ParrelRoad would include twenty white pine trees, four to six feet in height. These trees would be planted in two rows of ten trees each and would extend approximately ten feet beyond the end of the east and west side of the paddle courts. Cost of the trees, tax, labor and materials would be $530.20 as submitted in the planting contract by Gardenside Nurseries, Inc. of Shelburne, Vermont. This proposal has appeared before the Zoning Board of Adjustment on May 19, 1975. Zoning Board approved the proposal under the Conditional use provisions of Section 8.10 - Outside storage received a stipulation that no building materials be stacked higher than 8 feet and the easterly property line be landscaped. The answer to this question turns upon the time limits provided in Title 24, V.S.A. §4467. This section provides that the Board shall set a date and place for a public hearing, which shall be within 60 days of the filing of the notice of appeal. The Board is also mandated to give public notice of the hearing and to mail to the appellant a copy of the notice at least 15 days prior to the hearing date. These time limits lead to the conclusion that the Board should only consider the tabling or delay of the pend- ing appeal if, after such delay, it can give the required 15 days notice to the applicant and the public notice and still comply with the 60-day provision in the first sentence of this section. While it is arguable that an appellant who requests the delay should not be able to benefit from the delay in terms of claim- ing a procedural irregularity based upon the time limits in- volved, the safest course would be for the Board to go ahead and hear the appeal, even though there has been a request to table, if the request to table would bring the Board outside of the 60-day limit. The terms of the above section contemplate that a hearing can take place even though the appellant is not there. The section states in part, "Any person or body empowered by Section 4464 of this title to take an appeal with respect to that property at issue may appear and be heard in person or be repre- sented by agent or attorney at such hearing." The inability of the appellant to appear does not preclude his appearance by his agent or his attorney. EWING & SPOKES Richard R. PLANNING COMMISSION SEPTEMBER 25, 1984 posted. The plan shows $1600-$1800 worth of landscaping, and Mr. Wallman wants credit for the balance of the amount for what eiists on the site. Mr. Poger felt the city should have someone take a look at the area and determine the value of what is there. Ms. Bechtel also wondered if there was enough landscaping shown on the plan. Mr. Wallman admitted that it was deficient and said he would like to add more trees. Mrs. Maher moved to continue this item until two weeks from tonight, at 7:30 pm at City Ball. Mr. Jacob seconded the motion and all voted for it. Final plat application of RDR Enterprises for a 3 lot -;subdivision located at Kimball Avenue Mr. Mark Lawdon represented RDR. He said all stipulations from preliminary plat had been met. The line showing the Kimball Avenue right of way needs to be corrected on the plan, as does the location of the 24" CWD water main. The 60' right of way to Dr. Brown's property will be shown between lots 1 and 2 and the correct water and sewer lines will be put on the plan. Site plan application, Burlington International Airport for a 25,700 sq. ft. addition to the terminal and associated site work, Airport Drive Mr. James Lamphere said they would like to make a two-story expansion of the existing terminal building. They will also be purchasing the Lavalette land. The fuel farm will be moved and site work will be done in the car rental parking area. Three jetways will be added, plus a large departure lounge. Mr. Lamphere said the Master Plan for the airport showed major expansion from 1983-1984. He felt the major growth had already occurred and that things would now level off. Dr. Oppenlander has done a traffic analysis and concluded that the present access will be adequate through 1995. Mr. Lamphere noted that the terminal parking area had been expanded. When it reaches capacity, shuttle buses run between the terminal and other parking areas around the airport. At a future site plan review any structures built on the Tilley lot should be set back to provide for an interchange. Pond Location: Bill Szymanski agrees with the applicant that the pond should not present a problem to the road or vice versa. It is a farm pond and could be bermed if necessary. Legals: Legal documents are needed for the relocation of the 60 foot r--o-w. 4) FARRELL PROPERTY, 70 FARRELL STREET The applicant proposes to change the lot sizes of the two parcels of land located at 70 Farrell Street (former Lakeside Tennis) , and the adjacent Farrell land. It is zoned Commercial-1. An earlier application of Champlain College for this subdivision was withdrawn before final approval. The Vermont Federal will be the new owner of the Lakeside Tennis lot. The application simply reduces the size of the Lakeside Tennis lot to 4.10 acres and enlargens the size of the adjacent Farrell land to 8,-94 acres by adding a 60 foot strip of .72 acres. No additional lots are created. The 8.9-11 acres will be subject of a future land use plan. The final recorded plan should show both parcels of land at the new acreage. See Bill Szymanski's comments. 