SITE PLAN APPLICATION #SP‐19‐33
FINDINGS OF FACT AND DECISION
Snyder Braverman Development Co, LLC, hereinafter referred to as the applicant, is seeking
approval to amend a previously approved plan for a 60‐unit multi‐family residential building
with subsurface parking. The amendment consists of replacing the trash building with an
enclosure and reconfiguring the approved open space, 310 Market Street.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a 60‐unit multi‐
family residential building with subsurface parking. The amendment consists of replacing
the trash building with an enclosure and reconfiguring the approved open space, 310
Market Street.
2. The owner of record of the subject property is Snyder Braverman Development Co, LLC.
3. The subject property is located in the FBC T‐4 Zoning District.
4. The application was received on August 9, 2019.
5. The plans consist of a six (6) page set of plans, as follows

Only the standards below are affected by this application. All other standards will continue to be
met.
CITY CENTER FORM BASED CODES STANDARDS
Section 8.08 Open Space Requirements
The applicant has proposed 60 housing units and is required to provide at least 3,600 s.f. of open
space. Qualifying open space must be located on site or within 150’ of the site and directly accessible
from the site; 50% or more must be commonly accessible to all tenants/residents. There is no public
realm requirement.

The applicant has proposed 3,745 s.f. of qualifying open space on‐site or within 150’ of the site ,
including 660 s.f. of rain garden, 1,285 s.f. of community garden” at 1,285 s.f., and enhanced
wetlands/stormwater treatment area at 1,800 s.f.
The applicant has proposed to reconfigure the community garden in order to create additional
separation between the revised dumpster enclosure and the garden plots. The Administrative
Officer finds that the applicant must revise the previously approved Sheet 3 Landscaping Plan to
reflect the revised community garden configuration shown in the Revised Raised Bed Configuration
exhibit dated 8/22/2019. All other open space conditions in the existing approval continue to apply.
SITE PLAN STANDARDS
Section 14.07 Specific Review Standards
C. Disposal of Wastes. All dumpsters and other facilities to handle solid waste, including
compliance with any recycling or other requirements, shall be accessible, secure and properly
screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s).
Small receptacles intended for use by households or the public (ie, non‐dumpster, non‐large
drum) shall not be required to be fenced or screened.
Waste disposal is proposed to be handled by replacing the approved detached accessory
building with a shadowbox fence enclosure. The fence is proposed to be 6‐feet high and lined
by solid exterior grade sheathing on three sides. The enclosure will be accessed by three sets of
double swing doors, which will not be sheathed and will face away from the adjacent
community garden open space. The dumpsters themselves will be either flat or slant top units
with a side door allowing trash to be placed in the dumpster without opening the lid, and will be
no greater than 90‐5/16” high. Lids will be secured with a front mount locking bar as shown in
the exhibits submitted by the applicant.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP‐19‐33 of Snyder Braverman Development Co, LLC, subject to the following
conditions:
1. All previous approvals and stipulations which are not superseded by this approval will
remain in effect.
2. This project must be completed as shown on the plans submitted by the applicant and on
file in the South Burlington Department of Planning and Zoning.
3. Dumpster equipment shall be as shown on the provided exhibits or equivalent.
4. The plans must be revised to show the changes below and shall require approval of the
Administrative Officer. One complete copy of the approved revised plan set and one
electronic copy must be submitted to the Administrative Officer prior to issuance of the
zoning permit.

a. Revise the previously approved Sheet 3 Landscaping Plan to reflect the revised
community garden configuration shown in the Revised Raised Bed Configuration
exhibit dated 8/22/2019.
5. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04
of the Land Development Regulations or this approval is null and void.
6. All products installed in the qualifying open space must be of high quality materials intended to
be used for commercial application, pursuant to Appendix G.
7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to
use or occupancy of any building.
8. Any change to the site plan will require approval by the South Burlington Development
Review Board or the Administrative Officer.

a Notice of Appeal with the secretary of the Development Review Board. This Notice of Appeal
must be accompanied with a $233 filing fee and be filed within 15 days of the date of this
decision.
