MEMORANDUM

RE: CITY OF SOUTH BURLINGTON — LEACHATE TREATMENT
FACILITY
8, 9, 10) This project consists of constructing a leachate treatment facility at the
City's closed landfill site. This facility consists of: 1) a 14' x 14' mechanical control
building, 2) a leachate pretreatment tank, and 3) four (4) filter beds.
This property located at 1015 Airport Parkway lies within the Municipal and the
Interstate Highway Overlay Districts.
ARIANCE CRITERIA
Section 10.04 (D) (3) of the Land Development Regulations limits encroachments of
municipal buildings to no more than 15 feet into the Interstate Highway Overlay
District (I H O) Filter bed # 1 will encroach the greatest amount (approximately 145
feet) into the IHO District while only a portion of the pretreatment tank will encroach
into the IHO District. This facility is being located at this particular site due to
engineering considerations.
In order for the Board to grant the variance, it must find that all five (5) of the
following criteria under Section 24 VSA 4468 are being met:
That there are unique physical circumstances or conditions, including
irregularity, narrowness, or shallowness of lot size or shape, or exceptional
topographical or other physical conditions peculiar property, and that
unnecessary hardship is due to such conditions, and not the circumstances
or conditions generally created by the provisions of the zoning regulation in
the neighborhood or district in which the property is located.
The variance from the South Burlington Land Development Regulations is
necessary because of pre-existing physical characteristics of the site. First,
the pre-existing groundwater flow under the landfill is from east to west. Any
extraction of the groundwater must occur along the western perimeter at the
toe of the slope. Second, the pre-existing landfill dates back to the 1940s,
including trash buried deep along the western perimeter. The existing trash
cannot be moved. Third, the filter beds must be located over native soils,

down gradient of any trash. The only area is along the western perimeter of
the site, Forth, the soil cap of the landfill along the western perimeter is
thicker than other areas, and could support a small control building and
aeration tank.
2. That because of such physical circumstances or conditions, there is no
possibility that the property can be developed in strict conformity with the
provisions of the zoning regulation and that the authorization of a variance is
therefore necessary to enable the reasonable use of the property.
The leachate collection system must be located down gradient of the pre-
existing landfill in order to collect the contaminated groundwater. As
discussed above, the only area is along the western property line, within the
setback area.
The filter beds must be located down gradient of the trash in the landfill and
over native soils so that the treated water does not become recontaminated
before discharge to the groundwater below the landfill. As discussed above,
the only area meeting such conditions is along the western property line,
within the setback area.
The aeration tank and control building must be located in close proximity to
the extraction wells and filter beds to allow for efficient pumping and treating
of up to 60,000 gallons per day. The tank and building can be located over
trash, as long as the soil cap is thick enough to support the weight. As
discussed above, the only portion of the soil cap which is in proximity and
thick enough to carry the loads is along the western perimeter of the landfill.
3) That the unnecessary hardship has not been created by the appellant;
The landfill and the placement of trash predates the current ordinance and
these variance criteria. At the time the trash was placed in the landfill, the
City had no anticipation of needing to treat the groundwater, which otherwise
flows to the Winooski River. The State of Vermont has ordered the treatment
of the landfill leachate, leading to the current need to place the treatment
facility near the western perimeter of the landfill. The hardship was not
created by the City.
4) That the variance, if authorized, will not alter the essential character of the
neighborhood or district in which the property is located, substantially or
permanently impair the appropriate use or development of adjacent property,
reduce access to renewable energy resources, nor be determined to the
public welfare.

