Under Section 19.05 sub section 19.056 of the zoning regulatians, your application
will first require approval by the Zoning Board of Adjustment. This action is
required before site plan review. My next Zoning Board of Adjustment meeting is

Tree Planting Proposal for Screening
Paddle Tennis Club of Burlington
Screening of the proposed paddle tennis courts
located at Cross Courts, Inc. ParrelRoad would include
twenty white pine trees, four to six feet in height.
These trees would be planted in two rows of ten trees
each and would extend approximately ten feet beyond the
end of the east and west side of the paddle courts.
Cost of the trees, tax, labor and materials would be
$530.20 as submitted in the planting contract by
Gardenside Nurseries, Inc. of Shelburne, Vermont.
A large dead elm near the courts would be
removed.
A raised board walk from the parking area
to each court entrance would be constructed.

This proposal has appeared before the Zoning Board of
Adjustment on May 19, 1975.
Zoning Board approved the proposal under the Conditional
use provisions of Section 8.10 - Outside storage
received a stipulation that no building materials be
stacked higher than 8 feet and the easterly property
line be landscaped. (Plans show pines and arborvitae's)
Also approved is a multiple use of the building
(Grossman's and Triple S. Stamp Store). A waiver on
parking from 215 spaces for Grossman's portion was
approved with a stipulation that 100 spaces be
provided (plan indicates 100 spaces).
All other provisions are in conformance with zoning
regulations.
Proposal is to use a portion containing 21,504 square
feet of the building as a Grossman's Retail Store and
59936 square feet as a Triple S redemption center. No
alterations to entrance parking lot will be stripped
and additional landscapinep installed.

This proposal has appeared before the Zoning Board of
Adjustment. A variance was granted from Section 13.40

A total of 188 spaces are required. The proposal is to

Re -Tabling or Delay of an Appeal Before the Zoning Board
of Adjustment
Dear Dick:
You have recently posed the question of whether the Zoning
Board of Adjustment should, at the request of the appellant,
delay for a second time the hearing of the appeal. The answer
to this question turns upon the time limits provided in Title 24,
V.S.A. §4467. This section provides that the Board shall set a
date and place for a public hearing, which shall be within 60
days of the filing of the notice of appeal. The Board is also
mandated to give public notice of the hearing and to mail to
the appellant a copy of the notice at least 15 days prior to the
hearing date. These time limits lead to the conclusion that
the Board should only consider the tabling or delay of the pend-
ing appeal if, after such delay, it can give the required 15 days
notice to the applicant and the public notice and still comply
with the 60-day provision in the first sentence of this section.
While it is arguable that an appellant who requests the delay
should not be able to benefit from the delay in terms of claim-
ing a procedural irregularity based upon the time limits in-
volved, the safest course would be for the Board to go ahead
and hear the appeal, even though there has been a request to
table, if the request to table would bring the Board outside of
the 60-day limit.
The terms of the above section contemplate that a hearing
can take place even though the appellant is not there. The
section states in part,
"Any person or body empowered by Section 4464 of this
title to take an appeal with respect to that property
at issue may appear and be heard in person or be repre-
sented by agent or attorney at such hearing."
The inability of the appellant to appear does not preclude his
appearance by his agent or his attorney.

While you noted that this appeal came up within the context
of Title 24, Section 4470 (b), it appears that since the Board
has already set a date and place for public hearing, it would not
be able to avail itself of the provisions of 4470 (b) in terms of
the 10-day provision for rejecting an appeal that contains substan-
tially the same facts and issues decided in an earlier appeal.
Additionally, it would appear that the 10 days mentioned in this
subsection would have run, thus, precluding the applicability of
this subsection.
Therefore, unless the Board can warn another meeting which
would be held within 60 days of the original filing of the notice
of appeal for the second time, it would be best for the Board to
go ahead and entertain the appeal even though the appellant has
requested that the appeal be stayed until such time as he may be
present.

order to put this building on the most sensible location, and
still be of an economically feasible size (approximately 8,000
gross sq. ft.); we have located it as shown on the enclosed site

You will notice that the southern end of the building will be
located a foot in from the land we have leased from you. This
portion of the building is in technical violation of the present
zoning regulations,and the only violation of our proposal.
We have argued that since we already have a long-term lease that
we should be given a variance in this case. Since, in effect, we

However, the zoning board brought up the point that should we sell
the Court Club property, or should in the unlikely event that you

Enclosed please find a rough drawing indicating where Bob Bensen and
Cross Court would like to place a warm-up but and proposed paddle tennis
courts which is different from the past drawing that was submitted to the
Zoning Board of Adjustment. Bob Bensen measured the distance from
Farrell Drive to the court nearest the road and that distance is greater
than 75 feet. You will notice, however, that we wish to move the paddle
tennis courts to a location 18 feet from the side road and I will request
that too by advertisement.

