Raymond Giroux, St. John Viarntey Church, the appellant, for a variance to construct it covered exterior stairway to within six (6) feet of the northerly side yard, according to plans submitted. The Zoning Board of Adjustment finds as follows: 1) 142 Hinesburg road is a Residential District. 2) The structure is a pre-existing non -complying residential unit. 3) Conditional use approval was granted on May 13, 1991 to convert the dwelling for church functions and meeting rooms, 4) The structure is non -complying to dimensional requirements. 5) The proposed addition is a three foot wide covered stairway located on the northerly side of the structure. 6) The property is at least 75 years old, too narrow to permit any changes under zoning by-laws. 7) Safety concerns need to provide emergency exit from second floor. 8) Adjoining property owners supports the request for a variance. 9) Variance does not alter the character of the neighborhood.
