On the 27th of August 1991, the South Burlington Planning Commis- sion approved a request from John and Joyce Belter for a two (2) year extension under Section 605 of the South Burlington Subdivi- sion Regulations based on the following findings: 1. Section 605 of the subdivision regulations requires the subdivider to substantially construct the subdivision within three (3) years of the final plat approval or the approval be- comes null and void. This same section allows the Planning Commission, after a public hearing, to extend the approval for up to two (2) additional years if the Commission determines that the developer has, since final plat approval, been diligently and consistently pursuing financing or other approvals necessary for the project. 2. John and Joyce Belter received Final Plat approval for this project from the South Burlington Planning Commission on July 26, 1988. 3. Since October 3, 1988, the applicants have been pursuing an Act 250 permit. This permit was obtained on May 28, 1991. The following is a summation of the events leading up to the issuance of the Act 250 permit: Final Plat Approval - South Burlington PC Filed Act 250 Land Use Permit Application Act 250 Hearing Dist. Environmental Commission #4 Denial Appealed to Environmental Board Environmental Board Public Hearing Reconvened Proposed Finding Filed Hearing Panel Deliberations Environmental Board Reconvened Land Use Permit Issued Appeal Period Ended July 26, 1988 October 3, 1988 November 30, 1988 February 3, 1989 July 28, 1989 January 17, 1990 February 7, 1990 March 5, 1990 March 26, 1990 August 23, 1990 November 13, 1990 December 21, 1990 March 6, 1991 March 21, 1991 April 4, 1991 April 9, 1991 May 9, 1991 May 28, 1991 June 29, 1991 DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Plan- ning Commission approves a two (2) year extension to the approval of a subdivision of 14.68 acres into 36 single-family lots locat- ed adjacent to and north of Country Club Estates development off Poor Farm Road as the applicant has demonstrated that he has been diligently pursuing the original approval.
