SITE PLAN APPLICATION #SP-16-28
FINDINGS OF FACT AND DECISION
Blackbay Ventures VIII, LLC, hereafter referred to as the applicant, is seeking after -the -fact
approval to amend a previously approved plan for four (4) 3-unit multi -family dwellings. The
amendment consists of: 1) adding two (2) utility cabinets, 2) replacing pole mounted light
fixtures with bollard lights, and 3) adding landscaping to screen the new utility cabinets, 505,
507, 509, & 511 Market Street.
Based on the plans and supporting materials contained in the document file for this application,
the Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. Blackbay Ventures VIII, LLC, hereafter referred to as the applicant, is seeking after -the -fact
approval to amend a previously approved plan for four (4) 3-unit multi -family dwellings. The
amendment consists of: 1) adding two (2) utility cabinets, 2) replacing pole mounted light
fixtures with bollard lights, and 3) adding landscaping to screen the new utility cabinets,
505, 507, 509, & 511 Market Street.
2. The owner of record of the subject property is Blackbay Ventures VIII, LLC.
3. The application was received on May 6, 2016.
4. The subject property is located in the Form Based Code T-3 Zoning District.
5. The plan submitted consists of a three (3) page plan set, page one (1) is entitled "12 Unit
Housing Project 135 Hinesburg Road South Burlington Vermont 05403 Proposed Conditions Site
P/an"prepared by Civil Engineering Associates, Inc, dated 3/26/14 and last revised 4/11/16.
6. The purpose of this application is to make minor site modifications.
DIMENSIONAL REQUIREMENTS
7. There are no dimensional changes associated with this application.
Form Based Code Requirements
8. This project will alter the site of four (4) conforming structures in the FBC by adding two
(2) utility cabinets, adding shrubs and replacing previously approved pole lights with
bollard lights.

Only the standards below will are affected by the application. All other standards will be
continue to be met.
Landscaping
9. The only landscaping changes associated with this application involves adding four (4)
evergreen shrubs to an area which currently has approval for four (4) evergreen shrubs for
a total of eight (8) shrubs screening the cabinet labeled as "area 2" on the site plan.
10. Pursuant to Section 13.06(B) (7) of the Land Development Regulations, snow storage areas
must be shown on the plan. The plan does indicate the snow storage area(s).
Outdoor Lighting
11. The lighting changes involve the replacement of previously approved pole mounted
fixtures with eight (8) bollard lights 42" in height. The lighting plan should be revised to
show the location of each bollard light.
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site plan
application #SP-16-28 of Blackbay Ventures VIII, LLC, subject to the following conditions:
1. All previous approvals and stipulations shall remain in full effect except as amended herein.
2. This project shall be completed as shown on the plat submitted by the applicant and on file
in the South Burlington Department of Planning and Zoning.
3. The plan shall be revised to show the changes below and shall require approval of the
Administrative Officer. Three (3) copies of the approved revised plan shall be submitted to
the Administrative Officer prior to permit issuance.
a. The lighting plan must be revised to show the locations of the eight (8) bollard
lights.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04
of the Land Development Regulations or this approval is null and void.
5. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer
a final set of project plans as approved in digital (PDF) format.
6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to
the use of the buildings.
7. Any change to the site plan shall require approval by the South Burlington Development
Review Board or the Administrative Officer.

Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of
this decision.
