I am sorry that the construction of the paddle courts was started before obtaining a variance from the Board. Nay actions were not meant to be deliberatly in contz,st to the Boards wishes or the law. I first began construction on the paddle courts in May. Unfortunately I assumed that because the paddle courts had been there ( Lakeside ) before I did not need a new variance. It was not until I contacted the power company to install a meter Il trf� did I find out that I would,`a permit. It was at this time that I first contacted you about the need for a variance. I did not bring up the subject of construction prior to approval because I thought it would hinder my chance of obtaining the variance. After our initial meeting I decided it was best tgstop construction. The people helping me had to find other jobs. The only work done for two weeks was some painting to protect the wood. Last week I decided to start construction again by putting on the decking. P: 8 0 8 6 3- 2 2,, NEW BUSINESS F: 802-863.000 3 Reviewed South Burlington Zoning Regulations as they pertain to expansion of the Twin Oaks Farrel Street Facility. 2.1 SITE PLAN REVIEW Site plan review is conducted by the South Burlington Planning Commission at their twice monthly meeting. The Planning Commission is currently scheduling for the December 10 and 17 meetings. Required for submission are a completed application form, $50.00 fee, 5 full size copies of site plan, and one 11'3�ite plan. 2.2 MULTIPLE USE C U1 If the project involves multiple uses (i.e. recreational facility and professional offices) a conditional use permit will be required from the zoning board of adjustment. Required for submission are a completed application form, a $50.00 application fee, and 8 full size copies of the site plan. 2.3 SEWER ALLOCATION The South Burlington sew r system has limited capacity (10,000 gallons available at this time). rewery is currently in the planning stages which will use up this capacity. If the facility is on the South Burlington sewer system the conditional use permit,�pplication should be made ASAP in order to get ahead of the brewery project. The brewery is slated for 4te plan check on November 26. \ �v will follow. EREN A`"V:{KEZ 24 PARKING M.A R T Y S I E N K I E W Y C Z The zoning regulations require 1 parking space per 125 gross square feet for health clubs and 1 space per 250 gross square feet for offices. There is no specific requirement in the zoning regulations that the parking be on site. The STEPHEN SMITH III planning commission has the option to waive or modify up to 50% of the Meeting Minutes #2 Twin Oaks Farrell St. Addition October 29, 1996 - Page 2 parking requirement if sufficient evidence is presented to warrant such a reduction. RB suggested that the owner conduct a parking analysis to determine the car count and number of building users at peak hours on peak days. The analysis may be done in-house and the data should be presented to the zoning department two weeks prior to the Site Plan Review meeting. RB noted that the Kids and Fitness building received a parking waiver. Existing and proposed handicap parking spaces should be shown on the site plan. 2.5 LANDSCAPING Landscaping in required as a percentage of the construction budget per the Zoning Regulations. 2.6 BIKE RACK A bike rack will be required per Article 26.253b. 2.7 EXTERIOR LIGHTING Site Plan Review submittal should include information on type and location of existing and proposed exterior lighting. Exterior lighting may not cast a glare beyond the property line. Maximum height for pole lights is 20' . 2.8 TRAFFIC IMPACT FEE A one time fee is charged based on the traffic impact of the proposed expansion. 2.9 VARIANCES Variances are heard and granted or denied by the Zoning Board of Adjustment. In order for a variance to be granted all five of the criteria set forth by the state for granting variances must be met. The presentation requirements and criteria are attached. Mrs. Lafleur advised that the proposed use is permitted in the C-2 zone. Mr. Bergh said they plan to keep 3 of the tennis courts. They will expand the men's and women's locker rooms. The building has not been used for several years. The parking lot will be ex- panded to 92 spaces. They expect 80-85 cars in busy times. This facility will not have the indoor tennis facilities that Twin Oaks has. They anticipate that Champlain College will bus students down to use the basketball facilities. Mrs. Lafleur noted that the Fire Chief feels the turning radius in the parking lot is too small and would like to remove a few parking spaces. Mr. Bergh said they would prefer not to, but if it's a condition of approval they will abide by it. Members felt reserving 2 spaces for future use, if needed, would be advisable. They also discovered that the road that has always been proposed would require 9 ft. of blasting for a major ledge, and they don't want to have to do this. They are thus asking for a blanket 20 ft. setback from the normal 60 ft. right of way. They have changed to more condos and fewer single family homes. There will be 6 off- street parking spaces for each building, with 4 units per building (condos). Each unit has an enclosed garage, so there are 10 total spaces for four unit building, including the garages.' There will be 20 feet of woods between backyards of the single family homes. Mr. Burgess raised the question of counting spaces behind garages as guest parking. Mr. Hausner said there is room for on -street parking as wel. Mrs. Lafleur noted this would not include over- night parking, but that's the same as everywhere else in the city. Mr. Hausner said they will have a small sales building on the lot and this will be turned over to the development later for use as a community building. Mr. Marcellino said there will be a master association and a covenant will prohibit storage of recreational vehicles. He felt the whole community shouldn't have to pay for the 10% who have these vehicles. All roads will be city standard with sidewalks on one side. A typical single family lot would be 62 ft. wide, 115 ft. deep plus 10 feet of treed buffer. Each house will have a 2-car garage. Back yards will be about 50' x 60'. They did not feel the street- scape would suffer from 20 ft. setbacks and this would allow greater back yard space. Mr. Bergh, based on his experience with Twin Oaks should know if sufficient parking is available. 