Director of Planning and

DECISION AND CONDITIONS
Based on the above Findings of Face, the South Burlington Director of Planning and
Zoning approves site plan application #SP-01-90 of MDT Partnership, LLP to amend a
previously approved site plan for. The amendment consists of at 5 and 9 Green
Mountain Drive, as depicted on a set of plans entitled 'Proposed Addition and New
Building for Mark Hill Investment, Inc.," prepared by Forest/Teschmacher Architects,
dated 1Z/5/83 and with a date received notation of November 5, 2001, with the following
stipulations:
1. All previous approvals and stipulations that are not superseded by this approval
shall remain in effect.
2. Prior to issuance of a zoning permit, the applicant shall submit three copies of
revised drawings to the Director of Planning & Zoning clearly indicating 1) the
location of the concrete pad, with a notation that the 3,600 SF building has been
removed; 2) revised calculations of building and overall site coverage; and 3) a
notation that the new impervious area at the southwest corner of the property is
not striped for parking spaces.
3. The applicant shall obtain a zoning permit within six (6) months of the date of this
decision, pursuant to Section 27.302 of the Zoning Regulations, or this approval is
null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer.
5. Any change to the approved site plan shall require approval of the South
Burlington Development Review Board.
