Architects to construct a 6000 square foot building for warehousing and a contractor's yard, not including retail, 90 Ethan Allen Drive. On the 29r' day of June 1999, the South Burlington Planning Commission approved the site plan application of J.G. Architects to construct a 6000 square foot building for warehousing and a contractor's yard, not including retail, under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 6,000 square foot building for warehousing and a contractor's yard not including retail on a 0.98 acre lot. This property located at 90 Ethan Allen Drive lies within the IC District. It is bounded on the north by undeveloped land, on the east by a residence, on the west by an auto repair shop, and on the south by Ethan Allen Drive. 2. The owner of record of this property is S.P. Larson Construction, Inc. 3. Access/circulation: Access is proposed to be via a 20 foot curb cut on Ethan Allen Drive. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 14% (maximum allowed is 30%). Overall coverage is 37% (maximum allowed is 70%). Front yard coverage is 18.3% (maximum allowed is 30%). Setback requirements are met. 5. Parking: A total of 18 parking spaces are required and 17 spaces are spaces including one (1) handicapped space and a bike rack are being provided. The plan should be revised to add one (1) additional space. 6. Landscaping: The minimum landscaping required, based on building costs, is $4500 which is being met. Plantings will include Pagoda Dogwood, Red Maple and River Birch Clump. 7. Sewer: The sewer allocation requested is 240 gpd. The applicant will be required to pay the per gallon fee prior to permit issuance. 8. Dumpster: The dumpster will be stored behind the building. 9. Traffic: This project is exempt from the road impact fees. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of J.G. Architects, Inc. to construct a 6000 square foot building for warehousing and a contractor's yard, not including retail, as depicted on a plan entitled, "S.P. Larson Construction, Inc. 90 Ethan Allen Drive South Burlington Vermont," prepared by J.G. Architects, Inc., dated 5/10/99, 90 Ethan Allen Drive, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the revised plan shall be submitted to the Director prior to permit issuance. a) The site plan shall be revised to add one (1) additional parking space. 3. All exterior lighting shall consists of downcasting shielded fixtures. Any change to approved lights shall require approval of the Director prior to installation. Prior to issuance of a zoning permit, the applicant shall submit details of proposed building mounted lights to the Director for approval. 4. Prior to issuance of a zoning permit, the applicant shall post a $4500 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 5. The building shall be sprinklered. 6. The new curb cut shall include a depressed concrete curb. The existing curb cut shall be closed with a new concrete barrier curb. 7. The Planning Commission approves a sewer allocation of 240 gpd. The applicant shall pay the per gallon fee prior to permit issuance. 8. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 9. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the building. 10.
