DECISION AND FINDING OF FACT
On the 13th day of May, 1996 the South Burlington Zoning Board of
Adjustment heard testimony regarding a variance application of Mr.
& Mrs. Charles Parker Jr., 49 Forest Street.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question is zoned R-4 District.
2) Section 25.00 requires a minimum set -back of thirty (30) feet.
3) The property in question contains 8,832 square feet with
ninety six (96) feet of frontage.
4) The property is developed with a 281x 40' single family
dwelling with a rear deck and above ground swimming pool.
5) The existing setback is thirty-two (32) feet.
Conclusion
1) The property was developed in the 1960's as a ranch type
dwelling.
2 ) The proposed porch 8' x 28' is a reasonable size and not out of
character with the surrounding properties.
3) Neighborhood is developed with decks and porches of similar
character and design.
4) Architectural modification is a way to update the appearance
of the property.
5) Six foot encroachment represents a minimum variance to allow
for a reasonable expansion of a porch.
6) A twenty-four (24) foot setback will not alter the general
character of the area.

7 ) The narrowness of the lot prevents locating a porch to the
side of the structure.
Based upon the findings and conclusion set -forth above, the Zoning
Board of Adjustment hereby grants the applicant's request to
construct a 8'x 20' porch to within twenty-four (24) feet of the
required front yard located 4tllw Forrest ,S;L;,eet.
