The proposed subdivision will create a 21.88 acre as part of a land exchange in accordance with the settlement agreement between the City of South Burlington and JAM Golf, LLC while JAM Golf will retain the remaining 47.99 acres. This application does seek approval for the relocation of the existing recreation path from the retained Parcel F to the new Parcel F1. Any future development beyond this for the new lot will be subject to City review. This completes our summary of the proposed features of the project. An existing recreation path will be relocated in conjunction with this project. Otherwise, no other development is proposed or approved. The Project is located at 236 Golf Course Road in South Burlington, Vermont. The District #4 Environmental Commission is reviewing this application under Act 250 Rule 51 -- Minor Applications. Copies of the application and proposed permit are available for review at the office listed below. The application and a draft permit may also be viewed on the Natural Resources Board's web site (www.nrb.state.vt.us/lup) by clicking on "Act 250 Database" and entering the project number "4C0983-16". No hearing will be held and a permit clay be issued unless, on or before July 7, 2017, a person notifies the Commission of an issue or issues requiring the presentation of evidence at a hearing or the Commission sets the matter for hearing on its own motion. Any development or subdivision subject to the permit requirements of 10 V.S.A. Section 6081 and these rules may be reviewed in accordance with this rule as a "minor application" if the district commission determines that there is demonstrable likelihood that the project will not present significant adverse impact under any of the 10 criteria of 10 V.S.A. Section 6086(a). In making this determination, the district commission may consider: (1) the extent to which potential parties and the district commission have identified issues cognizable under the 10 Criteria; (2) whether or not other State permits identified in Rule 19 are required and, if so, whether those permits have been obtained or will be obtained in a reasonable period of time; (3) the extent to which the project has been reviewed by a municipality pursuant to a by-law authorized by 24 V.S.A. Chapter 117; (4) the extent to which the district commission is able to draft proposed permit conditions addressing potential areas of concern; and (5) the thoroughness with which the application has addressed each of the 10 criteria. (B) Preliminary procedures. The district commission shall review each application to determine whether the project qualifies for treatment under this Rule. If the project is found to qualify under section (A), the district commission shall: (1) prepare a proposed permit including appropriate conditions; and (2) provide written notice and a copy of the proposed permit to those entitled to written notice under 10 V.S.A. Section 6084; and (3) provide published notice as required by 10 V.S.A. Section 6084; the notice shall state that: (a) the district commission intends to issue a permit without convening a public hearing unless a request for hearing is received by a date specified in the notice which is not less than seven days from the date of publication; and (b) the preparation of findings of fact and conclusions of law by the district commission may be waived; and hearing -land (c) any person as defined in 10 V.S.A. Section 6085(c)(1) may request a (d) any hearing request shall state the criteria or subcriteria at issue, why a hearing is required and what evidence will be presented at the hearing; and (e) any hearing request by a person eligible for party status pursuant to 10 V.S.A. Section 8085(c)(1)(E) must include a petition for party status under these rules. (C) No hearing requested. If no hearing is requested by a party by right or a person eligible for party status pursuant to 10 V.S.A. Section 8085(c)(1), the proposed permit may be issued with any necessary modifications unless the district commission determines to schedule a hearing, on its own motion. The district commission may delegate the authority to sign minor permits which have been approved by the district commission to the district coordinator or the assistant district coordinator; (D) Hearing requested. Upon receipt of a request for a hearing, the district commission shall determine whether or not substantive issues have been raised under the criteria and shall convene a hearing if it determines that substantive issues have been raised. If the district commission determines that substantive issues have not been raised, the district commission may proceed to issue a decision without convening a hearing. If a hearing is convened, it shall be limited to those criteria or sub -criteria identified by those afforded party status pursuant to 10 V.S.A. Section 8085(c)(1), or by the district commission