HomeMy WebLinkAboutSP-97-0000 - Decision - 0080 Farrell StreetFINDINGS OF FACT & DECISION STATE OF VERMONT D COUNTY OF CHITTENDEN 5'p-� �7- 000 CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Twin Oaks Sports & Fitness to amend a previously approved site plan for an 11,000 square foot building for day care/indoor recreation use. The amendment consists of: 1) relocating the outside playground from the rear of the building to the front of the building, and 2) relocating a parking area from the front of the building to the rear of the building, 80 Farrell Street. On the 12th day of August, 1997, the South Burlington Planning Commission approved the request of Twin Oaks Sports & Fitness for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a site plan previously approved on 9/12/95 for an 11,000 square foot building for day care/indoor recreation use. The amendment consists of: 1) relocating the outside playground from the rear of the building to the front of the building, and 2) relocating a parking area from the front of the building to the rear of the building. 2. This property located at 80 Farrell Street lies within the C2 District. It is bounded on the north by a single family residence and Rice High School, on the east by a vacant lot, on the south by Joy Drive and on the west by Farrell Street. 3. Access/circulation: Access is provided by two (2) curb cuts on Joy Drive. The westerly curb cut is 26 feet in width and the westerly curb cut is 28 feet. No changes proposed. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 12.3% (maximum allowed is 300). Overall coverage is 42.3% (maximum allowed is 70%) . Front yard coverage along Farrell Street is 22% and along Joy Drive is 59.8% (maximum allowed is 30%) . Front yard coverage along Joy Drive is existing and will not be made worse by this application. 5. Setback requirements are not met. The building does not meet the front setback from Joy Drive and the 65 foot setback from a residential district. This is a noncomplying structure subject to Section 26.002 of the zoning regulations. 6. Landscaping: No additional landscaping required. Two (2) trees will be planted to replace the two (2) trees removed to install the playground area. 7. Parking: One (1) parking space will be added for a total of 30 spaces available. 8. Sewer: No additional allocation needed. 9. Traffic: No additional traffic expected. 10. Lighting: No changes. 11. Dumpster: A screened dumpster storage area will be provided at the rear of the building. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Twin Oaks Sports & Fitness to amend a previously approved site plan for an 11,000 square foot building for day care/indoor recreation use. The amendment consists of: 1) relocating the outside playground from the rear of the building to the front of the building, and 2) relocating a parking area from the front of the building to the rear of the building, 80 Farrell Street as depicted on a plan entitled "Kids & Fitness Twin Oaks 80 Farrell Street S . Burlington Vermont," prepared by Smith Alvarez Sienkiewycz Architects, dated 7/7/94, last revised 8 / 1 / 97 , with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the playground and parking relocation will generate zero (0) additional vehicle trip ends during the P . M . peak hour. 3. Any new exterior lighting or changes to existing exterior lighting shall consist of downcasting shielded fixtures. Any change to existing lights shall require approval of the City Planner prior to installation. 4. Prior to issuance of a zoning permit, the applicant shall post a $535 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 6. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the relocated playground and parking areas. 7.