The site is located in the Municipal District, where public facilities were
anticipated. The western perimeter of the site borders the interstate highway
and lands of the State of Vermont. No private lands or other zoning districts
are affected.
The extraction wells, filter beds, aeration tank, and control building will not be
visible by motorists on Interstate 89 or on Patchen Road. The site is below
the highway and there is significant wooded area, including evergreen trees,
which will block any view, even from the northern end of the bridge of the
Winooski River.
5) That the variance, if authorized, will represent the minimum variance that will
afford relief and will represent the least deviation possible from the zoning
regulation and from the plan.
The treatment system has been sized to treat 20,000 to 60,000 gallons per
day of contaminated groundwater. This is estimated flow rate from under the
landfill. The filter beds need to large enough to allow an application rate of 4
gallons per day per square foot.
Staff recommends granting the variance.
CONDITIONAL USE CRITERIA
The proposed conditional use must meet the following standards:
1. The proposed use, in its location and operation, shall be consistent with the
planned character of the area as defined by the City of South Burlington
Comprehensive Plan.
The Comprehensive Plan's Future Land Use Map designates the area where
the leachate treatment facility is proposed as "Public & Quasi -Public,
Recreation, Conservation & Open Space". The proposed use is consistent
with this designation.
2. The proposed use shall conform to the stated purpose of the district in which
the proposed use is to be located.
The stated purpose of the Municipal District under Section 7.03 (A) of the
Land Development Regulations is as follows:

"A Municipal District is hereby formed to provide for public schools, municipal
services including by not limited to administration, police, fire, water, street,
and sewer services, landfills, operations of other municipal corporations as set
forth in 24 VSA (municipal corporations such as CSWD), and other municipal
uses, excluding public recreation."
The proposed use conforms to the stated purpose.
3) The proposed use shall not adversely affect:
a. The capacity of existing or planned municipal or educational facilities.
No adverse affect expected.
b. The essential character of the neighborhood or district in which the
property is located, or the ability to develop adjacent property for
appropriate uses.
The neighborhood consists of the I-89 highway, the former landfill site and
other municipal buildings including a sewage treatment facility, public works
department buildings, and a hazardous waste collection facility. This
neighborhood will not be adversely affected by the proposed use.
c. Traffic on roads and highways in the vicinity.
Traffic generated by this facility will be minimal and will consist of occasional
maintenance vehicles. No adverse affect is therefore expected.
d. Bylaws in effect.
The proposed use will be in compliance with the bylaws upon granting of a
variance.
e. Utilization of renewable energy resources.
There is no utilization of renewable energy resources in the vicinity to be
adversely effect by the proposed use.
f. General public health and welfare.
The proposed use will benefit the general public health and welfare by treating
leachate, which is currently seeping from the former landfill site untreated.
No adverse affect is therefore expected.

INTERSTATE HIGHWAY OVERLAY DISTRICT CRITERIA
The Board must find that the proposed municipal facility meet the following
standards and criteria pursuant to Section 10.04 (D) of the Land Development
Regulations:
1. Accessory uses not directly related and essential to the functioning of the
municipal building shall not be permitted with the IHO district.
The proposed use is directly related to the former landfill site and is essential
in treating leachate coming from the landfill.
2. A finding is made by the Development Review Board that the proposed
municipal building cannot be located outside the IHO district because the
following criteria are met:
a. The use must occur in close proximity to another pre-existing
municipal building; AND
b. There is no reasonably practicable alternative location for the
municipal building, with pre-existing investment in the site a
consideration for the practicability of alternative locations; AND
c. The encroachment is the minimum necessary to operate the
proposed municipal building.
The proposed leachate treatment facility is located approximately 240 feet
from the nearest pre-existing municipal building. There is no reasonable
practicable alternative location for this facility given the engineering
considerations.
This encroachment is the minimum necessary to operate the treatment

3) The maximum extent of the encroachment shall be no more than fifteen (15)
feet into the IHO district.
This criteria is superseded by the granting of the variance.
SITE PLAN REVIEW CRITERIA
Access/Circulation: Access is provided via an existing curb cut on Airport Parkway,
which serves the Airport Parkway Wastewater Treatment Facility and the CSWD
Hazardous Waste Collection Facility.

An existing access road will provide access to the leachate treatment facility site.
Circulation on the site is adequate.
Coverage/Setbacks: Building coverage is 1.7% (maximum allowed is 30%). Overall
coverage is 24.2% (maximum allowed is 70%). Front yard coverage is 5.8%
(maximum allowed is 30%).
Setback requirements are not being met. This issue is being resolved with the
granting of the variance to allow encroachment into the IHO District.
Parking: One (1) parking space required and one (1) space is being provided.
Landscaping: No landscaping proposed and no additional landscaping is
recommended. Site is well screened from the interstate by existing vegetation.
Lighting: Proposed exterior lighting on the building will consist of a 175-watt metal
halide lamp with a downcasting-shielded fixture.