5) BURLINGTON INTERNATIONAL AIRPORT, AIRPORT DRIVE The applicant proposes to construct a two level addition to the main terminal, relocate the control tower, expand the paved area for additional rental parking, close Dawn Court and open a new access drive onto Airport Drive. The area is in the Airport District. Circulation: The main entrance and 2 exit drives will remain. The access driveway at the end of White Street will be opened. It is not clear whether this is for public traffic or airport - only traffic. Heavy use may require additional signage such as a stop sign on the Airport land. Also, agreements must be obtained from Don LaValette for Dawn Court closing, and Peter Judge for the access road over his property. The existing utilities and sidewalk along Farrell Street are affected by this correction. It puts some of them on private property. Land or easements should be deeded to the City. 5) AIRPORT TERMINAL AREA, BURLINGTON MUNICIPAL AIRPORT 1. Surface drainage from expansion area will require careful study. Draining into the area behind Airport Drive lots 1, 2, 3, and 4 as shown on site plan will add more water to an area that is experiencing problems with existing runoff. 2. That dead end section of White Street east of Airport Drive is a City Street. A turn around should be constructed there or that portion of the street turned over to the Airport. The problem with that is lot No. 1 has access from this street. 6) O'BRIEN-MILOT OFFICE BUILDING, KIMBALL AVENUE 1. Kimball Avenue sidewalk shall continue from the Palmer Building sidewalk easterly across the entire frontage, including across this project entrance. 2. Existing sewer stubs shall be used instead of opening road to install a new one. Building elevations show that except for the bottom floor the entire building can be sewered by gravity. This should be done instead of the entire building's sewage pumped. 7) EAST-0-LAKE INN & MOTEL, SHELBURNE ROAD 1- Water and sewer services to this complex will have to come from the west where large lines exist. The developer should anticipate have to acquire easements for that purpose (prior to permit). 2. Storm drainage for this extensive development will also have to go westerly where easements will be required. Drainage plans shall be approved by the City Engineer prior to permit. 8) INTERPRETIVE DATA SYSTEMS, SHELBURNE ROAD 1. New parking lot paving shall be a uniform arc not saw tooth as shown. They intend to upgrade the facility and put in 150 parking spaces. They also plan to run a shuttle bus from the campus. The sole access would be on Farrell St. Mr. McConaughy, representing Mr. Farrell, noted that the College ys-buying a piece of land which is less than what Farrell presently owns. They will not be creating any new lots. Sixty and Seventy foot strips along the south and west sides will be merged with present Farrell property. Apparently, when the original subdivision was planned, this was to be the arrangement; however, when Lakeside actually constructed, the additional strips were added. Mr. Dooley asked that the City Planner research and see if it could be determined why the original lot grew. Mr. McConaughy advised that the Farrells will at some point come in to the Commission to try to get a sensible land use plan for the entire area. She noted two possible alternatives: to increase the minimum lot size required for a duplex, so that at least 90% of the homes in the city would not have enough spaces; thus making accessory apartments the easier option; or to say that a 2-family structure could be built only on a vacant lot. She said she preferred the first alternative, and the concensus of the Commission was for this alternative. Within approximately 1/2 mile of this site are some 250 existing residences; within the same radius is the potential for development of some 515 additional dwellings. d. In the residential area south of the UVM Horticultural Farm, near Allen Road and Spear Street, a neighborhood parksite should be provided. Through option or other measure, the City must secure the purchase of a major parcel of recreational land of at least 250 acres in size, with the potential for multiple uses by all the citizens of the community. Mr. Burgess asked if there will be any grievances because Police vehicles will have to be moved. He noted that for the record this will be considered the City's problem. Mrs. Hurd moved that the Planning Commission approve the site plan application of the South Burlington Water Department for construction of a 3600 sq. ft. addition (1800 sq. ft. on 2 floors) to the City Hall as depicted on a plan entitled "South Burlington Water Department addition to City Hall, Dorset Street, South Burlington, Schematic Design" prepared Py Northern Architects, Inc, dated 11/13/86 with the following stipulations: 1. A $5900 landscaping escrow agreement shall be in place prior to permit. It shall be used to landscape the area in front of the building after Dorset Street is widened. 