Nothing else changes in regard to existing conformance or lack thereof with the LDRs, and no nonconformance would be increased or created by this change in lot size and boundary. No actual development upon the land is proposed; this is just moving the boundary between these two adjoining lots. A proper survey and table has been submitted to illustrate and explain all aspects of this proposal. 15.18 Criteria for Review of PUDs, Subdivisions and Master Plans A. General Standards. In all zoning districts of the City, the DRB shall make findings of fact on a PUD, subdivision and/or Master Plan in keeping with the standards for approval of subdivisions in Article 15 and/or site plans and conditional uses in Article 14. PUD, subdivision and Master Plan applications in the Central District shall meet the standards and criteria applicable in the appropriate sub -district and shall be consistent with the Comprehensive Plan goals for the City Center. For PUD, subdivision and/or Master Plan applications within the SEO, 10 and R1-Lakeshore districts, the DRB shall also make positive findings with respect to the project's compliance with the specific criteria in this section. The general standards applicable to all PUDs, subdivisions and Master Plans are: (1) Sufficient water supply and wastewater disposal capacity is available meet the needs of the project in conformance with applicable State and City requirements, as evidenced by a City water allocation, City wastewater allocation, and/or Vermont Water and Wastewater Permit from the Department of Environmental Conservation. (2) Sufficient grading and erosion controls will be utilized during construction and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. In making this finding, the DRB may rely on evidence that the project will be covered under the General Permit for Construction issued by the Vermont Department of Environmental Conservation. (3) The project incorporates access, circulation and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. In making this finding the DRB may rely on the findings of a traffic study submitted by the applicant, and the findings of any technical review by City staff or consultants. (4) The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. In making this finding the DRB shall utilize the provisions of Article 12 of these Regulations related to wetlands and stream buffers, and may seek comment from the Natural Resources Committee with respect to the project's impact on natural resources. (5) The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. (6) Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. (7) The layout of a subdivision or PUD has been reviewed by the Fire Chief or his designee to insure that adequate fire protection can be provided, with the standards for approval including, but not be limited to, minimum distance between structures, street width, vehicular access from two directions where possible, looping of water lines, water flow and pressure, and number and location of hydrants. All aspects of fire protection systems shall be designed and installed in accordance with applicable codes in all areas served by municipal water. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. Both of the subject lots are currently connected to the public sewer system. The sewer service lines are depicted on the plans. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. There is no construction or earthwork proposed through this project. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. Both of the subject properties are currently accessed by private driveways off of Gilbert Street. No changes are proposed. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. There are no wetlands on the subject property. The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning districts) in which it is located. Both structures are currently in existence, so this criterion is not applicable to the proposed project. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. This criterion is not applicable to the proposed project. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. Staff does not feel that this project warrants review by the South Burlington Fire Chief. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. This criterion is not applicable to the proposed project. Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. 1. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. Mr. Kupferman asked if the density from the units that are not being built was transferred elsewhere on the property. Mr. Scheuer said it was and showed where lots were added. There will also be more multi -family units. Ms. Hinds explained the "technical review process." The applicant noted that the State Agency of Natural Resources has been working with them. Mr. Wetzel questioned whether the applicant can meet the affordable housing criteria. He noted that Dorset Farms is having a hard time doing that. Mr. Scheuer said they have a commitment for a non-profit administrator to oversee that. He then explained the affordable housing regulations and said he was confident they could meet the requirements. An audience member asked about the impact on schools and sewers. Mr. Scheuer said there is plenty of capacity in the school and in the sewage treatment plant. Mr. Cimonetti asked what Master Plan approval means. Ms. Hinds said a Master Plan approval establishes overall housing density, the road network and building envelopes. If, in the future, the applicant wants to change any of those things, they have to go back to sketch plan again. Mr. Miner asked if the project will have sidewalks. Mr. Scheuer said it will. Ms. Kupersmith said the densities of a Master Plan are maximums. The applicant may not be able to get those densities when they actually engineer the neighborhood. Mr. Cimonetti noted that a master plan can also be changed. Mr. Kupferman reminded interested parties of the September 7t' Preliminary Plat hearing for this plan. DEVELOPMENT REVIEW BOARD 17 AUGUST 2004 Ms. Quimby moved to approve Final Plat Application #SD-04-57 of Thomas & Patricia Meaker subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 5. Sketch plan application #SD-04-52 of Danial & Elspeth Tolan and Veronique Dobson for a boundary line adjustment (minor subdivision) between 9 Tabor Place and 165 Holbrook Road: Ms. Tolan said they want to "pivot" the boundary line between the 2 properties. One property gains a bit in the front yard and the other gain a bit in their backyard. Mr. Belair said staff has no issues with the plan. 6. Sketch Plan Application #SD-04-56 of Paul & Linda Effel to subdivide a 0.58 acre lot developed with a single-family dwelling into two lots: Ms. Effel said this had been kept as a double lot and they now want to subdivide it and put another dwelling on the back lot. Ms. Effel said she had a problem with staff comments. She felt the minimum lot size should be stated at 9500 feet, not 10,890 as staff said. Mr. Belair explained that 9500 is the minimum lot size but the applicant would need at least half an. acre in order not to exceed density. In order to avoid this, they would have to apply as a PUD. Mr. Kupferman asked if they applicant would consider combining driveways to avoid having 2 curb cuts. Ms. Effel said they would. Mr. Bolton said there could be a problem with the garage if they did this. Ms. Effel noted it would also require an easement. 7.