Addendum to Variance Request
Provisions of Zoning Ordinance in Question:
1) Municipal District requires 15 foot side yards and 40 foot front yards.
Filter beds with concrete block walls are located within 5 feet of interstate
property line and are non -complying.
2) Interstate Highway Overlay District extends back 150 feet but only
allows encroachment of municipal structures by 15 feet (ie., 135 foot
setback). Filter beds, aeration tank, and control buiding all located with
135 feet of property line and are non -complying.

Standards for Granting a Variance
24 VSA Section 4468
South Burlington Landfill Leachate Treatment Facility
(1) That there are unique physical circumstances or conditions, including irregularity,
narrowness, or shallowness of lot size or shape, or exceptional topographical or other
physical conditions peculiar to the particular property, and that unnecessary hardship
is due to such conditions, and not the circumstances or conditions generally created
by the provisions of the zoning regulation in the neighborhood or district in which the
property is located;
The variance from the South Burlington zoning ordinance is necessary
because of pre-existing physical characteristics of the site. First, the pre-
existing groundwater flow under the landfill is from east to west. Any
extraction of the groundwater must occur along the western perimeter at the
toe of the slope. Second, the pre-existing landfill dates back to the 1940s,
including trash buried deep along the western perimeter. The existing trash
can not be moved. Third, the filter beds must be located over native soils,
downgradient of any trash. The only area is along the western perimeter of
the site. Forth, the soil cap of the landfill along the western perimeter is
thicker than other areas, and could support a small control building and
aeration tank.
(2) That because of such physical circumstances or conditions, there is no possibility that
the property can be developed in strict conformity with the provisions of the zoning
regulation and that the authorization of a variance is therefore necessary to enable the
reasonable use of the property;
The leachate collection system must be located downgradient of the pre-
existing landfill in order to collect the contaminated groundwater. As
discussed above, the only area is along the western property line, within the
setback area.
The filter beds must be located downgradient of the trash in the landfill and
over native soils so that the treated water does not become recontaminated
before discharge to the groundwater below the landfill. As discussed above,
the only area meeting such conditions is along the western property line,
within the setback area.
The aeration tank and control building must be located in close proximity to
the extraction wells and filter beds to allow for efficient pumping and
treating of up to 60,000 gallons per day. The tank and building can be
located over trash, as long as the soil cap is thick enough to support the
weight. As discussed above, the only portion of the soil cap which is in
proximity and thick enough to carry the loads is along the western perimeter
of the landfill.
(3) That the unnecessary hardship has not been created by the appellant;
The landfill and the placement of trash predates the current ordinance and
these variance criteria. At the time the trash was placed in the landfill, the
city had no anticipation of needing to treat the groundwater, which otherwise
flows to the Winooski River. The State of Vermont has ordered the
treatment of the landfill leachate, leading to the current need to place the
treatment facility near the western perimeter of the landfill. The hardship
was not created by the City.
(4) That the variance, if authorized, will not alter the essential character of the
neighborhood or district in which the property is located, substantially or permanently
impair the appropriate use or development of adjacent property, reduce access to
renewable energy resources, nor be detrimental to the public welfare; and
The site is located in the municipal district, where public facilities were
anticipated. The western perimeter of the site borders the interstate highway
and lands of the State of Vermont. No private lands or other zoning districts
are affected.
The extraction wells, filter beds, aeration tank, and control building will not
be visible by motorists on Interstate 89 or on Patchen Road. The site is below
the highway and there is significant wooded area, including evergreen trees,
which will block any view, even from the northern end of the bridge of the
Winooski River.
(5) That the variance, if authorized, will represent the minimum variance that will afford
relief and will represent the least deviation possible from the zoning regulation and
from the plan.
The treatment system has been sized to treat 20,000 to 60,000 gallons per day
of contaminated groundwater. This is the estimated flow rate from under
the landfill. The filter beds need to large enough to allow an application rate
of 4 gallons per day per square foot.
