Dear Marla,
Please find enclosed the City of South Burlington’s Conditional Use Application requesting that the
Development Review Board consider the extension of the regulations of the T-5 Transect to the entire
proposed Lot B1 (currently under consideration for subdivision) on Market Street.
The proposed Lot B1 is a split lot with the district boundary line between the T-5 Transect and the T-4
Transect running across and within 50 feet of the northeasternly corner of proposed Lot B1.
The City, along with the land owner, South Burlington City Center, LLC have proposed subdividing Lot B
(178,303 square feet) into three parcels Lot B1 (26,994 square feet), Lot B2, and the remainder of the
parent Lot B under a separate application.
Under 3.03 C. of the South Burlington Land Development Regulations, where a district boundary line
divides a lot which was in a single ownership at the time of passage of these regulations, the development
Review Board may permit, as a conditional use, the extension of the regulations for either portion of the
lot but not to exceed fifty (50) feet beyond the district line into the remaining portion of the lot.
The existing undeveloped proposed lot Lot B1 is located within the following zoning districts: Transect
Zone 5 (majority of the site), Transect Zone 4, and the Transit Overlay District.
Please see the attached application, narrative, survey plat, draft site plan, additional details as well as the
abutting property owner list. This application only proposes a conditional use permit. Any future site
improvements will be permitted through separate permit applications.

Plans shall be submitted which shows the information required by the City’s Land Development Regulations.
Three (3) regular size copies, one reduced copy (11" x 17"), and one digital (PDF-format) copy of the plans must
be submitted. A subdivision application fee shall be paid to the City at the time of submitting the application.

NOTE: NOTIFICATION of ADJOINING PROPERTY OWNERS: Notification of adjoining property owners, in
accordance with 24 V.S.A. §4464(a) and Section 17.06(B) of the South Burlington Land Development
Regulations, is the responsibility of the applicant. After deeming an application complete, the Administrative
Officer will provide the applicant with a draft meeting agendas or public hearing notice and sample certificate of
service. The sworn certificate of service shall be returned to the City prior to the start of any public hearing.

180 Market Street Narrative: Conditional Use Review
A. Description of the Project
The City of South Burlington is submitting a Conditional Use Review Application for a split zoned lot,
proposed Lot B1. The applicant is requesting that Transect T-5 regulations be extended beyond the
district line to encompass the entire proposed lot (that which falls within the Transect T-4 zoning district).
Lot B1 is a portion of a parcel of land which is proposed under a separate application to be subdivided
along the boundary of a future street on the City’s official map. The zoning map results in this proposed
Lot B1 having a small triangular corner that is Transect T-4, while the bulk of the property is Transect T-5.
Proposed Lot B1 is located on the north side of Market Street, just east of 145 Market Street and west of
the intersection of Market Street with the future public street (proposed Lot B2). Lot B2 is proposed to
become a new support street with driveways to the new public library, city hall and senior center, Rick
Marcotte Central School, Allard Square residential parking, and future developments to the east.
The City is requesting a Conditional Use Review in order to submit a cleaner site plan application for
Lot B1. Approximately 20 feet of a future building (which is almost wholly, but not entirely in the
Transect T-5) would land on the northeastern side of the district boundary (the Transect T-4 side). The
City is proposing that the Transect T-5 be extended northeasterly all the way to the corner of the
property to facilitate a cleaner site plan application. This would result in the application of Transect T-5
Form Based Code standards to the planned project.
B. Demonstration of Compliance with Applicable Review Standards
Per the South Burlington Land Development Regulations 3.03 C. Split lots, “Where a district boundary
line divides a lot which was in a single ownership at the time of passage of these regulations, the

Development Review Board may permit, as a conditional use, the extension of the regulations for either
portion of the lot but not to exceed fifty (50) feet beyond the district line into the remaining portion of
the lot (See Article 14 for Conditional Use Review). This provision shall not apply to the boundary lines of
any overlay or floating district.”
This lot was under the ownership of South Burlington City Center, LLC at the time that the Transect zones
were applied, and was part of one parcel, when the Land Development Regulations applied two zones to
the one lot.
The district line is within 50 feet of the corner of property towards which the applicant is proposing the
Transect T-5 be extended.
The Form Based Code District is not an overlay or floating district.
a) Zoning District and Dimensional requirements.
Lot dimensions are not applicable. There are no lot dimension requirements within the T5 or the T4
District.
Block Dimensions are not applicable as the proposed street and connection to Market Street is shown on
the Official Map.
b) Conditional Use: General Review Standards 14.10, E.
If the Transect T-5 district boundary is extended to the northeast less than 50 feet, this shall not result in
undue adverse effect on
(1) The capacity of existing or planned community facilities;
● The proposed extension will facilitate the creation of planned public library, city hall and senior
center facility as it will create a cleaner site plan application if the building corner does not
overlap into a second zone, the Transect T-4 zone, and this extension of zoning will not affect the
Rick Marcotte Central School nor the existing or proposed roadways .
(2) The character of the area affected, as defined by the purpose or purposes of the zoning district within
which the project is located, and specifically stated policies and standards of the municipal plan;
● The proposed extension will facilitate the creation of planned public library, city hall and senior
center facility which will enhance the character of the area by “establishing and enhancing public
buildings and gathering spaces...” which will “transform a retail area into a true downtown”
(Comprehensive Plan 3-9; 3-12).
(3) Traffic on roads and highways in the vicinity;
● The proposed extension does not affect the amount of traffic on roads and highways in the
vicinity as it has no impact on trips.
(4) Bylaws and ordinances then in effect;
● The proposed extension does not affect the project’s ability to meet the Form Based Code District
requirements.
(5) Utilization of renewable energy resources.

The proposed extension does not affect the project’s ability to utilize or provide renewable energy
resources.
The extension of Transect T-5 will not result in undue adverse effect on these items.