2. Following completion, the City Planner shall review the placement of the chain link fence to determine if further screening is required. 3. The building permit shall be obtained within 6 months. Mrs. Maher seconded, and the motion passed unanimously. 4. Consider request of Robert F. Torney, President of the ( Olympiad,. to make a temporary driveway permanent at the Olympiad, 70 Farrell Rd. Mr. Torney explained that the driveway, put in originally as a construction driveway, is useful for heavy things that are PLANNING COMMISSION 18 NOVEMBER 1986 PAGE 3 delivered and could also be used for an ambulance access if there were ever a problem in the aerobics area of the building. It would not be used for public access. Mrs. Lafleur noted that the culvert needs to be in place if the driveway remains, and the applicant is willing to put in the culvert. They would also be willing to chain the driveway so it is just for employee and emergency use. It would remain unpaved. Mrs. Hurd moved that the Commission approve the driveway referred to in a letter from Robert F. Torney, dated October 28, 1986, agreeing that the driveway be allowed to remain under the following stipulations: the Olympiad would replace the temporary culvert with one to be 30 inches in diameter and 30 feet long as requested pj the City Manager; the City Planner would review the use of the driveway in one year. It is understood that the driveway would be used only for delivery and for emergency vehicles. It will not be a public access to the building. Site plan application of William Peters for construction of a 3800 sq. ft. addition to the existing Harrington Brothers building, 400 Patchen Road. Mr. Peters explained that they want to make the building more usable for their needs. It is a unique business in which items are laid out on the floor to be picked up by trucks for delivery. There will be not vehicles in the front of the building, and trucks are parked inside at night. Trucks cannot enter from the rear because of the elevation. Mrs. Maher noted that landscaping is deficient and that she would be willing to give the Planner the right to get more permanent trees wherever best in order to soften the ap- pearance of the building. Mrs. Lafleur noted they could landscape 15-20 ft. in front of the building as Mr. Cota did across the street. She also noted that the Fire Chief has a problem with parking alongside the building. There is also a problem with space for snow removal. Mr. Peters said they would rather landscape the side of the building. He noted that the City uses the back of the building for access as does Barrett. He agreed to remove.parking from the side of the building and to landscape with a 5 ft. grass strip. He said they would eventually pave the whole area. He noted that his plans incorrectly show more land in the front yard than he has. Mr. lard said there was an application pending before the Zoning Board, but that Board wanted the Commission to discuss parking. The applicant has dropped the request for courts in the front of the building and has added a row of parking to the rear of the lot. Parking has been a problem,with cars parking along Joy Drive and Farrell Road. There will be a discussion with the City Council on signing those two streets for no parking. There are 75 parking spaces now and 48 will be added. 6 weeks ago one court was eliminated and that will be replaced. '1,:r. O'Connellwas asked hop; many people the facility could serve at any one time and he said 111. Be said he could erect signs saying No Parking on the Street and Additional Parking in the Rear. It was suggested that an additional area be excavated to the south of the new parking lot for snow storage in the winter. One was from a citizen named Mark Smith, the second was from Colchester noting amendments to its land use planning and zoning map, and the last was a notice of a Regional Planning Commission hearing last night on Transportation and Energy. He noted that this last letter had come too late for any Commission members to attend the hearing. Mr. Poger also noted that he had been notified of a proposed change in density in Burlington, that he had the Airport Plan if anyone wanted to read it, and that the courts had ruled against Carter clothing, on Shelburne Road. They have an 8-month