unless the district commission, at its discretion, determines before or during the hearing, that additional criteria or subcriteria should be addressed. (E) Party status petitions. The district commission shall rule on all party status petitions prior to or at the outset of the hearing. (F) Findings of Fact. The district commission need only prepare findings of fact and conclusions of law on those criteria or sub -criteria at issue during the hearing. However, findings of fact and conclusions of law may be issued with a decision to address issues identified and resolved during the minor application process, even if no hearing is held. (G) Material representations. Upon issuance of a land use permit under minor application procedures, the permit application and material representations relied on during the review and issuance of a district commission decision shall provide the basis for determining future substantial and material changes to the approved project and for initiating enforcement actions. Y:\NRB\NRB - Shared\MISC\Rule 51 Minor Application Procedures (5-9-12).docx STATE OF VERMONT NATURAL REoOURCES BOARD - DISTRICT CC,.AISSIONS ACT 250 The following general information is provided to assist participants and observers at Act 250 hearings in following and understanding what is taking place. In all cases when specific information about Act 250 is required, you should refer to 10 V.S.A. Chapter 151 (the Act 250 statute) and the Act 250 Rules, available from the Natural Resources Board's main office and regional offices, as well as on our web site (see next page for addresses). The Act 250 hearing is conducted by a three -member District Environmental Commission. Each Commission also has up to four alternate Commissioners. The Commissioners are appointed by the Governor of the State of Vermont. Their responsibility is to consider evidence presented by legally designated parties and to evaluate each Act 250 application in accordance with the 10 Criteria below. The District Coordinator's role is to assist the District Commission in the procedural aspects of the application review, as well as to provide advice to the applicant and the various parties. Statutory parties are: the applicant; the municipal planning commission; the municipality (represented by either the selectboard, aldermen, or trustees), the regional planning commission; and affected State agencies. Adjoining property owners and other persons with a particularized interest that may be affected under any of the 10 Criteria may also be admitted as parties, pursuant to 10 V.S.A. Sec. 6085. Adjoining property owners, other persons, and organizations seeking party status must make their request on or before the first day of the hearing (or prehearing conference if one is held) and must state the details of their particularized interest in the proceedings under the 10 criteria of Act 250. "Particularized Interest" means any interest protected under the Act 250 criteria that may be affected by the proposed project. In the case of an adjoining property owner, those interests often relate directly to the potential for impacts on land owned next to the project tract, but the interests need not relate to land ownership or the land itself. The interest must be specific and particular to the individual and thus distinguishable from the interests of the general public. For instance, a petitioner for party status must adequately demonstrate a potential impact relating to aesthetics, noise, stormwater runoff, traffic, air or water pollution, or other project impacts under the criteria that are specific to that individual. A party status request by a person must provide a description of the location of the person's property in relation to the proposed project. A request by an organization must describe the organization, its purposes, and the nature of its membership. The District Commission may also allow persons not accorded party status the opportunity to participate in the proceeding as a "friend of the commission," pursuant to 10 V.S.A. Sec. 6085(c)(5). In this instance, the participation may be limited to the filing of memoranda, proposed findings of fact and conclusions of law, and argument on legal issues. A petition to participate as a friend of the commission shall identify the interests of the petitioner, the desired scope of participation, and shall state the reasons why the petitioner's participation will be beneficial to the District Commission. 