posted. The plan shows $1600-$1800 worth of landscaping, and Mr. Wallman wants
credit for the balance of the amount for what eiists on the site. Mr. Poger
felt the city should have someone take a look at the area and determine the
value of what is there.
Ms. Bechtel also wondered if there was enough landscaping shown on the
plan. Mr. Wallman admitted that it was deficient and said he would like to
add more trees.
Mrs. Maher moved to continue this item until two weeks from tonight, at
7:30 pm at City Ball. Mr. Jacob seconded the motion and all voted for it.
Final plat application of RDR Enterprises for a 3 lot -;subdivision located at
Kimball Avenue
Mr. Mark Lawdon represented RDR. He said all stipulations from preliminary
plat had been met. The line showing the Kimball Avenue right of way needs to
be corrected on the plan, as does the location of the 24" CWD water main. The
three lots in question contain 11:9 acres, 7 acres, and 4.8 acres. The 60'
right of way to Dr. Brown's property will be shown between lots 1 and 2 and
the correct water and sewer lines will be put on the plan. In addition, two
10' triangles of land will be included as right of way. This land is for proper
curb radii. There will be two curb cuts for the three lots.
Mr. Belter asked whether Dr. Brown was aware of this right of way location
and Ms. Bechtel said he had been notified of the hearing as an abuttor. Whoever
comes to the Commission first is able to dictate the location of that right of way.
Mr. Dooley moved that the South Burlington Planning Commission approve the
final plat application of RDR Enterprises for the subdivision of a 23 acre parcel
into three lots as de icted on a plat entitled "Site Plan - RDR unter2rises
Subdivision" dated 3 4 84 and revised 5 31 84 prepared by Wiemann-Lamphere Architects
with the following stipulations:
1. That the reserved 60 foot right of way be used for common access between
lot #1 (4.8 acres) and lot #2 7.0 acres and shall serve as a reserved right
of way to Dr. Brown's property from Kimball Avenue for potential use as a
public street and noted as such on the plan. �+
2. The 60' right of way shall include two 10 foot triangles at the Kimball
Avenue intersection for future construction of adequate intersection radii
and to protect sight distances.
3. That the sewer allocation is 1400 gallons per day for the three lots,
and separate allocations for each lot at site plan review shall be deducted
from this amount. This is number 3 on the waiting list.
4. The location of the 24 inch water main shall be shown on the plan in
the correct location. The Tevised mylar shall show this change and shall be
filed with the City Clerk within 90 days.
5. This approval expires in 3 years.
Mrs. Maher seconded the motion and all voted aye.
The final plat application of David M. Farrell for re -subdivision of 2 lots
into 3.6 acres and 9.6 acres located at 70 Farrell Street has been withdrawn.

Mr. Crampton said Champlain College was going to purchase the lot which
is now the Lakeside Tennis property. The 60' strip of land will be allocated
to the surrounding Farrell property.
Mrs. Maher moved that the South Burlington Planning Commission ap rove
the final plat application of David M. Farrell and Vermont Federal Bank for the
subdivision of lots into 2 new sized lots of 4.10 acres and 9.2 acres as
depicted on a 2 page set of plans entitled "Final Plan, Subdivision of David_
M. Farrell Property" as prepared by George E. Bedard, dated 9 3%84 and revised
2 $5 with the followin-- stipulations:
1. A record copy shall be filed with the City Clerk_ within 90 days_
showing the entirety of the two lots and the new acreage.
2. Land or easements for the corrections on Farrell Street shall be
deeded to the City.
Mr. Belter seconded the motion.
Mr. Poger said he would like to seea plan for the overall use of the area
and Mr. Crampton said they would be in in 6 months to a year with one.
Mr. Crampton noted that Farrell Street had been constructed in the wrong
location in the 1960's and that will be corrected now (stipulation #2).
The motion carried unanimously.
Site plan application, Burlington International Airport for a 25,700 sq. ft.
addition to the terminal and associated site work, Airport Drive
Mr. James Lamphere said they would like to make a two-story expansion of
the existing terminal building. They will also be purchasing the Lavalette
land. The fuel farm will be moved and site work will be done in the car rental
parking area. Three jetways will be added, plus a large departure lounge.
Mr. Lamphere said the Master Plan for the airport showed major expansion
from 1983-1984. He felt the major growth had already occurred and that things
would now level off. Dr. Oppenlander has done a traffic analysis and concluded
that the present access will be adequate through 1995.
Mr. Lamphere noted that the terminal parking area had been expanded. When
it reaches capacity, shuttle buses run between the terminal and other parking
areas around the airport. Mr. Poger felt there was a parking problem now and

Future Interchange: There is no clear reservation of land on the
NET plan for a future interchange although an interchange there
would not appear to infringe on the main building. At a future
site plan review any structures built on the Tilley lot should be
set back to provide for an interchange.
Pond Location: Bill Szymanski agrees with the applicant that the
pond should not present a problem to the road or vice versa. It is
a farm pond and could be bermed if necessary.
Legals: Legal documents are needed for the relocation of the 60
foot r--o-w.
4) FARRELL PROPERTY, 70 FARRELL STREET
The applicant proposes to change the lot sizes of the two parcels
of land located at 70 Farrell Street (former Lakeside Tennis) , and
the adjacent Farrell land. It is zoned Commercial-1. An earlier
application of Champlain College for this subdivision was withdrawn
before final approval. The Vermont Federal will be the new owner
of the Lakeside Tennis lot.
The application simply reduces the size of the Lakeside Tennis lot
to 4.10 acres and enlargens the size of the adjacent Farrell land
to 8,-94 acres by adding a 60 foot strip of .72 acres. No additional
lots are created. The 8.9-11 acres will be subject of a future land
use plan. The final recorded plan should show both parcels of land
at the new acreage. See Bill Szymanski's comments.
5) BURLINGTON INTERNATIONAL AIRPORT, AIRPORT DRIVE
The applicant proposes to construct a two level addition to the main
terminal, relocate the control tower, expand the paved area for
additional rental parking, close Dawn Court and open a new access
drive onto Airport Drive. The area is in the Airport District.
Circulation: The main entrance and 2 exit drives will remain. The
access driveway at the end of White Street will be opened. It is
not clear whether this is for public traffic or airport - only
traffic. Heavy use may require additional signage such as a stop
sign on the Airport land. Also, agreements must be obtained
from Don LaValette for Dawn Court closing, and Peter Judge for the
access road over his property.
Parking: The People Express area will be relocated and a new parkinq
area for rental vehicles built in it's place.

