Request for a conditional use approval,
80 Farrell Street
Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on August 24, 1998 by
application of Burlington Indoor Tennis Center, Inc., Daryl Campbell agent, for a conditional use approval
to increase occupancy of existing day care center to a maximum of 75 children in conjunction with an
existing sports/fitness center, located at 80 Farrell Street according to plans submitted. This application
was represented by Wolfgang Liebman. The Board of Adjustment finds as follows:
1) The area in question is zoned Commercial II District, Section 26.05 conditional uses sub -section
26.056 requires approval to expand any conditional use.
2) Zoning Board of Adjustment granted conditional use approval on August 28, 1995 to operate a day
care center for a maximum of 59 children.
3) The applicant is requesting to increase occupancy to a maximum of 75 children.
4) No change is use or in the footprint of the building.
5) Agency of Natural Resources and Environmental Board has reviewed this project, no amendments
to permit #WW-4-0756 are required.
6) Certificate of Occupancy to increase occupancy from 59-75 has been granted by the Department of
Labor Industry, Fire Prevention Division.
7) City staff have calculated the impact fee based on a overall increase of 7.8 additional vehicle trip
ends during the peak hour.
8) State Fire Marshall Robert Patterson regulates maximum load capacity based on a ratio of 35
square feet of floor area per children. Building in question contains 11,500 square feet of usable
floor area.
9) Character of the area is not affected by this proposal.
10) No additional water or sewer allocation is required.
Stipulations:
That the applicant furnish information as to the required square footage per child under the S.R.S.
guidelines and that he provide a traffic study that state the P.M. peak hour traffic counts will not exceed the
eight projected for the additional children and two employees.