10 CRITERIA Before granting a permit, the District Commission must ensure that the development or subdivision meets the following criteria: (1) Will not result in undue water or air pollution. This criterion deals with water and air pollution generally and such specific matters relating to water pollution as: (A) Headwaters; (B) Waste disposal (including wastewater and stormwater); (C) Water Conservation; (D) Floodways; (E) Streams; (F) Shorelines; and (G) Wetlands. (2) Has sufficient water available for the needs of the subdivision or development. (3) Will not unreasonably burden any existing water supply. (4) Will not cause unreasona' soil erosion or affect the capacity the land to hold water. (5) (A) Will not cause unreasonably dangerous or congested conditions with respect to highways or other means of transportation. (B) As appropriate, will incorporate transportation demand management strategies and provide safe access and connections to adjacent lands and facilities and to existing and planned pedestrian, bicycle, and transit networks and services. (6) Will not create an unreasonable burden on the educational facilities of the municipality. (7) Will not create an unreasonable burden on the municipality in providing governmental services. (8) Will not have an undue adverse effect on aesthetics, scenic beauty, historic sites or natural areas, and 8(A) will not imperil necessary wildlife habitat or endangered species in the immediate area. (9) Conforms with the Capability and Development Plan, including the following considerations: (A) The impact the project will have on the growth of the town or region: (B) Primary agricultural soils; (C) Productive forest soils; (D) Earth resources; (E) Extraction II of earth resources; (F) Energy conservation; (G) Private utility services; (H) Costs of scattered developments; (J) Public utility services; (K) Development affecting public investments; and (L) Settlement Patterns. (10) Is in conformance with any local or regional plan or capital facilities program. The burden of proof is on the applicant for Criteria 1, 2, 3, 4, 9, and 10. The burden of proof is on those opposing the application for Criteria 5, 6, 7, 8, and often 9(A). A permit can be conditioned but not denied under Criteria 5, 6, and 7. Regardless of the burden of proof, the Commission must have enough information to make findings under all of the criteria. At the conclusion of the hearing, the District Commission will either adjourn the hearing or declare a recess to allow additional information to be presented. If the hearing is adjourned, the Commission will issue a decision in the form of Findings of Fact and Conclusions of Law, and, if appropriate, a Land Use Permit, within twenty days. A decision issued by the District Environmental Commission may be appealed to the Superior Court, Environmental Division (Environmental Court) by the applicant, the town, the regional planning commission, a state agency, or any "person aggrieved" by the Commission's decision, pursuant to 10 V.S.A. Sec. 8504. An appeal of a decision of the Environmental Court is to the Vermont Supreme Court. Act 250 permits do not supersede or replace the requirements of other local or state permits. Any best management practices (BMP's) depicted on the project's EPSC Site plan which go beyond the Handbook requirements we considered to be integral to the management of the site and represent components of the municipal EPSC approval for the project which shall be implemented. The EPSC plan depicts one snap shot in time of the site. All construction sites are fluid in their day to day exposures and risks as it relates to minimizing sediment loss from the site. It Is the responsibllity of the Contractor to Implement the necessary BMP's to comply with the Low Risk Handbook standards outlined on this sheet based on the Interim site disturbance conditions which may or may not be shown on the EPSC Site Plan. Specific BMP's which are critical to allowing the project to be considered e Low risk site Include the items checked below: • Limit the amount of disturbed earth to two acres or less at any one time. • There shall be a maximum of 7 consecutive days of disturbed earth exposure in any location before temporary or final stabilization is implemented. 1. Mark Site Boundaries Purpose: Mark the site boundaries to identify the limits of construction. Delineating your site will help to limit the area of disturbance, preserve existing vegetation and limit erosion potential on the site. How to comply: Before beginning construction, walk the site boundaries and flag trees, psi signs, or install orange safety fence. Fence is required on any boundary within 50 feet of a stream, lake, pond or wetland, unless the area is already developed (existing roads, buildings, etc) 2. Limit Dsturbance Area Purpose: Limit the amount of sal exposed at one time to reduce the potential erosion on site. Requirements: The permitted disturbance was is specified on the sites written authorization to discharge. Only the acreage listed on the authorization form may be exposed at any given time. How to comply: Plan ahead and phase the construction activities to ensure that no more than the permitted acreage is disturbed at one time. Be sure to properly stabilize exposed soil with seed and mulch or erosion control matting before beginning work in a new section of the site. 3. Stabilize Construction Entrance Purpose: A stabilized construction entrance helps remove mud from vehicle wheels to prevent tracking onto streets. Requirements: If there will be any vehicle traffic off of the construction site, you must install a stabilized construction entrance before construction begins. How to Install Rock Sim: Use a mix of 1 to 4 inch stone Depth: 8 inches minimum Width: 12 feet minimum Length: 40 feet minimum (a length of driveway, if shorter) Geaexllle: Place filter cloth under entire gravel bed Malmenance: Redress with clean stone as required to keep sediment from tracking onto the street. 