3) Village at Dorset Park 1. I would prefer a stone lined ditch instead of the ponds which will only be swamps with mosquitoes and bug problems. 2. I question the adequacy of off-street parking for the multi- family units. There should also be a place for boat trailers, etc. Extra width driveway to provide parking in front of the units would create problems for snow removal and take a lot of frontage space which should be landscaped. 4) Rozzi Subdivision 1) Creating spaghetti lots should be avoided. 2) There should be a single entrance. The 20 foot easement enlarges the road opening considerably. 3) If this subdivision is approved, the utilities, water and sewer should be separated. 5) Cupola Golf Course Subdivision 1) When Horizon Heights was approved, it was stipulated that further development of the parcel will require the street to be upgraded and become a public street. This upgrading shall be to City standards. Reason for Request In order to exist as a recreational center for the community, Lake- side Tennis must be able to offer tennis on a year-round basis. This is true for two reasons: 1. Risinq Costs The accelerated increase in the cost of operations, particularly in utility and service bills, no longer permits a facility to operate solely in the winter and remain financially sound. The summer revenue is needed to meet year-round costs. 2. Competition The other indoor tennis facility in the area offers out- door tennis. During the summer Lakeside's membership is drawn to the other facility, and then stays to sign up for the winter. Thus the lack of summer facilities affects not only summer but winter membership revenue in a negative manner. Lakeside Tennis cannot remain financially viable under these combined conditions of reduced income and increased costs. Satisfaction of Conditional Use Requirements It is felt that this request satisfies the requirements of Conditional Use Approval for the following reasons: 75 Farrell Road • South Burlington, Vermont 05401 • (802) 863-5515 -2- 1. The capacity of existing or planned facilities is not impaired. Since the outdoor courts will be used when the indoor courts are not used (summer) there will be no pressure on the facility's capaicty to handle the members. 2. The character of the neighborhood is not impaired. The courts fit in well with the character of the neighbor- hood. In addition to the indoor courts, there are two outdoor paddle courts presently on site. Across the road is the Court Club (racquetball). Together these facilities create a mini - recreation center for the neighborhood. The tennis courts do not create a visual mass, as would an enclosed structure, and thus do not create any increase in visual density. 3. Traffic No increase in traffic is expected. Since the four courts replace an activity carried on by six courts in the winter, it is expected that traffic would actually decrease. The facility is located on a back road that is not highly travelled. 4. Public Welfare not impaired. It is felt that the public welfare will be benefitted through the availability of these recreational facilities. Benefits created by the Courts 1. Recreational amenity for the neighborhood. The courts provide a healthy recreational amenity for the neighborhood and the surrounding community. The outdoor courts will provide a summer pastime presently not available to the community. 2. Attractive land use. The courts are felt to be aesthetically attractive, and to the extent visible from a residential area, create a use "buffer" from the more institutionalized commercial uses in the rest of the shopping center. - 3 - Other Aspects of the Court Installation I. Aesthetics The Courts will be surrounded by a cedar wood post fencing, an attractive fencing material. The stark and institutionalized chain link fence material will not be used. The courts are so sited that an existing "buffer" of foliage and trees will remain between the courts and two residential houses located in the northern property lines. The courts blend as a buffer between "heavy" commercial use and residential use, where people often have their own outdoor courts on their property. 2. Parking It is felt no additional parking will be needed, as the outdoor courts will be utilized at those times (summer, daytime) when the indoor courts will not be used. The outdoor courts are fewer in number (4) than the present indoor courts (6) whose parking adequately provides for it. If additional parking were ever to be needed, the present design allows room for the addition of additional parking. 3. Engineering Since the Courts will be made of fast -dry har-true, the Courts will not affect water run-off in any way. The Courts are designed to allow rain water to soak through (the har-tru is a highly permeable material) rather than off them, which would be the case if the Courts were made of asphalt.