1. The existing utilities and sidewalk along Farrell Street are
affected by this correction. It puts some of them on private property.

5) AIRPORT TERMINAL AREA, BURLINGTON MUNICIPAL AIRPORT
1. Surface drainage from expansion area will require careful study.
Draining into the area behind Airport Drive lots 1, 2, 3, and 4 as shown
on site plan will add more water to an area that is experiencing
problems with existing runoff.
2. That dead end section of White Street east of Airport Drive is a
City Street. A turn around should be constructed there or that portion
of the street turned over to the Airport. The problem with that is lot
No. 1 has access from this street.
6) O'BRIEN-MILOT OFFICE BUILDING, KIMBALL AVENUE
1. Kimball Avenue sidewalk shall continue from the Palmer Building
sidewalk easterly across the entire frontage, including across this
project entrance.
2. Existing sewer stubs shall be used instead of opening road to
install a new one. Building elevations show that except for the
bottom floor the entire building can be sewered by gravity. This
should be done instead of the entire building's sewage pumped.
7) EAST-0-LAKE INN & MOTEL, SHELBURNE ROAD
1- Water and sewer services to this complex will have to come from
the west where large lines exist. The developer should anticipate
have to acquire easements for that purpose (prior to permit).
2. Storm drainage for this extensive development will also have to
go westerly where easements will be required. Drainage plans shall be
approved by the City Engineer prior to permit.
8) INTERPRETIVE DATA SYSTEMS, SHELBURNE ROAD
1. New parking lot paving shall be a uniform arc not saw tooth as
shown.

Pursuant to our discussion, I enclose an application for
final plat subdivision approval and four copies of the final
set of plans prepared by George Bedard. It is my understanding
we are on the agenda for the March 12, 1985 meeting of the
South Burlington Planning Commission to receive final approval.
As you recall, the application for a minor subdivision was
originally submitted by David M. Farrell and Champlain College
and proposed to create a lot of 3.56 acres which was to be
conveyed to Champlain College, with the balance of 1.36 acres
being added to the adjacent Farrell properties. The change
between preliminary plat and final plat application is the
result of a new agreement reached between David M. Farrell and
Vermont Federal Bank subsequent to the decision of Champlain
College not to purchase the property. With the approval of the
final plat, a definitive lot will be established that will be
owned by Vermont Federal Bank, and the strip being retained by
Mr. Farrell and combined with adjacent Farrell property will be
the subject of a future land use plan for the 8.94 acres owned
by the Farrells which lies between Shelburne Road and Farrell
Street.

The two new lots will be 3.6 acres and 9.6 acres. The smaller lot
is the site of the former Lakeside Tennis, I have stipulated that
a revised Final Plat shall show both lots at the approved acreage
and -the ownership (David M. Farrell 3.6 acres and Thomas A Farrell
9.6 acres).
There was a question at the last meeting whether the original sub-
division was recorded at 3.6 acres or 4.8 acres. Our tax records
show that Thomas Farrell sold David Farrell a 4.81 acre lot in
1973. (Volume 108, page 484). Lakeside Tennis was built on this
lot. There is no indication that a 3.6 acre lot was ever created and
therefore this request is appropriate in order to create the de-
sired lots.
6) JEFF DAVIS, 1270 SHELBURNE ROAD
Mr. Davis proposes to build a 3900 square foot (60'x65') addition
to the existing 2480 square foot structure. It will be two stories
and requires a variance from the Zoning Board to have a 27.5 foot
set back. The building will be for office use. Assuming this is
granted on September 24, my comments are as follows:
Circulation: A 32 foot wide drive is proposed;twenty foot aisles
are shown.
Parking: All requirements have been met. 1 handicapped space
and 2 loading and unloading spaces are shown and forty four parking spaces.
Landscaping: Proposed landscaping has been verified at greater than
the $5250 required.
Traffic Overlay Zone: As you may remember, this lot is in traffic
overlay zone 3. As an office use, the maximum permitted size is
10,343 square feet, using Institute of Traffic Engineers (ITE) estimates.
The proposed 10,280 square feet is under this maximum.
Jeff Davis has been working with the neighborhood residents to
resolve any concerns regarding this use. It is my understanding
that the residents have no objections to the use of this building
as office space.

described by reference to a survey entitled "Plan and Profile of a Proposed
Street Extending From Swift Street to Hadley Road", prepared by Hoag &
Associates dated February 2, 1960, whereas Farrell Street as actually laid
out and constructed is correctly described and depicted on the aforementioned
plans prepared by Webster -Martin dated December 6, 1962.
Grantor expressly conveys an easement and right of way for utility lines
and/or sidewalk improvements which presently exist and are located adjacent
to and immediately westerly of the sixty foot strip conveyed herein, together
with the right of entry upon the adjacent property of Grantor for purposes of
maintenance, repair, and replacement of same, Grantee to expediently return
the property to the condition it was in prior to any maintenance, repair or
replacement of said utility lines or sidewalks.
David M. Farrell joins in this conveyance for the purpose of granting
the easement and right of way over property he presently owns adjacent to and

