Re: Findings of Fact, application of Dan Morrissey to amend
condition #7 of the 5/9/96 approval for National Gardening to
construct two (2) office buildings, 60 Farrell Street.
On the 24th day of September, 1996, the South Burlington Planning
Commission approved the request of Dan Morrissey under Section 303
of the South Burlington Subdivision Regulations based on the
following findings:
1) The applicant would like to amend condition #7 of the 5/9/96
approval for National Gardening to construct two (2) office
buildings at 60 Farrell Street. The condition reads as follows:
The applicant shall be responsible for widening the northern
leg of the Farrell Street/Swift Street intersection in
accordance with the plan entitled "National Gardening Farrell
St. Right Turn Lane, Site Plan," dated 2/95. This work shall
be completed prior to occupancy of the first office building.
2) The widening is needed to accommodate an additional turning
lane on Farrell Street. The widening will also incorporate a 5
foot wide bicycle lane on both sides of Farrell Street. In order
to accommodate the widening, a small easement is needed from the
property owner on the corner (i.e., 10 Farrell Street). The City
is very close to obtaining the easement, but it has not yet been
signed. The applicant would like to amend the condition to allow
the widening to be done in a phased approach. The widening to
accommodate the turn lane would be done now prior to occupancy of
the first office building. The additional widening to accommodate
the bicycle lanes would be done once the easement is signed weather
permitting. The applicant would post a bond for all improvements.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the request of Dan Morrissey, pursuant to
Section 303 of the Subdivision Regulations, to amend condition #7
of the 5/9/95 final plat approval for National Gardening to
construct two (2)office buildings, 60 Farrell Street, in accordance
with the following stipulation:
1. Conditon #7 of the 5/9/96 approval for National Gardening
Association is amended to read as follows:
"The applicant shall be responsible for widening the
northern leg of the Farrell Street/Swift Street
intersection in accordance with the plan entitled
"National Gardening Farrell St. Right Turn Lane, Site
Plan," dated 2/95 last revised 6/3/96. The widening to
accommodate the additional turn lane shall be done prior
to occupancy of the first office building. The
additional widening to accommodate the bicycle lanes
shall be done once an easement or land dedication is
obtained from 10 Farrell Street. The applicant shall
post a bond for all improvements prior to start of
construction."