lease which starts about 1 November. They will then evaluate the business to see if they wish to continue. Members were uneasy about the temporary nature of the business, noting they are not usually as fussy about a temporary use, but if the business is to continue, they would want additional stipulations. Mr. Weith said he and the City Engineer had viewed the application from a permanent point of view. Mrs. Maher raised the question of getting the front yard coverage to conform. Mr. Weith said that Brian Christenson had said he would reduce the display area in order to conform. A concensus of members was that they wanted conforamnce with setback and coverage regulations. The question of lights was also raised. Ms. Christenson said they hadn't considered that yet but would want some lighting for security. Members also questioned the width of the -shared access and the question of the right-of-way being a private drive. Following the discussion, members felt they wanted to see a revised plan. Site Plan application of Olympiad Court Associates for construction of a 4700 sq-ft. addition to the existing health club facility, 70 Farrell Street Mr. Weith said the plan meets setbacks and coverage require- ments. There is a question on parking, however. Mr. Torney said they presently have more parking than any__other similar. facility in the area. Mr. Weith said ITE recommends 5 spaces per 1,000 sq. ft. which would mean 94 spaces. They have 105. Mr. Torney said they are'now parking 135 cars since they re - striped the lot. Mr. Burgess said he would like the plan to show the 135 spaces. Mr. Torney said they are not looking for more members, just to serve their present membership better. He noted the Commission approved a larger facility than theirs next door and required fewer spaces. He said they have plenty of room to expand parking. Mr. Weith said there might be a question of problems in the the East Woods neighborhood, especially if there is an increase in traffic. Mr. Jacob raised the question of a sidewalk. It was the concensus of the members to require money for the sidewalk and to hold it for later use. The Twin oaks Tennis Club is located directly across Farrell Street. Access/Circulation: Access will remain from the 30 foot wide curb cut on Farrell Street. Circulation is provided in front and along the north side of the facility. Setbacks/Coverage: The existing facility plus the addition meets setback and coverage requirements. Parking: The plan shows 105 parking spaces. I believe these 105 spaces are existing and the applicant is not planning on increasing parking capacity. The City's ordinance does riot include any standards for indoor recreation facilities. I was able to find one source that contains a standard for "commercial recreational facilities." This source recommends 7.9 spaces per 1000 square feet of floor area. Applying this standard to this project results in a need for 148 parking spaces. When Twin Oaks Tennis came to the Planning Commission for its project. across the street, Jane Lafleur estimated a parking space need of 66 spaces for the 53,550 square foot facility. I have not been able to get in touch with Jane to find out how she derived her estimate. Her estimate calculates out to a ratio of 1.2 spaces per 1000 square feet of floor area. This is significantly lower than the standard discussed above. Applying this 1.2 space/1000 square foot standard to the Olympiad project results in a parking space need of 22 spaces. I feel this would not meet peak parking demands of this facility. I will reach Jane prior to the meeting to learn how she derived her estimate. I will also research other sources to try and find additional recommended parking standards for indoor recreation facilities. TRAFFIC: I feel traffic is an issue which the Planning Commission should consider carefully in regards to the traffic problems that are occurring in the Hadley Road/Meadow Road neighborhood. Mr. Torney of the Olympiad does not, feel the addition will cause more traffic; in the area because potential members who are looking rot, a facility with a pool- are going across the street. By adding a pool, Mr. Torney believes they will attract members who would otherwise go across the street. I do riot fully agree with this. This addition might not cause additional traffic in the short run, however, in the long run there will be an increase. The increase of fitness club capacity in the area will eventually result in an increase in traffic as both clubs attract, new members. What we need to consider is whether this addition substantially increases traffic in the surrounding neighborhoods, and whether this increase in traffic substantially impacts these neighborhoods. Landscaping: The project requires $7,500 in new landscaping. The addition will require the removal of 7 existing mature trees. The landscape plan shows new spirea, cranberry