subdivision of 2 lots into 4.81 acres and 9.6 acres located at
70 Farrell Street (Lakeside Tennis
Mr. Peter Collins explained that Champlain College would like
to buy the existing Lakeside Tennis Facility to use for intramurals,
varsity basketball, and graduation in inclement weather. They
intend to upgrade the facility and put in 150 parking spaces.
They also plan to run a shuttle bus from the campus. The sole
access would be on Farrell St. Mr. McConaughy, representing
Mr. Farrell, noted that the College ys-buying a piece of land
which is less than what Farrell presently owns. They will not
be creating any new lots. Sixty and Seventy foot strips along
the south and west sides will be merged with present Farrell
property. Apparently, when the original subdivision was planned,
this was to be the arrangement; however, when Lakeside actually
constructed, the additional strips were added. Mr. Dooley asked
that the City Planner research and see if it could be determined
why the original lot grew. Mr. McConaughy advised that the
Farrells will at some point come in to the Commission to try to
get a sensible land use plan for the entire area. That is why
they wanted more frontage on Farrell Street and more space to
be used for landscaping or parking, etc.
Consider language for amendment to Zoning Regulations for
accessory apartments
Ms. Bechtel advised that she and the City Attorney and Zoning
Administrator WarVez. on language with the intent of preserving
the character of neighborhoods but also allowing for the need for
smaller living space. She noted two possible alternatives: to
increase the minimum lot size required for a duplex, so that at
least 90% of the homes in the city would not have enough spaces;
thus making accessory apartments the easier option; or to say that
a 2-family structure could be built only on a vacant lot. She
said she preferred the first alternative, and the concensus of
the Commission was for this alternative.
Regulatory points would include: minimum and maximmim a 4r+mPnt

might be difficult to enforce. Mr.Krassner noted an instance
of an owner who moved to Florida and wanted to rent both the

like language in the ordinance that an accessory apartment is
not allowed as a use if the owner is not resident in the building.

The March 27, 1984 "minutes were approved on a motion by Mrs Maher, a
second by Mr. Belter, and a unanimous vote.

Mr. Burgess came in at this time.
Mr. Ward said a shared access onto Shelburne Road was proposed -for "lots

2 & 3 and this drive would lineup with Harbor View Road, across the street.
Lot i would have access to the private drive to the south.
Mr. Jacob arrived at this point.
Mr. Dickinson, of Fitzpatrick -Llewellyn, represented the applicant. He
said they would like some latitude left with regard to lot l's access along
the lot line. Where that access will be might depend on the type of use for
the lot. Mr. Mona asked if there were a legal right to use that private road
and Mr. Bouyea said there was. Mr. Ward said the State would have to have
input into the access to Shelburne Road before the Commission could act on this.
Mrs. Hurd asked about the Southern Connector and was told it might take
part of lot 3, but that the City Attorney had told the city that the Commission
could not legally consider that. She asked about access for the back 13.66
acres and was told that could have access through the private drive and the
bakery lot. She noted that only 3 lots could be served by a private road, and
this one now serves Wickes Lumber and the bakery. With the addition of lot 1,
,further subdivision of the retained land might be precluded. Mr. Mona wanted
Mr. Bouyea to ,be aware that, based on present regulations,this plan might have
the effect of locking up the back land.
Mrs. Maher moved to continue the hearing of Fassett's Bakery until the
next regularly scheduled meeting. Mr. Jacob seconded the motion and it carried
unanimously.

RECOMMENDATIONS
1) Project Parks
a. To conserve energy and ensure maximum usage and local
control, privately owned project parks should be strongly
encouraged. The design and type of facility should be guided by
the City in order to take pressure from city facilities.
b. In support of such parks, credit against recreation
land or fees exaction may be allowed, provided that the size and
type of facilities meet Planning Commission approval on advice of
the Recreation Director.
C. Legal mechanisms should be required as a condition of
approving private parks so that the option of municipal management
is retained in the event of failure of the homeowner's
association.
2) Neighborhood Parks
a. Development and expansion of the Potter property
currently underway with 20 acres of land now available and tennis
courts, ball field, tot lot, picnic area and fitness trail,
either under construction or planned for the near future.
b. Development of the Garvey, Dumont, and Degraff
properties could alleviate pressure on the presently overburdened
Jaycee Park. Although the neighbors have expressed that they
would like them to remain open space they should be developed as
neighborhood parks.
C. A proposed parksite, approximately 10 acres in size,
should be located near the intersection of Kennedy Drive and
Hinesburg Road. The size and location of this site are dictated
in large part by residential densities in the area (7 units per
acre). Within approximately 1/2 mile of this site are some 250
existing residences; within the same radius is the potential for
development of some 515 additional dwellings.
d. In the residential area south of the UVM
Horticultural Farm, near Allen Road and Spear Street, a
neighborhood parksite should be provided. It is preferred that
this new park be contiguous to the existing City park.
3) City Parks
a. Through option or other measure, the City must secure
the purchase of a major parcel of recreational land of at least
250 acres in size, with the potential for multiple uses by all
the citizens of the community. Such a site include multiple
playing fields, tennis courts, baseball fields and tot lots,
outdoor lighting, a municipal rink and swimming pool, crafts and
instructional room and assembly or meeting hall.

