FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Final plat application #SD-00-72 of Wright & Morrissey Realty Corporation to
subdivide a 4.91 acre parcel into two (2) lots of 1.5 acres (lot #1) and 3.41 acres (lot
#2), 60 Farrell Street.
On the 16th day of January, 2001, the South Burlington Development Review Board
approved the final plat application of Wright & Morrissey Realty Corporation under
Section 204 of the Subdivision Regulations based on the following findings:
1. This project is to subdivide a 4.91 acre parcel into two (2) lots of 1.5 acres (lot #1)
and 3.41 acres (lot #2), 60 Farrell Street.
2. The owner of record is the 60 Farrell Street Corporation.
3. The property located at 60 Farrell Street lies within the C2 and C.O. District. It is
bounded on the north by the Olympiad Fitness Center, on the west by Farrell Street, on
the south by I-89, and on the est by WCAX studios.
4. Access/circulation: Access to lot two is provided by a 30 foot curb cut on Farrell
Street and access to lot one by a 24 foot curb cut on Joy Drive. Access to Joy Drive is
via a deeded right-of-way over the Olympiad property. No changes were proposed.
5. Circulation on the site is adequate.
6. Lot Size/frontage: Both of the proposed lots meet the minimum lot size
requirements. Lot one meets the minimum frontage requirement but lot two does not.
7. Coverage/setbacks: The building coverage and total coverage for both separate lots
is unknown. The Development Review Board previously approved this development
using the commercial and industrial coverages in order to encourage mixed use
development.
The existing building coverage for a ie total lot is 10% (30 % maximum). The total
coverage for the property is 44.01% (70% maximum).
The building on lot two will not meet front or side yard setbacks. Section 25.113(d) of
the zoning regulations requires additional setbacks for taller structures. The building
must have a front yard and rear yard setback no less than 40 feet and a side yard
setback of no less than 35 feet. A front yard setback of 10 feet is proposed. A side
yard setback of 19 feet is proposed along the northern boundary and therefore does not
meet this requirement. The Board may waive the requirements of this section as long
as the general objectives of the PUD and applicable zoning district are met.
8. Density: The maximum density for the property as it currently exists, based on
acreage, is 34.3 units of residential housing. The applicant is approved for 30 units of
housing on what will become lot two . The maximum density for lot two will be 10 units
of residential housing. The maximum density for lot two will therefore be exceeded two
fold.
9. Parking: The parking for both of these lots should remain shared in order to meet
the parking requirements for all of the approved uses.
10. C.O. District: The applicant has submitted finished grade contours that indicate that
disturbance will take place in the C.O. District.
11. Legal Documents: Staff recommended that a "Notice of Condition" be recorded
which has been approved by the City Attorney which states that for zoning and
subdivision purposes the two (2) lots will be treated as a one (1) lot planned unit
development as lot frontage, setbacks, density, and potentially coverages are not being
met for the individual lots.
12. Summary of Issues: All issues with this subdivision will be resolved with the
recording of the "Notice of Conditions."
DECISTON AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves final plat application #SD-00-72 of Wright/Morrissey Realty Corporation to
subdivide a 4.91 acre parcel into two (2) lots of 1.5 acres (lot #1) and 3.41 acres (lot
#2), 60 Farrell Street, as depicted on a two page set of plans, page one entitled "Final
Plat of Subdivision Property of National Gardening Association, Inc.," prepared by Civil
Engineering Associates, Inc., dated September 2000 with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.

2. Prior to recording the final plat plan, the applicant shall record a "Notice of
Condition" approved by the City Attorney which states that for zoning and subdivision
purposes the two (2) lots shall be considered as one lot.
I Any change to the final plat plans shall require approval by the South Burlington
Development Review Board.
4. The final plat plan (survey plat) shall be recorded in the South Burlington land
records within 90 days or this approval is null and void. The plan shall be signed by the
Development Review Board Chair or Clerk prior to recording. Prior to recording the final
plat plan, the applicant shall submit a copy of the survey plat in digital format. The
format of the digital information shall require approval of the Director.
