HomeMy WebLinkAboutCU-00-11 SP-00-20 - Decision - 0091 Ethan Allen Drive#CU-00- I I & SP-00-20 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan and conditional use applications of Michael Burham to convert 2,250 of an 11,250 square foot single -story building for storage/distribution uses to automotive repair use. On the 16th of May, 2000, the South Burlington Development Review Board approved Michael Burham's conditional use application under Section 26.05 and site plan application under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting 2,250 of an 11,250 square foot single -story building for storage/distribution uses to automotive repair use. On August 8, 1989 the Planning Commission approved the construction of the 11,250 square foot single story building with five units for multiple tenants. 2. The property is in the Industrial/Commercial Zone. It is bounded on the west by a storage/distribution facility, on the north by Ethan Allen Drive, and on the east and south by Commerce Avenue. 3. Access: Access is shown from both Ethan Allen Drive on the north and Commerce Avenue on the south. 4. Circulation: Circulation is along the length of the eastern side of the building. A 24-foot aisle width is located between the parking spaces and loading zones for the building. 5. Parking The property requires 20 spaces. The proposed use requires for the unit requires four (4) parking spaces. There are currently 21 parking spaces on -site with four designated per unit. One handicapped space is provided as is required. These parking spaces are currently not striped. These parking spaces should be striped before permit issuance. A bike rack must be provided for the property. The plan shall be revised to show perpendicular spaces and show the existing parking area configuration. 6. Landscaping The site is well landscape and the project will not require additional landscaping. The plan should be revised to show landscaping as it currently exists. 7. Setback/Coverage: All setback requirements are met. Front yard coverage is unknown. Building coverage is 291/o (maximum 30% allowed). Total lot coverage is 661/6 (maximum permitted is 70%). 8. Traffic: No additional traffic is expected and the traffic impact fees have already been paid for this lot. 9. Lighting All lights have been approved by the Director of Planning and Zoning. 10. p=ster All dumpsters must be screened and illustrated on the site plan. Currently, there are several unscreened dumpsters on the lot. 11. Other: Parking spaces are currently being used for storage of mulch, etc. This outside storage is not approved. All outside storage should be removed from the property prior to issuance of a Certificate of Occupancy/Compliance for the new use. 12. Conditional Use Criteria: The proposed use complies with the stated purpose of the Mixed Industrial and Commercial District to encourage "a range of individual commercial uses... that will serve adjacent area and/or the traveling public and that will be mutually compatible with industrial activity." The proposed use will not adversely affect: a) the capacity of existing or planned community facilities. No affect expected. b) the character of the area affected. No adverse affect is expected. c) traffic on roads or highways in the vicinity. The proposed use is not expected to impact traffic. d) bylaws in effect. The proposal is in conformance with the zoning regulations. e) utilization of renewable energy resources. There is no utilization of renewable energy resources to be affected. f) general public health and welfare. No adverse affect expected. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves site plan application #SP-00-20 and conditional use application #CU-00-11 of Michael Burham to convert 2,250 of an 11,250 square foot single -story building for storage/distribution uses to automotive repair use, 91 Ethan Allen Drive, as depicted on a one page set of plans entitled "Storage/Distribution Facility, Ethan Allen Drive, Lot 18, So. Burlington, Vermont", prepared by Graphic Services, dated 5-2-89, last revised on 6-8-89, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plans shall be revised to show the changes listed below and shall require approval of the Director 2 of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised plans shall be submitted to the Director prior to permit issuance. a) The site plan shall be revised to show all dumpsters screened. b) The plan shall be revised to show perpendicular spaces and show the existing parking area configuration as it actually exists. c) The plan shall be revised to show a bike rack. d) The plan shall be revised to show landscaping as it currently exists. e) The plan shall be revised to show the current front yard coverages. 3. The approved parking spaces shall be striped before issuance of a Certificate of Occupancy/Compliance for the new use. 4. All outside storage shall be removed from the property prior to issuance of a Certificate of Occupancy/Compliance for the new use. 5. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 6. Any new exterior lights shall consist of downcasting fixtures. Any change to the approved lights shall require approval of the Director prior to installation. 7. That portion of the building containing the automotive repair and service use shall be sprinklered or include an alternative fire protection system approved by the Fire Chief. 8. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the newly converted space. 9. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the Zoning Regulations or this approval is null and void. 10.