Mrs. Lafleur noted that the City Manager and City Council
have reviewed the application and have no problems with it.
Mr. Stoner advised that per the request of the Fire Chief,
changes have been made to the access road. There will be no
new public entrance to the building. It is the intention of
the Water Dept. that the addition be similar in character to
the present City Hall building. The Dept. needs outside
storage for pipe, hydrants, etc.. About 2400 sq. ft. would
be adequate, and the Dept. could clear space on the other
side of the access road. The area will be chain link fenced.
Mr. Belter asked if the fence could be made to look decent
from I-89. Mr. Stoner outlined a number of possible
camouflage techniques. Mrs. Lafleur said the Commission
could view the fence when it is up and decide if additional
screening is needed. Mr. Burgess asked if there will be any
grievances because Police vehicles will have to be moved. He
noted that for the record this will be considered the City's
problem.
Mrs. Hurd moved that the Planning Commission approve the site
plan application of the South Burlington Water Department for
construction of a 3600 sq. ft. addition (1800 sq. ft. on 2
floors) to the City Hall as depicted on a plan entitled
"South Burlington Water Department addition to City Hall,
Dorset Street, South Burlington, Schematic Design" prepared
Py Northern Architects, Inc, dated 11/13/86 with the
following stipulations:
1. A $5900 landscaping escrow agreement shall be in place
prior to permit. It shall be used to landscape the area in
front of the building after Dorset Street is widened.
2. Following completion, the City Planner shall review the
placement of the chain link fence to determine if further
screening is required.
3. The building permit shall be obtained within 6 months.
Mrs. Maher seconded, and the motion passed unanimously.
4. Consider request of Robert F. Torney, President of the
( Olympiad,. to make a temporary driveway permanent at the
Olympiad, 70 Farrell Rd.
Mr. Torney explained that the driveway, put in originally as
a construction driveway, is useful for heavy things that are

delivered and could also be used for an ambulance access if
there were ever a problem in the aerobics area of the
building. It would not be used for public access. Mrs.
Lafleur noted that the culvert needs to be in place if the
driveway remains, and the applicant is willing to put in the
culvert. They would also be willing to chain the driveway so
it is just for employee and emergency use. It would remain
unpaved.
Mrs. Hurd moved that the Commission approve the driveway
referred to in a letter from Robert F. Torney, dated October
28, 1986, agreeing that the driveway be allowed to remain
under the following stipulations: the Olympiad would replace
the temporary culvert with one to be 30 inches in diameter
and 30 feet long as requested pj the City Manager; the City
Planner would review the use of the driveway in one year. It
is understood that the driveway would be used only for
delivery and for emergency vehicles. It will not be a public
access to the building.
Mr. Burgess seconded the motion which -passed unanimousl
5. Site plan application of William Peters for construction
of a 3800 sq. ft. addition to the existing Harrington
Brothers building, 400 Patchen Road.
Mr. Peters explained that they want to make the building more
usable for their needs. It is a unique business in which
items are laid out on the floor to be picked up by trucks for
delivery. There will be not vehicles in the front of the
building, and trucks are parked inside at night. Trucks
cannot enter from the rear because of the elevation. Mrs.
Maher noted that landscaping is deficient and that she would
be willing to give the Planner the right to get more
permanent trees wherever best in order to soften the ap-
pearance of the building. Mrs. Lafleur noted they could
landscape 15-20 ft. in front of the building as Mr. Cota did
across the street. She also noted that the Fire Chief has a
problem with parking alongside the building. There is also a
problem with space for snow removal. Mr. Peters said they
would rather landscape the side of the building. He noted
that the City uses the back of the building for access as
does Barrett. He agreed to remove.parking from the side of
the building and to landscape with a 5 ft. grass strip. He
said they would eventually pave the whole area. He noted that his plans
incorrectly show more land in the front yard than he has.
Mrs. Hurd moved that the Planning Commission approve the site

Telephone Company for construction of a 55,000 sq. ft. office complex and a 16,000
sq. ft. parking garage on a parcel ofland containing 18 acres, owned by Helen
Tilley, located southerly of Interstate 89, as depicted on a plan entitled
"New England Telephone Vermont Headquarters" dated November 22, 1983, prepared
by the Architects Collaborative, Inc., with the following stipulations:
1. That the north -south sewer line be 12" to service adjoining Goodrich
and Dubois properties, and that an agreement between parties concerned be
filed with the City.
2. That two fire hydrants be relocated as requested by Chief Goddette
and approved by him.
3. That the sewer allocation be 6,000 g.p.d. in accordance with the
sewer pohc.y of the Planning Commission.
4. That the water line proposed be 8" to service proposed fire hydrants
and adjoining Wright property.
5. That the State Highway permits be secured prior to issuance of a
building permit.
6. That a performance bond be posted in the amount of $47,000 for
landscaping and $4500 for sidewalk installation.
7. This approval expires in six months.
Mrs. Maher seconded the motion and it carried with all in favor.
Mrs. Maher left the meeting at this time.
Site plan review, addition ;to Olympiad, 70 Farrell Street
Mr. Tim O'Connell represented the Olympiad.
Mr. lard said there was an application pending before the Zoning Board,
but that Board wanted the Commission to discuss parking. The applicant has
dropped the request for courts in the front of the building and has added a
row of parking to the rear of the lot. Parking has been a problem,with cars
parking along Joy Drive and Farrell Road. There will be a discussion with
the City Council on signing those two streets for no parking.
There are 75 parking spaces now and 48 will be added. 6 weeks ago one
court was eliminated and that will be replaced. '1,:r. O'Connellwas asked hop;
many people the facility could serve at any one time and he said 111. Be
said he could erect signs saying No Parking on the Street and Additional
Parking in the Rear.
It was suggested that an additional area be excavated to the south of
the new parking lot for snow storage in the winter. The new lot will be
paved, and arrows on the pavement directing traffic flow were suggested.
Mr. Jacob moved that the South Burlington Planning Commission grant
site plan approval for the application of the Olympiad, 70 Farrell Road, Mr.
Gordon 'floods. Agent, for the construction of a 21' x 42' and a 30' x 90'
addition, as depicted on a plan entitled "Addition to the Olympiad" dated
August 1983 as prepared by Gordon G. Woods Associates, with the following
stipulations:

by the City Engineer prior to issuance o a permit.

