DECISION AND FINDING OF FACT
On the 28t.h day of July, 1997, the South Burlington Zoning Hoard of
Adjustment heard testimony regarding a variance application of
Daniel & Leo O'Brien, d.b.a. Airport Mobil, 1801 Williston Road.
Also attending the meeting was Patrick O'Brien, Kevin Spillane and
Steve DeCoursey.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludss, and decides as
follows;
Findinqs of Fact
1) The area in question is zoned C-1 District.
2) Section 25.00 of the zoning by-laws requires a minimum front
yard of fifty seven (57) feet from the planned right-of-way.
3) The lot in question is developed as a mini-mart/service
station with gasoline pump islands along Kennedy Drive and
Williston Road,
4) The gasoline pump islands are located within the required
setback.
5) Applicant is proposing a canopy 30' x 55' to within two (2)
feet of the Williston Road property line.
conclusion
1) Unique physical circumstances, rear and easterly portion of
land is unusable due to steep embankment.
2) Hardship created by others. Frontage taken by eminent domain
over a 25 year period.
3) Location of pump islands dictates location and design of a
canopy.
4) Lot size and topography requires a variance to allow for any
modification.
S) Most gasoline stations have canopies, provides safety for
patrons.
Based upon the findings and conclusion satforth above, the Zoning
Board of Adjustment hereby grants the applicant's request to
construct a 30' x 55'94h