bush, .juniper, crabapple, hemlock, sugar maple, ash and burning bush. The plan does not, however, indicate the sizes of the proposed landscaping. The plan should be revised to show proposed sizes. Based on adequate sizes, the proposed plan meets the $7,500 requirement. Although this building access was originally designed to be a temporary curb cut for construction, we have found the access to be very valuable for deliveries to and from the club, as well as an extra fire lane. Mr. Ward explained to me that if we wished to consider permanent use of this fire lane we would have to receive necessary approvals from your office. The main concern, according to Mr. Ward, being culvert size under the access. We have contacted Mr. Sonny Audette from the City Highway Department about proper design. He has also informed us that replacing the temporary culvert with one 30 inch in diameter and 30 feet long would meet his requirements. I would like to request the Planning Commissions approval of this access to the Olympiad Club, based on our meeting the requirements of the City Highway Department. If the Planning Commission has any questions concerning this matter, I would be more than happy to appear in person if necessary to explain our request. Torney, president of the Olympiad requests approval to retain a driveway that was designed to be a temporary construction curb cut. They are finding it useful for deliveries. It is not shown on the original plans since it was for construction use only. The Planning Commission has the power to approve all driveways. The enclosed letter addresses Mr. Torney's concerns.and describes the replacement culvert the city will require if this is approved. This gravel driveway serves a single doorway at the top of a steep set of stairs. I question how useful it is for deliveries. Mr. Torney should be available to discuss his interests with the Planning Commission. 5) HARRINGTON BROTHERS, 400 PATCHEN ROAD Mr. Peters proposes to construct a 3800 square foot addition to the Harrington Brothers building on Patchen Road. Effective September 10, 1982 and Olympiad Court Associates Address: 180 Flynn Avenue Burlington, Vermont 05401 This project, consisting of amending the property line between the two lots previously approved in Subdivision Permit EC-4-0747 and Deferral of Permit D-4-730 so that the two lots are now a 2.67 acre lot (with the structure approved in Certification of Compliance PB-4-0020 and Land Use Permits PB-4-0765 and PB-4- 0765-1) and a 4.91 acre lot (proposed for the structure referenced in Water Supply and Wastewater Disposal Permit WW-4- 0875) located off Farrell Street in the city of South Burlington, Vermont is hereby approved under the requirements of the regulations named above, subject to the following conditions. GENERAL 1. The project shall be completed as shown on the plans Project No. 94276 "Plat of Boundary Adjustment Between Gardens For All, Inc. and Olym[piad Court Associates" dated December 1994 prepared by Civil Engineering Associates, Inc. and which have been stamped "approved" by the Wastewater Management Division. The project shall not deviate from the approved plans without prior written approval from the Wastewater Management Division. 2. Each prospective purchaser of each lot shall be shown a copy of the approved plot plan and this Subdivision Permit prior to conveyance of the lot. 3. The conditions of this permit shall run with the land and will be binding upon and enforceable against the permittee and all assigns and successors in interest. The permittee shall be responsible for the recording of this permit and the "Notice of Permit Recording" in the South Burlington Land Records within 30 days of issuance of this permit and prior to the conveyance of any lot subject to .the jurisdiction of this permit. 4. The 2.67 acre lot has been reviewed and is approved with the existing structure referenced in permits PB-4-0020, PB-4- 0765 and PB-4-0765-1. No other buildings are allowed without prior review and approval by the Agency, and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. The 4.91 acre lot has been reviewed and is approved for the construction of the structure referenced in Water Supply and Wastewater Disposal Permit WW-4-0875 on the approved lot. Construction of other type dwellings, including public buildings, duplexes, and condominium units, is not allowed without prior review and approval by the Wastewater Management Division and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. 6. All conditions set forth in Certification of Compliance #PB- 4-0020 dated August 15, 1974 shall remain in effect except as modified or amended herein. 7. All conditions set forth in Land Use Permits #PB-4-0765, EC- 4-0747 and PB-4-0765-1 dated December 28, 1982 March 15, 1983 and November 13, 1983 respectively shall remain in effect except as modified or amended herein. 8.