2. That a landscaping bond in the amount of $1200 be posted prior to
issuance of a permit.

5. The south side of the rear parking lot shall be rough graded to
allow for snow storage.
6. This approval expires in 6 months.
Mr. Mons seconded the motion and it passed without dissent.
Other business
Mr. Mona moved that the Planning Commission recommend to the City Council
that they prohibit parking on Farrell Road and Joy Drive. Mr. Jacob seconded
the motion and it carried unanimously.
Mr. Poger noted that he had received three letters. One was from a
citizen named Mark Smith, the second was from Colchester noting amendments to
its land use planning and zoning map, and the last was a notice of a Regional
Planning Commission hearing last night on Transportation and Energy. He noted
that this last letter had come too late for any Commission members to attend
the hearing. Mr. Poger also noted that he had been notified of a proposed
change in density in Burlington, that he had the Airport Plan if anyone wanted
to read it, and that the courts had ruled against Carter clothing, on
Shelburne Road. Mr. `,lard said he would check into the ruling.
The meeting was adjourned at 9:30 pm.

this will be a temporary use. They have an 8-month lease
which starts about 1 November. They will then evaluate the
business to see if they wish to continue. Ms. Christenson
said they will do about $1500 cleanup work on the property.
The trailer will be skirted and there will be landscaping up
front.
Members were uneasy about the temporary nature of the
business, noting they are not usually as fussy about a
temporary use, but if the business is to continue, they would
want additional stipulations. Mr. Weith said he and the City
Engineer had viewed the application from a permanent point of
view. Mrs. Maher raised the question of getting the front
yard coverage to conform. Mr. Weith said that Brian
Christenson had said he would reduce the display area in
order to conform. A concensus of members was that they
wanted conforamnce with setback and coverage regulations.
The question of lights was also raised. Ms. Christenson said
they hadn't considered that yet but would want some lighting
for security. Members also questioned the width of the
-shared access and the question of the right-of-way being a
private drive. Following the discussion, members felt they
wanted to see a revised plan.
Mrs. Maher moved to table the application until 25 October.
Mr. Burgess seconded. Motion pass ed unanimously.
3. Site Plan application of Olympiad Court Associates for
construction of a 4700 sq-ft. addition to the existing
health club facility, 70 Farrell Street
Mr. Weith said the plan meets setbacks and coverage require-
ments. There is a question on parking, however. Mr. Torney
said they presently have more parking than any__other similar.
facility in the area. Mr. Weith said ITE recommends 5 spaces
per 1,000 sq. ft. which would mean 94 spaces. They have 105.
Mr. Torney said they are'now parking 135 cars since they re -
striped the lot. Mr. Burgess said he would like the plan to
show the 135 spaces. Mr. Torney said they are not looking
for more members, just to serve their present membership
better. He noted the Commission approved a larger facility
than theirs next door and required fewer spaces. He said
they have plenty of room to expand parking. Mr. Weith said
there might be a question of problems in the the East Woods
neighborhood, especially if there is an increase in traffic.
Mr. Jacob raised the question of a sidewalk. It was the
concensus of the members to require money for the sidewalk
and to hold it for later use.

1. A $7500, 3-year landscape bond shall be posted prior to

4. Preliminary Plat application of G. Milot and J. Larkin
for subdivision of a 30.5 acre lot into 22 commercial lots,
1175 Shelburne Rd.
Mr. Llewellyn said accesss onto Shelburne Rd. will be
opposite McIntosh Avenue. The smallest lot will be just
under and acre, the largest 1.6 acres. The plan has been
submitted to the Water Dept. and City Manager. The plan is
to tie into the existing 16" main on the west side of the
property and to end at Rt. 7. The Water Dept. doesn't want
to cross Rt. 7. There will be a stub to the Pomerleau pro-
perty. They will use public
a private pump station. This

pied Court Associates propose to construct: a 4,700 square
foot. addition for recreational uses (new pool) to the existing
health club facility.
The property is bounded by Joy Drive on the north, WCA1 T.V. on
the east, vacant wooded land on the south and Farrell Street on
the west. The Twin oaks Tennis Club is located directly across
Farrell Street.
Access/Circulation: Access will remain from the 30 foot wide
curb cut on Farrell Street. Circulation is provided in front and
along the north side of the facility.
Setbacks/Coverage: The existing facility plus the addition meets
setback and coverage requirements.
Parking: The plan shows 105 parking spaces. I believe these 105
spaces are existing and the applicant is not planning on
increasing parking capacity. The City's ordinance does riot
include any standards for indoor recreation facilities. I was
able to find one source that contains a standard for "commercial
recreational facilities." This source recommends 7.9 spaces per
1000 square feet of floor area. Applying this standard to this
project results in a need for 148 parking spaces.
When Twin Oaks Tennis came to the Planning Commission for its
project. across the street, Jane Lafleur estimated a parking space
need of 66 spaces for the 53,550 square foot facility. I have
not been able to get in touch with Jane to find out how she
derived her estimate. Her estimate calculates out to a ratio of
1.2 spaces per 1000 square feet of floor area. This is
significantly lower than the standard discussed above. Applying
this 1.2 space/1000 square foot standard to the Olympiad project
results in a parking space need of 22 spaces. I feel this would
not meet peak parking demands of this facility.
I will reach Jane prior to the meeting to learn how she derived
her estimate. I will also research other sources to try and find
additional recommended parking standards for indoor recreation
facilities.
TRAFFIC: I feel traffic is an issue which the Planning
Commission should consider carefully in regards to the traffic
problems that are occurring in the Hadley Road/Meadow Road
neighborhood. Based on I.T.E. trip generation rates, the

