DECISION AND FINDING OF FACT
On the 23rd day of October 1995 the South Burlington Zoning Board
of Adjustment heard testimony regarding a variance application of
Bernard Coui,llard, Jr., d.b.a. Bernie's Auto Sales, 1150
Williston Road, this meeting also was attended by Attorney Carl
Lisman and Dan Couillard.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for
this application, the Zoning Board finds, concludes, and decides
as follows:
Findings of Fact
1) Area zoned Commercial I District.
2) Section 26.00 Non -conforming uses, automobile sales and
service not a permitted use.
3) Section 26.65 Multiple uses, a dual use is being proposed
41 (automobile repairs). Uses are not permitted within
Commercial I District. Uses are conditional within
Commercial II District.
4) A similar variance was granted in September 1985, variance
has since expired.
5) Lot contains .96 acres with 121 feet of frontage.
Conclusion
1) Automobile dealership has operated from the site since 1958.
2) Proposed use is a minor deviation from existing use. Auto
repairs on site as part of automobile sales.
3) Non -conforming of property will not change, proposed use
will not affect the general character.
4) Variance granted in 1985 for a similar type use.
5) Hardship pre -dates the present zoning by-laws.
Based upon the findings and conclusion set -forth above, the
Zoning Sward of Adjustment hereby grants the applicants request

to operate an windshield repair and replacement lousiness in
conjunction with automobi S es, 10 ated at 1150 Williston
Road.
