DECISION AND FINDING OF FACT
On the 14th day of April, 1997, the South Burlington Zoning Board of Adjustment
heard testimony of Karl Benware regarding a variance application located at
McDonald's Restaurant, 1205 Williston Road.
Based upon the testimony provided at the above mentioned public hearing and the
documents submitted to the Zoning Board of Adjustment which are contained within
the "document file" for this application, the Zoning Board finds, concludes, and
decides as follows:
FindinLrs of Fact
1) The area in question zoned C,I District.
2) Section 25.00 Dimensional requirements. Minimum rear yard thirty (30) feet
and side yard fifteen (15) feet.
3) Proposed structure 201x 20' storage shed to replace existing enclosed
dumpster area.
4) proposed setback five (5) feet to rear yard and three (3) feet to westerly side
yard.
Conclusion
1) Proposed structure is required due to increase of rodents, sea gulls and
people picking through the dumpsters .
2) Hardship is a health and safety issue for employees and general public.
3) The proposed storage shed is basically the same size of the enclosed dumpster
area.
4) Due to the irregularity of the lot, dumpster area cannot be located elsewhere.
5) The proposed accessory building will actually enhance the area and clean up
the appearance.
Based upon the findings and conclusion setforth above, the Zoning Board. of
Adjustment hereby gra s the applicant's request to construct a 20'x 20' storage
shed, located at McDona 's Restaurant, f4205 Williston Road.