of the adjacent street and 75 trips during the typical weekday.
Mr. Torney of the Olympiad does not, feel the addition will cause
more traffic; in the area because potential members who are
looking rot, a facility with a pool- are going across the street.
By adding a pool, Mr. Torney believes they will attract members
who would otherwise go across the street. I do riot fully agree
with this. This addition might not cause additional traffic in
the short run, however, in the long run there will be an
increase. The increase of fitness club capacity in the area will
eventually result in an increase in traffic as both clubs attract,
new members. What we need to consider is whether this addition
substantially increases traffic in the surrounding neighborhoods,
and whether this increase in traffic substantially impacts these
neighborhoods.
Landscaping: The project requires $7,500 in new landscaping.
The addition will require the removal of 7 existing mature trees.
The landscape plan shows new spirea, cranberry bush, .juniper,
crabapple, hemlock, sugar maple, ash and burning bush. The plan
does not, however, indicate the sizes of the proposed
landscaping. The plan should be revised to show proposed sizes.
Based on adequate sizes, the proposed plan meets the $7,500
requirement.

4) PUBLIC HEARING: L & M BUSINESS PARK, 1175 SHELBURNE ROAD
G. Milot and J. Larkin propose to subdivide the 30 acre Fayette
property into 22 commercial lots. The property is bounded on the
east by commercial uses (Vermont Federal Bank and south
Burlington Chrysler Plymouth) a multi -family residential complex
and Shelburne Road, on the north by the Pomerleau property, on
the west by the railroad tracks and on the south by a private
road (Inn Road). The property is zoned commercial- 1.
The layout of the plan is basically the same as the plan
submitted for Sketch Plan review. Enclosed are the minutes from
Sketch Plan review (10/27/87).
Access: A 60 foot r.o.w. with 30 feet of pavement is shown from
Shelburne Road. the applicant was instructed at Sketch Plan

Dear Sirs,
I am writing you in response to a letter I received
from Richard Ward concerning a temporary driveway which was bu-lt
during the construction of our addition at the Olympiad Health
Club, located on 70 Farrell Road, South Burlington.
Although this building access was originally designed to
be a temporary curb cut for construction, we have found the
access to be very valuable for deliveries to and from the club, as
well as an extra fire lane. Mr. Ward explained to me that if
we wished to consider permanent use of this fire lane we
would have to receive necessary approvals from your office.
The main concern, according to Mr. Ward, being culvert size
under the access.
We have contacted Mr. Sonny Audette from the City
Highway Department about proper design. He has also informed
us that replacing the temporary culvert with one 30 inch in
diameter and 30 feet long would meet his requirements.
I would like to request the Planning Commissions approval
of this access to the Olympiad Club, based on our meeting the
requirements of the City Highway Department.
If the Planning Commission has any questions concerning
this matter, I would be more than happy to appear in person if
necessary to explain our request.
If possible we would like to go ahead replacing the
existing culvert as soon as possible to avoid ground freezing.

the required amount to "selectively cut trees in the wooded area
to encourage growth of the best trees" and to plant grass. I do
not believe this meets the intent of our ordinance. At the very
least, I suggest the Water Department place the money in escrow
to use to improve the front of the property after Dorset Street
is widened in addition to planting grass and selectively cutting
trees.

4 OLYMPIAD, 70 FARRELL STREET
Mr. Robert F. Torney, president of the Olympiad requests approval
to retain a driveway that was designed to be a temporary
construction curb cut. They are finding it useful for
deliveries. It is not shown on the original plans since it was
for construction use only. The Planning Commission has the power
to approve all driveways.
The enclosed letter addresses Mr. Torney's concerns.and describes
the replacement culvert the city will require if this is
approved.
This gravel driveway serves a single doorway at the top of a
steep set of stairs. I question how useful it is for deliveries.
Mr. Torney should be available to discuss his interests with the
Planning Commission.
5) HARRINGTON BROTHERS, 400 PATCHEN ROAD
Mr. Peters proposes to construct a 3800 square foot addition to
the Harrington Brothers building on Patchen Road. The property
is zoned R4 and this non -conforming use was given permission to
expand after considerable discussion and site visits (see Zoning
Board of Adjustment minutes). The major advantage of this
proposal is that most loading and unloading will occur around the
back of the building rather than in front i,:here it stops traffic
on Patchen Road.
(The Zoning Board has asked the Commission to review the zoning
in this area since the R44desi.gnati.on seems inappropriate for the
area that is comprised of Harrington Brothers, the Frank Cota
property, the land fill, etc.).
Access: With the exception of a seven foot strip along the north
western property line, all of the 144 feet of frontage is paved.
Part of this paved area serves an overhead door. The front of
area to the left, of this door could be landscaped.
Circulation: Circulation is adequate around the rear of the
property with an access road out the back that connects to the

3) Offset House Addition, Airport Parkway Berard Drive
1. Site grading especially parking area should be toward the north-east.
2. I would recommend the Airport Parkway access be eliminated and all access
to the site be from Berard Drive. Airport Parkway is a through street with a
constant increase in traffic.
5) New Storage Warehouse (Paul Adams), Berard Drive
1. Design of on site sewage disposal system shall be submitted prior to issuing
of building permit.
2. Site including parking area shall be graded so surface runoff is away from
cul-de-sac.
3. Water and power service to building must be separated by at least 10 feet.

