STATE OF VERMONT
COUNTY OF CHITTENAEN
CITY OF SOUTH BURLINGTON
17EPISTON& FILMING OF FACT
On the 14th day of May 1990, the South Burlington Zoning Board of
Adjustment heard evidence regarding the appeal of University of
Vermont, Mr. Robert Penniman, 860 Williston Road on the following
facts and findings:
1) Based on the -traffic study prepared by Resource Systems Group
of Norwich, Vermont and reviewed by the Chittenden County region-
al Commission the Hoard finds that criteria C (traffic on roads
and highways in the vicinity) should have a minimum affect.
2) This proposal does not affect the general character of the
area, a similar project is proposed and approved by the City of
Burlington on an adjoining East Avenue parcel.
3) This proposal should have no impact on existing or planned
municipal or educational facilities.
4) All by-laws in effect are in compliance.
Stipulations:
1. That approval for a second left turn lane exiting the Shera-
ton be obtained by U.V.M. so that a second left turn lane
may be constructed at a time when transportation studies
and/or traffic operational characteristics show that is
necessary.
2. That the dual left turn lane when constructed be done in
such a way so as not to conflict with left turns exiting the
Gaynes driveway.
3. That U.V.M. provide access to existing parking lots
currently owned by the Sheraton via the newly constructed
roadway.
4. That the roadway be signed for "No Through Traffic".
5. That if the Sheraton or the City of South Burlington feel
that through traffic becomes a problem on the new roadway,
that the University conduct a study in order to determine
the amount of through traffic using the roadway. If neces-
sary, U.V.M. would then be responsible for controlling
through traffic - possibly with a security officer or gate.
h
6. That the signal ,installation at East Avenue/Carrigan Drive,
as well as restriping of the existing intersection approach-
es, be completed by'U.V.M. before the new parking lots are
open.
Based upon the above stated -)facts pnd findings the appellant's
request for a Conditional us s e proved.
