MOTION OF APPROVAL
I move the South Burlington Planning Commission approve the final
plat application of Howard Slack for subdivision of 0.72 acres of
land into two (2) parcels of 0.38 acres and 0.34 acres as
depicted on a plat entitled "Revised Plan - Pine Tree Farm Lots,
Williston Road",- prepared by Warren Robenstein and dated March,
1992, last revised 5/11/92, with the following stipulations:
1. The applicant for a zoning/building permit for a structure on
lot 13 shall pay the required sewer fee and per unit recreation
fee prior to issuance of the zoning/building permit.
2. The final plat shall -he recorded in the South Burlington land
records within 90 days or this approval is null and void.

This project, consisting of an existing single family residence
on so-called lot 13 located at 22 Gilbert Street in the city of
South Burlington, Vermont is hereby approved under the
requirements of the regulations named above, subject to the
following conditions.
GENERAL
1. The project shall be completed as shown on the plans which
have been stamped "approved" by the Wastewater Management
Division. The project shall not deviate from the approved
plans without prior written approval from the Wastewater
Management Division.
2. This project has been reviewed and is approved with an
existing single family residence. No other buildings are
allowed without prior review and approval by the Agency, and
such approval will not be granted unless the proposal
conforms to the applicable laws and regulations.
3. Each prospective purchaser of the lot shall be shown a copy
of the approved plot plan and this Subdivision Permit prior
to conveyance of the lot.
4. The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee
and all assigns and successors in interest. The permittee
shall be responsible for the recording of this permit and
the "Notice of Permit Recording" in the South Burlington
Land Records within 30 days of issuance of this permit and
prior to the conveyance of any lot subject to the
jurisdiction of this permit.

WATER SUPPLY
5. The lot is approved for water supply by connection to the
municipal water system. No other means of obtaining potable
water shall be allowed without prior review and approval by
the Wastewater Management Division.
SEWAGE DISPOSAL
6. The lot is approved for wastewater disposal by connection to
the municipal sewer system. No other method of wastewater
disposal shall be allowed without prior review and approval
by the Wastewater Management Division, and such approval
will not be granted unless the proposal conforms to the
applicable laws and regulations.

Mr. Burgess noted the lots will be equal in size to other lots on
the street.
Mr. Austin moved the Plannin Commission approve the finalplat
application of Howard Slack for subdivision on 0.72 acres of land
into two (2) parcels of 0.38 acres and 0.34 acres as depicted on
a plat entitled "Revised Plan - Pine Tree Farm Lots, Williston
Road," prepared by Warren Robenstein and dated March 1992, last
revised 5/11/9.2, with the following stipluations:
1. The applicant for a zoning/building permit for a structure on
lot 13 shall pay the required sewer fee and per unit recreation
fee prior to issuance of the zoning/buildin permit.
2. The final plat shall be recorded in the South Burlington land
records within 90 days or this approval is null and void.
Mrs. Maher seconded. Motion passed unanimously.
4. Continue Site Plan application of Salamin Handy for an 80-room
motel and 178 seat quality restaurant, 792 Shelburne Road:
Mr. Burgess asked the applicant to describe the changes to the
plan. Mr. Handy said they have removed 25 ft. of restaurant to
conform with the gas stationnext door. They have reduced the
motel to 64 rooms and the restaurant to 123 seats. They have
also re -angled the parking and put up a barrier between this lot
and the Pizza Hut lot. There is more space for fire trucks to
negotiate turns. The reduction in size and number of rooms
reduces traffic.
Mr. Sheahan asked if there is adequate room for trucks servicing
the restaurant to turn around. Mr. Handy said there is a 12 ft.
space between buildings. Trucks will have to follow the same
pattern as everyone else. Mr. Craig asked what other cars will
do when trucks park to unload. Mr. Handy said deliveries are
very early in the morning. The only problem would be the
blocking of one handicapped space. Mr. Craig and Mr. Sheahan
felt it would be a tough situation.
Mr. Sheahan asked if the motel would turn away tractor trailers
that want to stay the night. Mr. Handy said they can refuse
anyone they want. He noted they'd had a problem once and had
to refund money to other guests because of the noise of the
trucks. They won't allow tractor trailers in this facility.

