On the "' day of October, 1998, the South Burlington Planning Commission approved the request of Real Charlebois for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting a vacant lot into a temporary contractor's yard not including retail. This lot has been used for this use during the past summer without approvals and a permit. This application is to cure the violation. 2. This property located at 90 Ethan Allen Drive lies within the IC District. It is bounded on the north by undeveloped land, on the east by a residence, on the west by an auto repair shop, and on the south by Ethan Allen Drive. 3. Access/circulation: Access is proposed to be via a 20 foot curb cut on Ethan Allen Drive. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 0% (maximum allowed is 30%). Overall coverage is 50% (maximum allowed is 70%). Front yard coverage is 17% (maximum allowed is 30%). 5. The fuel tank and enclosure do not meet the front and side yard setback requirements. Plan should be revised to show the tank and enclosure relocated to meet the setback requirements. 6. Parking: This use requires a total of five (5) parking spaces. There are no designated parking spaces on the plan. The plan should be revised to show the five (5) required spaces including one (1) handicapped space and a bike rack. 7. Landscaping There is no minimum landscaping requirement, based on building costs, for this project. 8. Sewer: No sewer allocation needed. 9. Lighting: No exterior lighting proposed. 10. Traffic: This project is exempt from the road impact fee. 11. Dumpster: No dumpster proposed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Real Charlebois to convert a vacant lot into a contractor's yard not including retail, 90 Ethan Allen Drive, as depicted on a plan entitled, "Real Charlebois Ethan Allen Drive South Burlington, Vermont," prepared by Frank R. O'Brien, P.E., dated 8/26/98, last revised on 9/15/98, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) This use is approved on a temporary basis until 3/1/99. All material on the site shall be removed by 4/ 1 /99. 3) The plan shall be revised to show the changes listed below and shall require approval of the Director of Planning & Zoning. Three (3) copies of the approved revised plan shall be submitted to the Director of Planning & Zoning prior to permit issuance. a) The site plan shall be revised to relocate the fuel tank and enclosure to meet the front and side yard setback requirements. b) The site plan shall be revised to show five (5) parking spaces including one (1) handicapped space. 4) The Planning Commission waives the landscaping requirement since this is a temporary use. 5) A depressed concrete curb shall be constructed at the new curb site. 6) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 2 7) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the property. 8) Any change to the site plan shall require approval by the South Burlington Planning Commission.
