Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on June 22, 1998 by
application of Timothy and Irene Russell for a variance to construct a 8' x 18' deck to within sixteen (16)
feet of the required front yard at 2 Forest Street according to plans submitted. The Board of Adjustment
finds as follows:
Area in question zoned R-4 District.
Section 25.00 Dimensional requirements requires a minimum front yard of thirty (30) feet.
Lot contains 7,872 square feet which is non -conforming, minimum lot area required is 9500 square
feet.
Property is a corner lot with a thirty four (34) foot setback on Forest Street and a thirty seven (37)
foot setback on Logwood Street from the curb line.
Size of lot and placement of house on the lot presents hardship for current owners.
Deck and porches are consistent with character of neighborhood.
Deck entrance is a reasonable use of the property. Deck replaces existing walk and steps.
ORDER
The variance to construct a 8' x 18' deck at 2 Forest Street is hereby GRANTED