The South Burlington Planning Commission held a meeting on
Tuesday, 12 May 1992, at 7:00 pm, in the Conference Room, City
Hall, 575 Dorset St.
Members Present:
William Burgess, Chairman; Terry Sheahan, Ann Pugh, Catherine
Peacock, Mary -Barbara Maher, David Austin, William Craig

1. Other Business:
a. John Larkin noted that one of the stipulations of the approval
for the expansion of Pillsbury Manor was that the small house
would be torn down. He said they now feel they can save it and
find some use for it. Members felt it was inappropriate for the
house to remain and denied the request.
b. Ms. Pugh announced that she will be leaving the Commission at
the end of the month as she is running for the Legislature.
c. Mr. Burgess noted that he had appeared last night on a Channel
17 call -in show to represent the Planning Commission's position
on the proposed zoning vote. Nile Duppstadt and Charles Scott
represented opposing points of view.
2. Review Minutes of 3 March 1992:
Ms. Peacock moved the Minutes of 3 March be approved as written.
Mr. Sheahan seconded. Motion passed 6-0 with Mrs. Maher ab-
staining.
3. Sketch Plan application of Howard Slack for subdivision of
0.72 acres of land into two parcels of 0.38 and 0.34 acres, 24
Gilbert Street:
Mr. Slack noted that on the original map these were lots 12 and
13. They want to subdivide so they can sell one of the lots
(#13). He also noted that they have added the 5 ft. necessary so
both lots will have required frontage. Gas, water, and sewer
services are already in place.
The Planning Commission foresaw 'no problems with the subdivision.

3) HOWARD SLACK - 2 LOT SUBDIVISION - GILBERT STREET
This project consists of the subdivision of a .72 acre lot into
two (2) lots of .38 acres and .34 acres. The applicant purchased
two (2) adjacent lots in 1949 as one (1) lot. He now wants to
reestablish these two (2) lots but since one of these lots is
substandard due to insufficient frontage, this subdivision is
necessary. It is the City Attorney's opinion and state law that
when two (2) or more substandard lots are owned by the same
person(s) prior to the effective date of the current zoning
regulations, that these lots are automatically merged and
subdivision is necessary to transfer any portion of the merged
lot. The Planning Commission reviewed the sketch plan for
this subdivision on 5/12/92 (minutes not yet available).
This property at 24 Gilbert Street is located in the R4 District.
It is bounded on the north by a two-family dwelling, on the west
by Gilbert Street and on the east and south by single-family
residences.
The southerly lot. (lot #12) is currently developed with a single
family dwelling and the northerly lot (lot #13) is currently
undeveloped.
Area & Dimensions: Both lots will meet the minimum area and
dimension requirements.
Access: Both lots have frontage on Gilbert Street. Lot #12
currently has an access and lot #13 does not.
Sewer: The sewer allocation for this project is 450 gpd. The
per gallon fee would have to be paid at the time a
zoning/building permit is issued.
Recreation: The applicant will be required to pay the per unit
recreation fee in effect at the time a zoning/building permit is
issued for construction on lot #13.

The South Burlington Planning Commission will hold a public
hearing at the South Burlington City Hall, Conference Room, 575
Dorset Street, South Burlington, Vermont on Tuesday, June 9, 1992
at 7:30 P.M. to consider the following:

The site plan should be revised to show the following:
--- a curbed median on the west side of main access rather than
"Jersey Barriers" as approved on 3/24/92.
--- the painted arrows and dashed lines south of the proposed

John Larkin will be at Tuesday's meeting to raise an issue under
other business. It. .is in regards to the Pillsbury Manor III
project. Phase I of the project has been constructed. Phase II
cannot start until after the white house is razed. John would
now like to keep the white house as is. He would like an
indication from the Planning Commission if they might support an
amendment to keep the white house up, or if he should just forget
about it and raze the house. Minutes of October 16, 1990 are
enclosed.
3) HOWARD SLACK - 2 LOT SUBDIVISION - GILBERT STREET
This project consists of the subdivision of a .72 acre lot into
two (2 )-„,lots of .:38 acres and .34 acres. The applicant purchased
two (2) ajacent lots in 1949 as one (1) lot. IHe now wants to
reestab}_ish these two (2) lots but since one of these lots is
substandard due to insufficient frontage, this subdivision is
necessary. It is the Ci-"-.y Attorney' s opinion and state law that
when two (2) or moire substandard lots are owned by the same
person(s) prior to the effective date of the current zoning
regulations, that. these lots are automatically merged and
subdivision is necessary to transfer any portion of the merged
lot.
This property at. 24 Gilbert Street is located in the R4 District.
It is bounded on the north by a two-family dwelling, on the west.
by Gilbert, Street and on the east and south by single-family
residences.
The southerly lot. (lot. #12) is currently developed with a single
family dwelling and the northerly lot (lot #13) is currently
undeveloped.

Shelburne Road cemetery, a large healthy oak tree is very close
to the cemetery line. This oak tree should be saved. This line
should have substantial screening because there are burials close
to this line. A cedar hedge or a stockade fence is recommended.