6) Myers -Subdivision, Swift Street - Dorset Street
1. To conform with the Zoning Regulations for street rights -of -way (66' Swift
and 80'Dorset Street) a strip of land 8.25' in width on Swift Street and 7'
on Dorset Street should be deeded to the City. In addition a triangle piece
(25' each leg) should be obtained to allow for intersecting radii and day
lighting intersection.

MOTION OF APPROVAL
That the South Burlington Planning Commission grant site plan approval for
the application of the Olympiad, 70 Farrell Road, Mr. Gordon Woods, Agent, for
a construction of a 21'x42' and 30'x90' addition, as depicted on a plan en-
titled "Addition to the Olympiad", dated August 1983 as prepared by Gordon
G. Woods Associates, with the following stipulations:
1) That a drainage and finish grade plan be submitted to and approved by the
City Engineer prior to issuance of a permit.
2) That a landscaping bond in the amount of $1200 be posted prior to issuance
of a permit.
3) This approval expires in 6 months.

7) New England Telephone, Tilley property

A standard sidewalk,is being proposed along entire frontage. An 8" waterline
is required to service hydrants and adjoining Wright property. Chief Goddette
requests relocation of two fire hydrants.
Traffic impact and access addressed in a detailed traffic study by Dr. Oppen-
lander, summary of report enclosed.
Zoning Board of Adjustment granted approval for a maintenance shop within the
parking garage, request for a maintenance garage was withdrawn.
Size of sewer line (north -south) serving Dubois, Goodrich properties must be 12"
with a cost sharing agreement between people involved.
8) Olympiad, 70 Farrell Road
An application is pending before the Zoning Board of Adjustment for extension of
a conditional use. Hearing is continued to Wednesday, November 23, 1983.
Zoning Board of Adjustment feels that a traffic problem exists. The original
request was for an additional three courts, plus a storage and class room area.
Two of the proposed courts have been deleted.
Parking has been a problem during winter peak hours, normally 4-8 P.M. Vehicles
park along Farrell Road and Joy Drive. The parking lot is designed for seventy-
four vehicles. Cars are parking on grassed areas and the entrance turn -around.
An additional 52 spaces are proposed.
The area to the rear of the lot is presently a wooded enbankment, the finish
grade should be reviewed by the City Engineer along with the drainage.
An area to the northerly side to the proposed parking should be left open -
minimum of 20 feet to allow for access at two points. Four spaces will be loss
to accomplish this. The 35 foot treed buffer area along Joy Drive should not
be disturbed.
Landscaping is adequate, however, an additional $1200 is required.
City will consider an ordinance prohibited parking along Farrell Road and Joy
Drive at the December 5th meeting.

This project, consisting of amending the property line between
the two lots previously approved in Subdivision Permit EC-4-0747
and Deferral of Permit D-4-730 so that the two lots are now a
2.67 acre lot (with the structure approved in Certification of
Compliance PB-4-0020 and Land Use Permits PB-4-0765 and PB-4-
0765-1) and a 4.91 acre lot (proposed for the structure
referenced in Water Supply and Wastewater Disposal Permit WW-4-
0875) located off Farrell Street in the city of South
Burlington, Vermont is hereby approved under the requirements of
the regulations named above, subject to the following conditions.
GENERAL
1. The project shall be completed as shown on the plans Project
No. 94276 "Plat of Boundary Adjustment Between Gardens For
All, Inc. and Olym[piad Court Associates" dated December
1994 prepared by Civil Engineering Associates, Inc. and
which have been stamped "approved" by the Wastewater
Management Division. The project shall not deviate from the
approved plans without prior written approval from the
Wastewater Management Division.
2. Each prospective purchaser of each lot shall be shown a copy
of the approved plot plan and this Subdivision Permit prior
to conveyance of the lot.
3. The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee
and all assigns and successors in interest. The permittee
shall be responsible for the recording of this permit and
the "Notice of Permit Recording" in the South Burlington
Land Records within 30 days of issuance of this permit and
prior to the conveyance of any lot subject to .the
jurisdiction of this permit.
4. The 2.67 acre lot has been reviewed and is approved with the
existing structure referenced in permits PB-4-0020, PB-4-
0765 and PB-4-0765-1. No other buildings are allowed
without prior review and approval by the Agency, and such
approval will not be granted unless the proposal conforms to
the applicable laws and regulations.

5. The 4.91 acre lot has been reviewed and is approved for the
construction of the structure referenced in Water Supply and
Wastewater Disposal Permit WW-4-0875 on the approved lot.
Construction of other type dwellings, including public
buildings, duplexes, and condominium units, is not allowed
without prior review and approval by the Wastewater
Management Division and such approval will not be granted
unless the proposal conforms to the applicable laws and
regulations.
6. All conditions set forth in Certification of Compliance #PB-
4-0020 dated August 15, 1974 shall remain in effect except
as modified or amended herein.
7. All conditions set forth in Land Use Permits #PB-4-0765, EC-
4-0747 and PB-4-0765-1 dated December 28, 1982 March 15,
1983 and November 13, 1983 respectively shall remain in
effect except as modified or amended herein.
8. This permit shall supersede Deferral of Permit #D-4-0730
dated January 12, 1983, thereby rendering it null and void.
