HomeMy WebLinkAboutVR-95-0000 - Decision - 0003 Patrick StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 14th day of August 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding the variance application of Harry Lindberg, 3 Patrick Street. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findinqs of Fact 1) The area in question is zoned R-4 District. 2) Section 25.00 of the Zoning by-laws requires a minimum side yard of 10 feet. 3) The property is developed with a single family dwelling with an attached 14'x 22' garage. 4) The lot contains 11,250 square feet with 75 foot of frontage. 5) The appellant is requesting a 10'x 22' addition to the existing garage resulting in a side yard of 5 feet. Conclusion 1) The appellant is attempting to save trees located within the rear yard. Trees prevent the extension of the garage to the rear portion of the lot. 2) The narrowness of the lot limits the use and prevents construction of a two car garage without some relief. 3) A five (5) foot side yard does not change character of neighborhood. Property located across the street has a 5 foot side yard. 4) No opposition, nearest neighbor supports the appellant's request for a variance. 5) Narrow lot set off in the 1950's, pre -dates adoption of existing zoning by-laws. 6) Request for a two car garage is not unreasonable and represents a minimum variance. IIF Based upon the findings and conclusion set -forth above, the Zoning Shard of Adjustment hereby grants the applicants request to construct a 10'x 22' addition to an existing 14'x 22' garage, located at 3 Patrick Ar h&M-MV, South Burlington Zoning Board of Adjustment AUG 2 8 1995