4. Divert Upland Runoff Purpose: Diversion berms intercept runoff from above the construction site and direct it around Me disturbed area. This prevents clean water from becoming muddied with soil from the construction site. Requirements: ff storm water runs alto your site from upslope areas and your site meets the following two conditions, you must insult a diversion berm before disturbing any soil, i. You plan to have one or more acres of sal exposed at any one time (excluding roads). 2. Average slope of the disturbed area is 20% or steeper. How to Install: 1. Compact the berm with a shovel or earth -moving equipment. 2. Seed and mulch berm or cover with erosion control matting immediately after installation. 3. Stabilize the flow channel with seed and straw mulch or erosion control matting. Line the channel with 4 inch stone if the channel slope is greater than 20%. 4. Ensure the berm drains to an outlet stabilized with riprap. Ensure that there is no erosion at the outlet. 5. The diversion berm shall remain in place until the disturbed areas are completely stabilized. 6. Slow Down Channelized Runoff Purpose: Stone check dams reduce erosion in drainage channels by slowing down the storm water flow. Requirements: It there is a concentrated flow (e.g, in a ditch or channel) of storm water at your site, than you must install stone check dams. Hay bales must not be used as check dams. How to Install: Height: No greater than 2 feet, Center of dam should be 9 inches lower than the side elevation Side slopes: 2:1 or flatter Stone size: Use a mixture of 2 to 9 inch stone Width: Dams should span the width of the channel and extend up the sides of the banks Spacing: Space the dams so that the bottom (toe) of the upstream dam s at the elevation of the top (crest) of the downstream dam. This spacing is equal to the height of the check dam divided by the channel slope. Spacing (in feet) = Height of check dam (in feet)/Slope in channel (tt/tt) Maintenance: Remove sediment accumulated behind the dam as needed to allow channel to drain through the stone check dam and prevent large flows from carrying sediment over the dam. If significant erosion occurs between check dams, a liner of stone should be installed. 7. Construct Permanent Controls Purpose: Permanent storm water treatment practices are constructed to maintain water quality, ensure groundwater flows, and prevent downstream flooding. Practices include detention ponds and wetlands, infiltration basins. and storm water filters. Requirements: If the total impervious• area on your site, or within the common plan of development, will be 1 or more acres, you must apply fm a State Storm water Discharge Permit and construct permanent storm water treatment practices on your site. These practices must be installed before the construction of any impervious surfaces. Stabilize Exposed Soil Purpose: Seeding and mulching, applying erosion control matting, and hydroseeding are all methods to stabilize exposed soil. Mulches and matting protect the soil surface while grass is establishing. Requirements: All areas of disturbance must have temporary or permanent stabilization within 7, 14, or 21 days of initial disturbance, as stated in the project authorization After this time, any disturbance in the area must be stabilized at the end of each work day. The following exceptions a cot tions apply: PPY • Stabilization is not required if earthwork is to continue in the area within the next 24 hours and there is no precipitation forecast for the next 24 hours. • Stabilization is not required if the work is occurring in a self-contained excavation (i.e. no outlet) with a depth of 2 feet or greater (e.g. house foundation excavation, utility trenches). All areas of disturbance must have permanent stabilization within 48 hours of reaching final grade. Winter Stabilization Purpose: Managing construction sttes to minimize erosion and prevent sediment loading of water: is a year-round challenge. In Vermont, this challenge becomes even greater during the late fall, winter, and early spring months. Winter construction' as discussed here, describes the period between October 15 and April 15, when erosion prevention and sediment control is significantly more difficult. Rains in late fall, thaws throughout the winter, and spring melt and rains can produce significant flows over frozen and saturated ground, greatly increasing the potential for erosion Requirements for Wlnlar Shutdown: For those projects that will complete earth disturbance activities prior to the winter period (October 15), the following requirements must be adhered to: 1. For areas to be stabilized by Vegetation, seeding shall be completed no later then September 15 to ensure adequate growth and cover. 