HomeMy WebLinkAboutCU-96-0000 - Decision - 3017 Williston Road0 STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 8th day of January 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of Harold Brown, 3017 Williston Road. Also attending this meeting were Mrs, Harold Brown and Lee Diamond. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: 1) The area in question is zoned I-C District. 2) Section 15.20 Conditional uses requires approval by the Board of Adjustment in accordance with Section 26.05. 3) Proposed use a music rehearsal studio will occupy 2500 square feet which is the house portion. Q'IS-0d po- 4) The animal hospital and kennels (approximately square feet) will not be occupied. 5) The prior use dog day care no longer occupies the property. 6) The property contains 5.4 acres. Conclusion 1) space for band rehearsal is not available. Residential areas are not suited for proposed use. 2) Nearest residential structure is located approximately 700 feet from animal hospital. 3) Rehearsal rooms will be insulated for sound and air conditioners will be installed during summer months. 4) Traffic generated by proposed use is projected lower than prior uses. 5) Noise ordinance will regulate any excessive noises. 6) Evening hours of operation 7:00 P.M. to 11:00 P.M. 1 Based upon the findings and conclusion set -forth above, the Zoning Board of adjustment he grants the applicants request to operate a music rehear a 30 9vare feet) located at 3017 Williston Road. -- Chairman, South Burlington Zoning Board of Adjustment ,BAN 2 2'996