2. If seeding is not completed by September 15, additional non -vegetative protection must be used to stabilize the site for the winter period. This includes use of Erosion Control Matting or netting of a heavy mulch layer. Seeding with winter rye is recommended to allow for early germination during wet spring conditions. 3. Where mulch is specified, apply roughly 2 inches with an 80-90% cover, Mulch should be tracked in or stabilized with netting in open areas vulnerable to wind. Requirements for Winter Constmction If construction activities involving earth disturbance continue past October 15 or begin before April 15, the following requirements must be adhered to: I. Enlarged access points, stabilized to provide for snow stockpiling. 2. Limits of disturbance moved or replaced to reflect boundary of winter work. 3. A snow management plan prepared with adequate storage and control of meltwater, requiring cleared snow to be stored down slope of all areas of disturbance and out of storm water treatment structures. 4. A minimum 25 fool buffer shall be maintained from perimeter controls such as silt fence. 5. In areas of disturbance that drain to a water body within 100 feat, two sea of silt fence must be installed along the contour. 6. Drainage structures must be kept open and free of snow and ice dams, 7. Silt fence and other practices requiring earth disturbance must be installed ahead of frozen ground. 8. Mulch used for temporary stabilization must be applied at double the standard rate, or a minimum of 3 inches with an 80.90%cover. 9. To ensure cover of disturbed soil in advance of a melt event, areas of disturbed soil must be stabilized at the end of each work day, with the following exceptions: • If no precipitation within 24 hours is forecast and work will resume in the same disturbed area within 24 hours, daily stabilization is not necessary. • Disturbed areas that collect and retain runoff, such as house foundations or open utility trenches. 10. Prior to stabilization, snow or ice must be removed to less than 1 inch thickness. 11. Use stone to stabilize areas such as the perimeter of buildings under construction or where construction Vehicle traffic is anticipated. Stone paths should be 10 to 20 feet wide to accommodate vehicular traffic, 10. Stabilize Soil at Final Grade Purpose: Stabilizing the site with seed and mulch or erosion control matting when it reaches final grade is the best way to prevent erosion while construction continues. Requirements: Within 48 hours of final grading, the exposed soil must be seeded and mulched or covered with erosion control matting. How to comply: Bring the site or sections of the site to final grade as soon as possible after construction is completed. This will reduce the need for additional sediment and erosion control measures and will reduce the total disturbed area. For seeding and mulching rates, follow the specifications under Rule 6, Stabilizing Exposed Soil. 11. Dewatering Activities Punpoea: Treat water pumped from dewatering activities so that it is clear when leaving the construction site. Requirements: Water from dewatering activities that flows off of the construction site must be clear, Water must not be pumped into storm sewers, lakes, or wetlands unless the water is clear. How to comply: Using sock filters or sediment filter bags on dewatering discharge hoses or pipes, discharge water into silt fence enclosures installed in vegetated way from waterways. Remove accumulated sediment after the water has dispersed and stabilize the area with seed and mulch 12. Inspect Your Site Purposes: Perform site inspections to ensure that all sediment and erosion control practices are functioning properly Regular inspections and maintenance of practices will help to reduce costs and protect water quality, Requirements: Inspect the site at least once every 7 days and after every rainfall or snow melt that results in a discharge from the site. Perform maintenance toe sure that practices are functioning according to the specifications outlined in this handbook. In the event of a noticeable sediment discharge from the construction site, you must take immediate action to inspect and maintain existing erosion prevention and sediment control practices. Any visibly discolored storm water runoff to waters of the State must be reported.
